A regular meeting of the Civil Service Commission was held on Wednesday, August 27, 2008, in Trenton, New Jersey.
PRESENT: Margaret E. L. Howard, Presiding Member; Members Flavella Branham and Robert Long; Pamela Ullman, Deputy Attorney General; and Elizabeth Napolitano, Deputy Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Presiding Member Margaret E. L. Howard, opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 21, 2007, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey. All actions were by unanimous vote unless otherwise specified.
It is noted that agenda items A-4 and B-99 were considered at the conclusion of the agenda to allow for the items to be discussed in Executive Session.

A-2 ERICK AGINS (REMAND)
Erick Agins, Supervisor, Traffic Maintenance, City of Trenton, Department of Public Works, 10-day suspension on charges of inability to perform duties and neglect of duties.
Recommendation of the Administrative Law Judge - Dismiss the appeal with prejudice.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to dismiss the appeal without prejudice.
A-3 MARTY DIAS
Marty Dias, Police Officer, City of East Orange, Police Department, 10 working day and 90 working day suspensions on charges of chronic or excessive absenteeism and neglect of duty.
Recommendation of the Administrative Law Judge - Modify the 10 working day and 90 working day suspensions to a 6-month suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
Agenda items A-4 and B-99 were held to be considered at the conclusion of the regular agenda. At that time, a motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Civil Service Commission entered into Executive Session because the matters involved issues of confidentiality on the matters of A-4 Edward Day and B-99 Dean Spencer. The Board subsequently reconvened the public meeting.
A-4 EDWARD DAY
Edward Day, Senior Correction Officer, Juvenile Justice, Juvenile Justice Commission, Department of Law and Public Safety, 15-day suspension on charges of conduct unbecoming a public employee, and violation of rules.
Recommendation of the Administrative Law Judge - Uphold the 15-day suspension.
ACTION: The Civil Service Commission remanded the matter to the Office of Administrative Law.
A-5 GENERAL MCFADDEN
General McFadden, Fire Alarm Operator, City of Paterson, Fire Department 30-day suspension on charges of conduct unbecoming a public employee and other sufficient cause regarding violations of various City policies, among other things, unprofessional conduct, harassment and false statements.
Recommendation of the Administrative Law Judge - Uphold the 30-day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-6 NAGY SOLIMAN
Nagy Soliman, Supervising Electrician, Borough of Fair Lawn, Public Works Department, eight day suspension on charges of neglect of duty and other sufficient cause.
Recommendation of the Administrative Law Judge - Reverse the eight-day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-7 BENJAMIN J. TRAVERS
Benjamin J. Travers, Cottage Training Technician, New Lisbon Developmental Center, Department of Human Services, indefinite suspension pending the outcome of criminal charges, on charges of robbery, unlawful possession of weapons and possession of weapons for unlawful purposes and removal effective June 14, 2007 on charges of physical abuse of a client and verbal abuse of a client.
Recommendation of the Administrative Law Judge - Uphold the removal. It is noted that the indefinite suspension is moot, as it is the same date as the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-8 KAREEM HOWZE
Kareem Howze, County Correction Sergeant, Hudson County, Corrections Department, removal effective April 12, 2006 on charges of conduct unbecoming a public employee, insubordination, neglect of duty, incompetency, inefficiency or failure to perform duties and other sufficient cause.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-9 CORINE JOHNSON
Corine Johnson, School Traffic Guard, Township of Irvington, Police Department, removal effective April 23, 2007 on charges of neglect of duty and incompetency, inefficiency or failure to perform duties.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to dismiss the appeal for lack of jurisdiction.
A-10 GEORGE KANDAKAI
George Kandakai, Human Services Technician, Greystone Park Psychiatric Hospital, Department of Human Services, two removals effective January 9, 2007, one on the charge of violation of a policy or procedure and one on the charge of falsification.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-11 JOAQUINA LARANJEIRA
Joaquina Laranjeira, Grounds Worker, Kean University, removal effective December 23, 2006 on charges of conduct unbecoming a public employee, and other sufficient cause regarding violation of NJ Executive Order #49.
Recommendation of the Administrative Law Judge - Dismiss the appeal with prejudice.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to dismiss the appeal without prejudice.
A-12 YVONNE PINCKNEY
Yvonne Pinckney, Technical Assistant 1, Department of Treasury, return to formerly held permanent title at the end of the working test period effective June 26, 2007. This matter was held over from the July 16, 2008 Civil Service Commission meeting.
