THE CIVIL SERVICE COMMISSION

    A regular meeting of the Civil Service Commission was held on Wednesday, August 3, 2022, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Daniel O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2021, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

Submitted for adoption are the Civil Service Commission minutes of its meeting of July 20, 2022.

 

ACTION:     The Civil Service Commission adopted the minutes of its meeting of July 20, 2022.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Luann Barnett, Department of the Treasury, removal.

 

Scott Stein, Lawrence, Department of Public Safety, suspension.

 

ACTION:  The Civil Service Commission noted the withdrawal of appeals without prejudice.    

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

Sergei Hillman, Bergen County, Department of Public Safety, removal.

 

Anabelle Rodriguez, Middlesex County, Adult Corrections Center, removal.

 

ACTION: The Civil Service Commission noted the dismissal of appeals without prejudice.

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    GREMIER ALEMANY AND LUCAS ZARATE – CSC DOCKET NOS. 2018-3600, ET AL. (Consolidated)

 

Gremier Alemany and Lucas Zarate, disqualification from the examination for Fire Captain (PM1051V), Paterson for cheating.

 

Recommendation of the Administrative Law JudgeGrant the appeals.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge and provided appropriate remedies.

 

A-3    MOHAMMED HAMIDU – CSC DOCKET NO. 2019-2538

 

Mohammed Hamidu, Human Service Technician, Greystone Park Psychiatric Hospital, Department of Health, removal, effective May 9, 2017, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the removal.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    DAVID PETERSON – CSC DOCKET NO. 2021-1425

 

David Peterson, Senior Repairer, Stockton University, removal, effective July 9, 2020, on charges of conduct unbecoming a public employee and other sufficient cause.

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:     The Civil Service Commission modified the removal to a six-month suspension.

 

A-5    ALTON PORTER – CSC DOCKET NO. 2022-1964

 

Alton Porter, Senior Correctional Police Officer, Northern State Prison, Department of Corrections, removal, effective February 16, 2022, on charges of conduct unbecoming a public employee, falsification and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    J.M. – DOCKET NO. 2022-681

         

J.M., represented by Stephen B. Hunter, Esq., appeals his rejection as a Police Officer candidate by Elizabeth and its request to remove his name from the eligible list for Police Officer (S9999A) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be dismissed.

 

B-2    JAMES ARPINO– DOCKET NO. 2022-2306

         

James Arpino appeals his bypass on the certification (PL210681) resulting from the examination for Battalion Fire Chief (PM2170W), Voorhees.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    L.M.– DOCKET NO. 2022-2029

         

L.M. appeals the bypass of her name on the Human Services Specialist 3 (PC2626W), Monmouth County eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    ZORAIDA POZO – DOCKET NO. 2022-2549

         

Zoraida Pozo requests to file a late application for the open competitive examination for Police Officer (M0117D), Paterson.

 

ACTION:     The Civil Service Commission directed that this request be granted.

  

B-5    ANTOINETTE ABDUL-HAKEEM – DOCKET NO. 2022-2853

         

Antoinette Abdul-Hakeem appeals the decision of the Division of Agency Services which found that she did not meet the experience requirements for the promotional examination for Keyboarding Clerk 2 (PM3723D), East Orange.

 

ACTION:     The Civil Service Commission directed that this appeal be denied, and the classification of the appellant’s provisional position be referred to the Division of Agency Services for review.

 

B-6    PATRICE BASSETT – DOCKET NO. 2022-2239

         

Patrice Bassett appeals the determination of the Division of Agency Services which found that she did not meet the requirements for the promotional examination for Records Manager (PM4891C), City of Camden.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    JENNIFER FISCHER, ET AL. – DOCKET NOS. 2022-3001, ET AL.

         

Jennifer Fischer, Jacqueline Kulsick, and Anthony Lawrence appeal the determinations of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Program Specialist 1, Social/Human Services (PS6260K), New Lisbon Developmental Center.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-8    DONNA GREEN – DOCKET NO. 2022-2729

         

Donna Green appeals the decision of the Division of Agency Services which found that, per the substitution clause for education, she did not meet the experience requirements for the promotional examination for Management Assistant (PS6973K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    VIDAL GUZMAN-SANCHEZ – DOCKET NO. 2022-2982

         

Vidal Guzman-Sanchez appeals the decision of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Principal Drafting Technician (PM3730D), East Orange.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-10   ROBERT ILER – DOCKET NO. 2022-2946

         

Robert Iler appeals the decision of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Environmental Scientist 3, Public Health (PS3937H), Department of Health.

