          A regular meeting of the Civil Service Commission was held on Wednesday, August 14, 2019, at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca (via phone) and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on August 5, 2019, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

 

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    T.B. (consolidated)

 

T.B., Senior Medical Security Officer, Ann Klein Forensic Center, Department of Health, removal effective March 5, 2018, on charges of conduct unbecoming a public employee and physical or mental abuse of a patient.

 

Recommendation of the Administrative Law JudgeUphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    DAVID BOYD

 

David Boyd, County Correction Officer, Cumberland County, Department of Corrections, removal effective October 12, 2018, on charges of conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    JUAN CORTES (on remand)

 

Juan Cortes, Boiler Operator, Jersey City School District, 90 working day suspension on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the 90 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    ROBERT GUNDY

 

Robert Gundy, Custodial Worker, Newark Public School District, removal and resignation not in good standing effective October 15, 2018, on charges of chronic or excessive absenteeism or lateness, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law JudgeDismiss the appeal for failure to appear.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    REACTIVATION AND REALLOCATION OF MICROBIOLOGIST TRAINEE TITLE – CSC DOCKET NO. 2020-348

 

          The Division of Agency Services recommends reactivation and reallocation of the Microbiologist Trainee title to the non-competitive division of the career service in accordance with N.J.A.C. 4A:3-1.2.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-2    C.S. – CSC DOCKET NO. 2019-332

 

          C.S. appeals his rejection as a Fire Fighter candidate by the North Hudson Regional Fire and Rescue and its request to remove his name from the eligible list for Fire Fighter (M1557T) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    MATTHEW BERMUDEZ – CSC DOCKET NO. 2019-1649

 

          Matthew Bermudez, represented by Brian M. Gerstein, Esq., appeals his removal from the eligible list for Police Officer (S9999U), Linden on the basis that he possessed an unsatisfactory driving record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    JOSHUA BERRY – CSC DOCKET NO. 2019-2671

 

          Joshua Berry appeals his removal from the eligible list for Police Officer (S9999U), Gloucester Township on the basis that he falsified his application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    THOMAS KMETZ – CSC DOCKET NO. 2019-1295

 

          The Division of Agency Services, on behalf of Hopatcong Borough, requests that the list for Police Captain (PM1843R), Hopatcong Borough be revived in order to effectuate the appointment of Thomas Kmetz effective May 1, 2017.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-6    MICHAEL GOLUB – CSC DOCKET NO. 2019-2523

 

          Michael Golub requests a retroactive appointment date as a Deputy Attorney General 3 effective January 6, 2018, with the Department of Law and Public Safety.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-7    JILL GIANNINI – CSC DOCKET NO. 2019-1967

 

          Jill Giannini appeals the bypass of her name on the Sheriff’s Officer Sergeant (PC2636V), Burlington County Sheriff eligible list.

         

ACTION:     The Civil Service Commission directed that this matter be referred to the Office of Administrative Law for a hearing.

 

B-8    YOUTH OPPORTUNITY COORDINATOR (M0039T), CITY OF NEWARK – CSC DOCKET NO. 2019-733

 

          The appointing authority’s failure to dispose of the certification for Youth Opportunity Coordinator (M0039T), City of Newark, while a provisional is serving in the title, has been referred to the Civil Service Commission for enforcement.

 

ACTION:     The Civil Service Commission ordered the appointing authority to remove the provisional appointee, make an appointment from the certification, and pay compliance costs in the amount of $1,000.

 

B-9    JUDITH BUDAY – CSC DOCKET NO. 2020-66

 

          Judith Buday appeals the determination of the Division of Agency Services which found that she did not meet the minimum requirements in experience for the open-competitive examination for Social Worker, Aging (C0059A), Hunterdon County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-10  SCOTT MULLEN – CSC DOCKET NO. 2019-3556

 

          Scott Mullen appeals the determination of the Division of Agency Services which found that he did not meet the minimum requirements in experience for the open-competitive examination for Senior Planning Aide (C2008W), Cape May County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-11  JACQUELINE TILLMAN – CSC DOCKET NO. 2019-2764

 

          Jacqueline Tillman appeals the decision of the Division of Agency Services which found that she did not meet the experience requirements for the promotional examination for Human Services Specialist 1 (PC0199A), Gloucester County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-12  EDWARD GENTILE – CSC DOCKET NO. 2019-3483

 

          Edward Gentile appeals the decision of the Division of Agency Services which found that his position with Hudson County is properly classified as Truck Driver. The appellant seeks a Maintenance Worker 3, Grounds job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13  PATRICIA HORRELL – CSC DOCKET NO. 2019-3580

 

          Patricia Horrell appeals the decision of the Division of Agency Services which found that her position with the Department of Health is properly classified as Technical Assistant 2. The appellant seeks a Technical Assistant 3 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-14  ANJU BAJAJ – CSC DOCKET NO. 2019-3645

 

          Anju Bajaj appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Head Procurement Clerk (PS4587K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied and the classification of the appellant’s provisional position be referred to Agency Services for further review.

 

B-15  DIANA BAUER – CSC DOCKET NO. 2020-15

 

          Diana Bauer appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Executive Secretarial Assistant (PS8865H), Department of Health.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-16  RENE CICCHETTI – CSC DOCKET NO. 2019-3526

 

          Rene Cicchetti appeals the decision of the Division of Agency Services which found that, per the substitution clause for education, she did not meet the experience requirements for the open-competitive examination for Assistant Chief of Administrative Services (C0946W), Hudson County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied and the classification of the appellant’s provisional position be referred to Agency Services for further review.