Recommendation of the Administrative Law Judge - Grant a new working test period.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to uphold the return to her formerly held permanent title at the end of the working test period.

Christopher Esposito, Police Officer, Borough of Rutherford, Police Department, removal effective August 5, 2005 on charges of misconduct, incompetency, inefficiency or failure to perform duties, inability to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause.
Recommendation of the Administrative Law Judge - Modify the removal to a three month suspension.
ACTION: The Civil Service Commission rejected the recommendation of the Administrative Law Judge and acknowledged the settlement.
A-15 MICHAEL HOWE
Michael Howe, Police Officer, City of Clifton, Police Department, release at the end of the working test period. This matter was held over from the February 13, 2008 Merit System Board meeting.
Recommendation of the Administrative Law Judge - Grant a new shortened working test period of six months.
ACTION: The Civil Service Commission rejected the recommendation of the Administrative Law Judge and acknowledged the settlement.
A-16 MAUREEN BYRD
Maureen Byrd, Correction Sergeant, Edna Mahan Correctional Facility for Women, Department of Corrections, 60-working day suspension on charges of safety and security precautions, loss or careless control of radios, mace or handcuffs, performance, neglect of duty, loafing, idleness or willful failure to devote attention to tasks which could result in danger to persons or property and 10-working day suspension on charges of conduct unbecoming a public employee and violation of a rule, regulation, policy, procedure, order or administrative decision.
Recommendation of the Administrative Law Judge - Dismiss the appeal.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to dismiss the appeal without prejudice.
A-17 LIZETTE IRIZARRY
Lizette Irizarry, Correction Officer, County of Hudson, Department of Corrections, 30-day suspension on charges of insubordination, conduct unbecoming public employee and neglect of duty.
Recommendation of the Administrative Law Judge - Reverse the 30-day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-18 JAMES J. KEARNS, MICHAEL K. DELANCEY AND KEVIN BUCKLEY
1) James J. Kearns, Police Sergeant, City of Elizabeth, Police Department, 183-day suspension and demotion to the title of Police Officer effective February 8, 2006, on charges of violation of rules and regulations regarding police image, conduct unbecoming a public employee and other sufficient cause.
2) Michael K. Delancey, Police Lieutenant, 95-day suspension and demotion to the title of Police Sergeant, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause.
A-18 JAMES J. KEARNS, MICHAEL K. DELANCEY AND KEVIN BUCKLEY (CONTINUED) 3) Kevin Buckley, Police Sergeant, 96-day suspension and demotion to the title of Police Officer, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty, and other sufficient cause.
Recommendation of the Administrative Law Judge - 1) Modify Kearns's 183-day suspension to a 60-day suspension and reverse the demotion to Police Officer, 2) modify Delancey's 95-day suspension to a 30-day suspension and reverse the demotion to Police Sergeant and 3) modify Buckley's 96-day suspension to a 15-day suspension and reverse the demotion to Police Officer.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-19 LORENZO VALENTIN
Lorenzo Valentin, Police Officer, City of Newark, Police Department, 12-day suspension on charges of violation of Department rules and regulations regarding conduct in public and private and conduct unbecoming a public employee.
Recommendation of the Administrative Law Judge - Reverse the 12-day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-20 WALTER YOUNG
Walter Young, Police Lieutenant, Township of Irvington, Police Department, 60-day suspension on charges of insubordination, withholding information and obedience to laws and regulations.
Recommendation of the Administrative Law Judge - Reverse the 60-day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-21 JULIA ANDERSON
Julia Anderson, County Correction Officer, County of Burlington, County Jail, 1) 10-day suspension, 2) 10-day suspension, 3) 20-day suspension, 4,5,6,7,8) five removals effective December 8, 2007, on charges of chronic or excessive absenteeism or lateness, other sufficient cause and attendance policy.
Recommendation of the Administrative Law Judge - 1) Uphold the 10-day suspension, 2) uphold the 10-day suspension 3) uphold the 20-day suspension, 4) uphold the removal, 5) reverse the removal, 6) uphold the removal, 7) reverse the removal, and 8) uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-22 JUDY JILES
Judy Jiles, Assistant Family Service Worker 3, Department of Children and Families, removal effective May 30, 2007 on charges of leaving an assigned work area without permission but not creating a danger to persons or property, neglect of duty, falsification, use of state vehicle for unauthorized or unofficial purposes and conduct unbecoming a public employee.
Recommendation of the Administrative Law Judge - Modify the removal to a six-month suspension.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to uphold the removal.
