A special meeting of the Civil Service Commission was held on Friday, July 17, 2020, at 10:00 a.m., in Trenton, New Jersey.

PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on July 8, 2020, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified.

B-1 ELYSSA LOIACONO - CSC DOCKET NO. 2020-1833

Elyssa Loiacono appeals the determination of the Division of Agency Services which found that she did not meet the experience requirement for the open competitive examination for Senior Registered Environmental Health Specialist, Public Health (C0832A), Warren County.

ACTION: The Civil Service Commission directed that this appeal be granted.

B-2 LATOYA HARRIS - CSC DOCKET NO. 2020-2723

LaToya Harris requests to have her application for Parole Officer Recruit, Bilingual in Spanish and English (S1001A), Statewide applied to Parole Officer Recruit (S1000A), Statewide.

ACTION: The Civil Service Commission directed that this request be granted in part.

B-3 LUCERO ADAMES - CSC DOCKET NO. 2020-2311

Lucero Adames appeals the decision to remove her name from the Correctional Police Officer (S9988A), Department of Corrections, eligible list on the basis of an unsatisfactory driving record

ACTION: The Civil Service Commission directed that this appeal be denied.

B-4 H.D. - CSC DOCKET NO. 2019-3698

H.D., a Senior Technician MVC, appeals the determination of the Director, Office of Compliance, Motor Vehicle Commission (MVC), which found that he had violated the State Policy Prohibiting Discrimination in the Workplace (State Policy).

ACTION: The Civil Service Commission directed that this appeal be denied.

B-5 B.M. - CSC DOCKET NO. 2020-2582

B.M., a Supervisor of Professional Residential Services with Vineland Developmental Center (VDC), appeals the decision of the Chief of Staff, which did not substantiate her allegations that she was subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace (State Policy).

ACTION: The Civil Service Commission referred the allegations concerning whether M.H. sexually harassed B.M. and/or called her a gender pejorative term to the Office of Administrative Law for a hearing. The remained of the appeal is denied.

B-6 SHERIFF’S OFFICERS, UNION COUNTY - CSC DOCKET NO. 2021-2

The Policemen’s Benevolent Association, Sheriff’s Officers of Union County, Local Number 108, Inc., represented by Brian J. Manetta, Esq., petitions for interim relief to preclude Union County and the Union County Sheriff’s Office (UCSO) from requiring that unit members screen temperatures or manually take the temperatures of any individuals.

ACTION: The Civil Service Commission directed that this petition be denied.

B-7 DAQING SONG - CSC DOCKET NO. 2020-636

Daqing Song, a Research Scientist 2 with the Department of Human Services (DHS), appeals the calculation of his salary under N.J.A.C. 4A:3-4.9.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-8 CHRISTOPHER D’ERRICO - CSC DOCKET NO. 2020-1846

Christopher D’Errico appeals the determination of the Division of Agency Services (Agency Services) that his position with the Department of Health is properly classified as a Program Specialist 1. The appellant seeks a Program

Specialist 2 job classification in this proceeding.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-9 TROY KELSEY - CSC DOCKET NO. 2019-2216

Troy Kelsey requests to be permitted to submit a late application for the Institutional Trade Instructor 1, Cooking (S0501A), Statewide examination.

ACTION: The Civil Service Commission directed that this request be granted.

B-10 LAURA RICHARDS - CSC DOCKET NO. 2019-2216

Laura Richards appeals the determination of the Division of Agency Services (Agency Services) that she did not meet the education requirement for the open competitive examination for Public Health Consultant 2, Nutrition ((S2099W), Statewide.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-11 M.A. - CSC DOCKET NO. 2020-644

M.A. appeals the removal of his name from the Correctional Police Officer (S9988A), Department of Corrections eligible list on the basis of an unsatisfactory criminal record.

ACTION: The Civil Service Commission directed that this appeal be granted.

B-12 AIRAN FERNANDEZ - CSC DOCKET NO. 2020-1155

Airan Fernandez petitions the Civil Service Commission for reconsideration of the decision rendered on September 10, 2019, which found that his scores are correct on the promotional examination for Police Captain (PM1838W), Linden.

ACTION: The Civil Service Commission directed that this request be denied.

B-13 MANUEL RODRIGUEZ , ET AL. - CSC DOCKET NO. 2020-2576 ET AL.

Manuel Rodriguez, Thurman Bridgers, Katrina Waith, Shontaya Lockhart, and Beverly Dewberry request reconsideration of the decision rendered on January 29, 2020, which determined that their positions with the Department of Corrections are properly classified as Communications Operator, Department of Corrections.

ACTION: The Civil Service Commission directed that these requests be denied.

ACTION: The Civil Service Commission directed that this appeal be granted.

B-15 SCHOOL OF CONSERVATION, MONTCLAIR STATE UNIVERSITY LAYOFF - CSC DOCKET NO. 2020-2722

The Communications Workers of America (CWA), represented by Hetty Rosenstein, Area Director, petitions for a stay of the layoff of Montclair State University (MSU) employees in the New Jersey School of Conservation scheduled for August 3, 2020.

ACTION: The Civil Service Commission directed that this petition be denied.