 

B-17  SAMANTHA MAURO – CSC DOCKET NO. 2019-2907

 

          Samantha Mauro appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the open competitive examination for Human Services Specialist 2 (C0143A), Warren County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-18  DANIEL SULLIVAN – CSC DOCKET NO. 2019-3579

 

          Daniel Sullivan appeals the determination of the Division of Agency Services which found that he did not meet the minimum requirements in experience for the promotional examination for Equipment Operator (PC2984W), Ocean County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-19  DOROTHY WILLIAMS – CSC DOCKET NO. 2019-3474

 

          Dorothy Williams appeals the determination of the Division of Agency Services that the proper classification of her position with the Department of the Treasury is Senior Clerk. The appellant seeks a Technical Assistant job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-20  NICHOLAS MAHER – CSC DOCKET NO. 2020-88

         

          Nicholas Maher appeals the administration of the physical performance portion of the examination for Fire Fighter (M1863W), Paterson.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-21  TUCKER BROWN – CSC DOCKET NO. 2019-2817

 

          Tucker Brown requests that his residency be changed after the closing date for the eligible lists produced from the examination for Fire Fighter (M9999W).

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-22  HELDER FONSECA – CSC DOCKET NO. 2019-3607

 

          Helder Fonseca appeals the determination of the Division of Agency Services denying his request for a make-up examination for Battalion Fire Chief (PM2157W), Newark.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-23  CHRISTOPHER D’AMICO – CSC DOCKE NO. 2019-3554

 

          The City of Plainfield, represented Littie E. Rau, Esq., petitions the Civil Service Commission (Commission) for a stay of the Commission’s May 9, 2019 decision, pending the outcome of its appeal to the Appellant Division.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

         

B-24  VICTOR PERALTA – CSC DOCKET NO. 2019-3649

 

          Victor Peralta appeals the determination of the Division of Administrative Support denying his request for a make-up examination for County Correction Sergeant (PC2926W), Hudson County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-25  JASON LOMBARDI – CSC DOCKET NO. 2019-3167

 

          Jason Lombardi appeals the removal of his name from the eligible list for Fire Lieutenant (PM1071V), Carteret on the basis that he failed to respond to a priority provisional certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted and a priority provisional certification be issued.

 

B-26  JOHN MIKORSKI – CSC DOCKET NO. 2019-2118

 

          John Mikorski, represented by Brian J. Manetta, Esq., appeals the removal of his name from the eligible list for Police Officer (S9999U), Morristown on the basis of an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-27  JENNIFER ATTANASIO – CSC DOCKET NO. 2019-3642

 

          Jennifer Attanasio appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Technical Assistant (PS4828K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-28  JASMINE GOVANI – CSC DOCKET NO. 2020-10

 

          Jasmine Govani appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Quality Assurance Specialist, Health Services (PS8866H), Ann Klein Forensic Center.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-29  ILSE HYDE – CSC DOCKET NO. 2019-3725

 

          Ilse Hyde appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Senior Clerk Typist (PS9007J), Rowan University.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-30  ODELL ROLLING, III – CSC DOCKET NO. 2019-2649

 

          Odell Rolling, III appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Sewer Repairer 2/Water Repairer 3 (M0932W), East Orange.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-31  PATRICIA INGELIDO – CSC DOCKET NO. 2019-2820

 

          Patricia Ingelido requests to be permitted to submit a late application for the Manager 3 Environmental Protection, Technical/Scientific/Engineering (PS9309G), Department of Environmental Protection, examination.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-32  SELWYN CORLEY – CSC DOCKET NO. 2019-2475

 

          Selwyn Corley, a County Correction Officer with Camden County, Department of Corrections, represented by Frank C. Cioffi, Esq., requests to reinstate the appeal of his six working day suspension, which was dismissed on the basis of his failure to appear at the July 9, 2019 settlement conference at the Office of Administrative Law.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-33  CHIEF CLERK (C0543W), BERGEN COUNTY – CSC DOCKET NO. 2020-218

 

          The Bergen County Clerk requests permission not to make an appointment from the February 4, 2019 certification for Chief Clerk (C0543W).

 

ACTION:     The Civil Service Commission granted the appointment waiver and deferred selection costs.

 

B-34  CRIME PREVENTION SPECIALIST (M0296T), CITY OF ORANGE – CSC DOCKET NO. 2019-1911

 

          The City of Orange requests permission not to make an appointment from the February 1, 2016 certification for Crime Prevention Specialist (M0296T).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-35  ROSALYN WILLIAMS – CSC DOCKET NO. 2019-1714

 

          Rosalyn Williams appeals the appointing authority’s request to remove her name from the eligible list for Correctional Police Officer (S9999U), Department of Corrections, on the basis of an unsatisfactory employment record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-36  PAUL GORE – CSC DOCKET NO. 2019-87

 

Paul Gore appeals the determination of the Division of Agency Services which found that per the substitution clause for education, he was below the minimum requirements in experience for the promotional examination for Fiscal Analyst (P6566I), State Parole Board.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-37  DOMENICO SACCA – CSC DOCKET NO. 2019-3585  

 

Domenico Sacca appeals the determination of the Division of Agency Services which found he did not meet the experience requirements for the promotional examination for Road repairer2/Sign Maker 2 (PM2458W), Elizabeth.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-38  L.L. – CSC DOCKET NO. 2018-3240

 

L.L. requests reconsideration of the final decision of the Civil Service Commission, rendered on March 27, 2019, which upheld the removal of her name from the Correction Officer Recruit (S9988U), Department of Corrections, eligible list.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-39  I.E. – CSC DOCKET NO. 2019-1758

 

I.E., a Principal Clerk Typist with the Office of the Public Defender (OPD), represented by Brian Powers, CWA Local 1033, appeals the determination of the OPD, which found that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.  

 

ACTION:     The Civil Service Commission directed that this appeal be granted, but no further action is required.

 

PUBLIC PORTION

 

          No comment.