A-23 WILLIAM LEE
William Lee, Senior Correction Officer, Garden State Youth Correctional Facility, Department of Corrections, 15-working day suspension and removal effective April 18, 2007, on charges of insubordination, other sufficient cause, inappropriate physical contact or mistreatment of an inmate, patient, client, resident, or employee, conduct unbecoming a public employee and threatening, intimidating, harassing, coercing, or interfering with fellow employees on State property.
Recommendation of the Administrative Law Judge - Uphold the 15-working day suspension and removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-24 LARRY TAYLOR
Larry Taylor, Senior Food Service Handler, Vineland Developmental Center, Department of Human Services, removal effective April 21, 2006, on charges of creating a disturbance on State property, intimidating, coercing or interfering with fellow employees on State property and conduct unbecoming a public employee.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1 JAMES FITZGERALD
James Fitzgerald appeals his rejection as a Police Officer candidate by Atlantic City and its request to remove his name from the eligible list for Police Officer (S9999H) on the basis of medical unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-2 GARY VANNOZZI
Gary Vannozzi appeals his rejection as a County Correction Officer by Mercer County and its request to remove his name from the eligible list for County Correction Officer (S9999F) on the basis of medical unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-3 WILLIAM BOAL
William Boal, a Senior Correction Officer at Albert C. Wagner Youth Correctional Facility, Department of Corrections, represented by Henry J. Cistrelli, Esq., appeals the denial of sick leave injury (SLI) benefits.
ACTION: The Civil Service Commission directed that this appeal be granted in part.

B-12 MARIE R. DESARME
Marie R. Desarme appeals the decision of the Division of State Human Resource Management, which removed the appellant's name from the Charge Nurse 12 Months (S9346H) employment list due to the appellant's failure to respond to the Certification Notice.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-13 ANITA O'NEAL
Anita O'Neal, represented by Louis C. Guarino, Esq., appeals the determination of the Division of Local Human Resource Management (LHRM), which upheld the appointing authority's bypass of her name on the May 9, 2007 certification of the eligible list for Police Sergeant (PM2541F), Trenton.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-14 PAUL A. ZIELINSKI
Paul A. Zelinski, represented D. William Subin, Esq., appeals the decision of the Division of Local Human Resource Management (LHREM), which upheld the appointing authority's decision to bypass his name on the eligible list for Police Sergeant (PM2567G), Wildwood City.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-15 ASSISTANT ENGINEER (M1410H), VERONA TOWNSHIP
Verona Township requests permission not to make an appointment from the October 29, 2007 certification for Assistant Engineer (M1410H).
ACTION: The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.
B-16 ASSISTANT VIOLATIONS CLERK (M1753J), MORRISTOWN
Morristown requests permission not to make an appointment from the February 4, 2008 certification for Assistant Violations Clerk (M1753J).
ACTION: The Civil Service Commission denied the request for an appointment waiver and ordered the appointing authority to properly dispose of the certification and remit $500 in compliance costs.
B-17 CASHIER (M1622J), NEWARK
The appointing authority's failure to dispose of the certification for Cashier (M1622J), Newark, while a provisional is serving in the title, has been referred to the Civil Service Commission for enforcement.
ACTION: The Civil Service Commission ordered the appointing authority to remove the provisional appointee, make an appointment from the certification, and pay compliance costs.
B-18 CRIME PREVENTION AIDE (M6324H), UNION TOWNSHIP
Union Township, represented by Arthur R. Thibault, Jr., Esq., requests permission not to make an appointment from the July 10, 2006 certification for Crime Prevention Aide (M6324H).
ACTION: The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.
B-19 SENIOR CLERK (M1059H), CITY OF PATERSON
The City of Paterson requests permission not to make an appointment from the October 17, 2006 certification for Senior Clerk (M1059H).
ACTION: The Civil Service Commission granted the request for an appointment waiver but assessed partial selection costs in the amount of $1,024.
B-20 JAYANTILAL PATEL
Jayantilal Patel, a Principal Environmental Engineer, Water Resources, with the Department of Environmental Protection, appeals the determination of the Assistant Commissioner, Management and Budget, with the Department of Environmental Protection, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-21 ANGELO CATALDO
Angelo Cataldo, a former Court Executive with the Judiciary, Bergen Vicinage, represented by Christian P. Stueben, Esq., appeals the determination of the appointing authority, which denied his claim for Supplemental Compensation on Retirement (SCOR) for unused sick leave.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-22 ROBERT A. GALLAGHER
Robert A. Gallagher appeals the decision of the Division of State Human Resource Management, which determined that his effective date of reclassification of his position from Hazardous Site Mitigation Specialist 1 to Site Manager was September 1, 2007.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-23 KAREN ABBOTT
The Department of Transportation requests that the eligible list for Manager 2, Department of Transportation, Procurement (PS0951T) be revived in order to effectuate the permanent appointment of Karen Abbott, effective March 29, 2008.