 

ACTION:     The Civil Service Commission directed that this appeal be denied, and the classification of the appellant’s provisional position be referred to the Division of Agency Services for review.

 

B-11   MARIAH KENNEDY – DOCKET NO. 2022-3141

         

Mariah Kennedy appeals the decision of the Division of Agency Services which found that she did not meet the experience requirements for the promotional examination for Senior Account Clerk (PM3861D), Cape May City.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-12   SHAWN KING AND SHEFIT MERSIMI– DOCKET NOS. 2022-3184 AND 2022-3031

         

Shawn King and Shefit Mersimi appeal the determinations of the Division of Agency Services and they did not meet the experience requirements for the open competitive examination for Senior Repairer (S0311D), Statewide.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

 

B-13   SANDRA KLIMECZAK AND ANTHONY RODRIGUEZ – DOCKET NOS. 2022-2998 AND 2022-3000

         

Sandra Klimeczak and Anthony Rodriguez appeal the determinations of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Program Specialist 2, Social/Human Services (PS6261K), New Lisbon Developmental Center.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-14   ISAAC LANE – DOCKET NO. 2022-2028

         

Isaac Lane appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Painter (M0538B), Newark School District.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-15   QUEENIQUEKA PARISH – DOCKET NO. 2022-2685

         

Queeniqueka Parish appeals the decision of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Administrative Analyst 2, (PS7386U), Department of the Treasury.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-16   STEPHEN RICE – DOCKET NO. 2022-3079

         

Stephen Rice appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Analyst Grant Application/Program Monitor (C0581C), Morris County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-17   ROBERT MINKLER, JR. – DOCKET NO. 2022-2911

         

Robert Minkler Jr., appeals the determination of the Division of Agency Services denying his request for a make-up examination for Deputy Fire Chief (PM1791A), Woodbridge.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

 B-18   MATTHEW DUGAN – DOCKET NO. 2022-2491

         

Matthew Dugan appeals his oral score on the promotional examination for Deputy Police Chief (PM4496C), Bayonne.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-19   JOHN FRANCESCHINO – DOCKET NO. 2022-3185

         

John Franceschino appeals his score for on the essay portion of the examination for Police Captain (PM3481C), Phillipsburg.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-20   GLENN GASTON, SR. – DOCKET NO. 2022-3164

         

Glenn Gaston, Sr., appeals his score for on the essay portion of the examination for Police Captain (PM4059C), Union City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-21   JOSEPH MOSCINSKI– DOCKET NO. 2022-717

         

Joseph Moscinski appeals his score for the oral portion of the promotional examination for Fire Lieutenant (PM0125A), Harrison.

 

ACTION:     The Civil Service Commission directed that this appeal be granted and the appellant’s score for the technical component of the evolving scenario be changed from 2 to 4.

 

B-22   DOROTHY JO WALTERS – DOCKET NO. 2022-2646

         

Dorothy Jo Walters appeals the decision of the Division of Agency Services that the proper classification of her position with Gloucester County is Welder. She seeks a classification of Senior Welder in these proceedings.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

 

B-23   S.Y-G. – DOCKET NO. 2022-2993

         

S.Y-G., an Investigator 2, Real Estate Commission with the Department of Banking and Insurance, appeals the decision of an Assistant Insurance Commissioner, which was unable to substantiate some of her allegations that she was subject to discrimination in violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-24   BARBARA FAY – DOCKET NO. 2022-714

         

Barbara Fay, a Librarian 1, represented by Patricia A. Villanueva, Esq., appeals her separation from employment, effective August 13, 2021, with the Orange Public Library.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-25   MICHAEL OAKLEY – DOCKET NO. 2022-555

         

Michael Oakley, a former part-time Fire Prevention Specialist with Ewing Township, requests relief regarding the elimination of his work hours.

 

ACTION:     The Civil Service Commission directed that this request be granted in part.

 

B-26   HUMAN RESOURCE COORDINATOR (M0542B), NEWARK SCHOOL DISTRICT – DOCKET NO. 2022-3045

         

Newark School District requests permission not to make an appointment from the March 14, 2022 certification for Human Resource Coordinator (M0542B), Newark School District.

 

ACTION:     The Civil Service Commission granted the appointment waiver and deferred selection costs.