ACTION: The Civil Service Commission granted the request.
B-24 BELINDA CHISARICK AND ROSE MCDERMOTT
Belinda Chisarick and Rose McDermott, Administrative Assistants 3 with the Department of Environmental Protection, appeal their lateral title changes.
ACTION: The Civil Service Commission directed that these appeals be denied.
B-25 DAVID ABER, ET AL.
Independence Township petitions for retroactive appointment dates as Police Sergeants for David Aber and Keith Aiello and as a Police Chief for Dennis Riley.
ACTION: The Civil Service Commission granted the request.
B-26 ARDRA ESCALERA
Monmouth County petitions for retroactive permanent appointment date as a Telephone Operator for Ardra Escalera.
ACTION: The Civil Service Commission granted the request.
B-27 MICHELLE FEDORKO
Michelle Fedorko, a Customer Service Representative 4 with the Motor Vehicle Commission, represented by Paul Curcio, Representative, CWA Local 1033, appeals her resignation in good standing, effective February 15, 2008.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-28 AFOLABI BABALOLA
Afolabi Babalola, represented by Eric Winston, Esq., requests reconsideration of the decision rendered on April 23, 2008 by the Merit System Board which found sufficient basis to grant the request of Passaic County to remove his name from the list of eligibles for Juvenile Detention Officer (C2065D), County of Passaic.
ACTION: The Civil Service Commission denied the request for reconsideration.
B-29 ANTHONY IRVIN
Anthony Irvin, a Custodial Worker with the Newark School District, represented by Sasha A. Wolf, Esq., requests reconsideration of the decision rendered on September 20, 2006, which upheld the dismissal of his appeal of is 20-day suspension, based on his failure to appear at his scheduled settlement conference.
ACTION: The Civil Service Commission granted the request for reconsideration.
B-30 DENISE LONG, ET AL.
Joshua M. Ottenberg, Acting Camden County Prosecutor, on behalf of Denise Long, Linda Rusin, and Roseanne Skalkowski, requests reconsideration of the decision rendered on April 23, 2008, which found that, per the substitution clause for education, they were below the minimum requirements in experience for the promotional examination for Paralegal Specialist (PC1775H), Camden County.
ACTION: The Civil Service Commission granted the requests for reconsideration.
B-31 ROBERT L. ROBINSON
Robert L. Robinson requests reconsideration of the decision rendered on January 16, 2008, which upheld the removal of his name from the eligible list for Juvenile Detention Officer (C2128G), Warren County and (C2125G), Hudson County.
ACTION: The Civil Service Commission denied the request for reconsideration.

The appeal of Freddie B. John Garton and Douglas Inferrera, Jr. Appeal the awarding of volunteer points to the score of Gregory Maines for the eligible list for Fire Fighter (M2373H), Millville.
ACTION: The Civil Service Commission directed that these appeals be granted and Mr. Maines' volunteer points be removed from his score and the application for Fire Fighter be revised as specified.

Diana Diaz appeals her score on the promotional examination for Records Technician 2 (Motor Vehicles) (PS3989T) and Records Technician 3 (Motor Vehicles) (PS4975T), Motor Vehicle Commission.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-111 ANITA DIAZ
The Office of the Public Defender, on behalf of Anita Diaz, requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to permit P. Jeffrey Wintner to donate more than ten leave days to Ms. Diaz and to allow her to receive more than the 180 donated leave days allowed to a recipient.
ACTION: The Civil Service Commission granted the request.
B-112 VALERIE HAYNES
The Department of Law and Public Safety, on behalf of Valerie Haynes, requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to permit her to donate more than ten leave days to Maryann Pullen, who is participating in the donated leave program.
ACTION: The Civil Service Commission granted the request.

Daniel Ritzel, James Shellem, Charles Love, Joseph Hanlin, and Gregory Vandenberg, Police Lieutenants with Atlantic City, appeal the determination of the Division of Selection Services, which denied their request to reduce the one-year service requirement in the title of Police Lieutenant to the completion of the working test period for the promotional examination for Police Captain (PM3519K), Atlantic City.
ACTION: The Civil Service Commission directed that this appeal be granted.
