A regular meeting of the Civil Service Commission was held on Wednesday, September 1, 2021, at 10:00 a.m., in Trenton, New Jersey.

PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Allison Chris Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2020, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

Brian Ambroise, Senior Correctional Police Officer, Edna Mahan Correctional Facility, Department of Corrections, removal effective December 4, 2020, on charges of conduct unbecoming a public employee and other sufficient cause.

Recommendation of the Administrative Law Judge – Modify the removal to a 20 working day suspension.

ACTION: The Civil Service Commission modified the recommendation of the ALJ and modified the removal to a six-month suspension.

A-3 JUAN CRUZ – CSC DOCKET NOS. 2020-2534, ET AL. (Consolidated)

Juan Cruz, County Correctional Police Officer, Hudson County, Department of Corrections, 30, 60 and 90 working day suspensions on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty, chronic or excessive absenteeism or lateness, inability to perform duties and other sufficient cause.

Recommendation of the Administrative Law Judge – Uphold the 30 working day suspension, modify the 60 working day suspension to a 30 working day suspension and modify the 90 working day suspension to a 30 working day suspension.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-4 BRIAN HOAGLAND - CSC DOCKET NO. 2020-810

Brian Hoagland, Emergency Medical Technician, Gloucester County, Department of Emergency Response, 72 working hour suspension, on charges of insubordination, conduct unbecoming a public employee and neglect of duty.

Recommendation of the Administrative Law Judge – Uphold the 72 working hour suspension.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5 KODI POLLOCK – CSC DOCKET NO. 2020-1113

Kodi Pollock, Senior Correctional Police Officer, South Woods State Prison, Department of Corrections, 30 working day suspension on charges of insubordination, conduct unbecoming a public employee and neglect of duty.

Recommendation of the Administrative Law Judge – Uphold the 30 working day suspension.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

SECTION B – MISCELLANEOUS MATTERS

B-1 FIRE INSTRUCTOR – CSC DOCKET NO. 2022-44

The Division of Agency Services requests reallocation of the local government title of Fire Instructor to the non-competitive division of the career service in accordance with N.J.A.C. 4A:3-1.2, effective September 11, 2021.

ACTION: The Civil Service Commission directed to that the request be granted.

B-2 C.R. – CSC DOCKET NO. 2020-2750

C.R., represented by Luretha M. Stribling, Esq., appeals his rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove his name from the eligible list for Correctional Police Officer (S9988A), Department of Corrections, on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-3 J.E. – CSC DOCKET NO. 2021-134

J.E., represented by Ben Weathers, Esq., appeals his rejection as a Police Officer candidate by the Township of Teaneck and its request to remove his name from the eligible list for Police Officer (S9999A) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-4 RACHEL ADAMS – CSC DOCKET NO. 2021-1332

Rachel Adams appeals the decision to remove her name from the Parole Officer Recruit (S1000A), State Parole Board eligible list on the basis of an unsatisfactory background report.

ACTION: The Civil Service Commission directed that this appeal be denied.

Highlander Castaneda appeals the removal of his name from the Police Officer (S9999A), Linden eligible list on the basis of an unsatisfactory background report.

B-6 JA’MAURI CHUMISO, SR. – CSC DOCKET NO. 2021-1894

Ja’mauri Chumiso, Sr., appeals the decision to remove his name from the Correctional Police Officer (S9999A), Department of Corrections eligible list on the basis of an unsatisfactory criminal record and falsification of application.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-7 CHRISTOPHER DUNLAP – CSC DOCKET NO. 2021-1818

Christopher Dunlap, represented by Bette R. Grayson, Esq., appeals the removal of his name from the Fire Fighter (M1838W), Township of Hillside, eligible list on the basis of falsification of the employment application.

ACTION: The Civil Service Commission directed that this appeal be granted.

Lucas Greenwood appeals his removal from the eligible list for County Correctional Police Officer (S9999A), Camden County for failing to complete pre-employment processing.

Bette Feldeisen appeals the decision of the Division of Agency Services which found that her position with Stockton University is properly classified as Crew Supervisor, Plumbers and Steamfitters. The appellant seeks an Assistant Supervisor of Building Repairs job classification.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-15 MICHAEL PAPPANO – CSC DOCKET NO. 2021-1791

Michael Pappano appeals the decision of the Division of Agency Services that the proper classification of his position with the Office of Information Technology is Administrative Analyst 3, Information Systems. The appellant seeks an Administrative Analyst 4, Information Systems or a Data Processing Systems Programmer 1 job classification.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-16 DAVID RADSNIAK – CSC DOCKET NO. 2021-1198

David Radsniak appeals the decision of the Division of Agency Services, which found that his position with the Borough of Point Pleasant is properly classified as Police Lieutenant. The appellant seeks a Police Captain classification.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-17 IRIS WILCOX – CSC DOCKET NO. 2022-74

Iris Wilcox appeals the decision of the Division of Agency Services that the proper classification of her position with New Jersey City University is Administrative Assistant 2. The appellant seeks a Professional Services Specialist 1, Administrative Services or Professional Services Specialist 2, Administrative Services job classification.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-18 COORDINATOR YOUTH ACTIVITIES (C0257A/C0056B), BERGEN COUNTY – CSC DOCKET NO. 2022-142

Bergen County requests permission not to make an appointment from the November 19, 2020 certification for Coordinator Youth Activities (C0257A/C0056B), Bergen County.

ACTION: The Civil Service Commission granted the appointment waiver and assessed no current selection costs.

B-19 LEGAL SECRETARY 1 (C0320W), BERGEN COUNTY – CSC DOCKET NO. 2021-1749

The matter of Bergen County’s failure to make an appointment from the OL180500 certification for Legal Secretary 1 (C0320W), Bergen County has been referred to the Civil Service Commission for review.

ACTION: The Civil Service Commission directed Bergen County to pay selection costs in the amount of $2,048.

Dean Testa, represented by Robert K. Chewning, Esq., appeals the bypass of his name on the Police Sergeant (PM0861V), Rockaway Township eligible list.

Bobby Stubbs, Jr., appeals his non-appointment from the Juvenile Detention Officer (Special), Cumberland County eligible list.

Maryann Horan appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Personnel Director (PM2439C), Montville.

ACTION: The Civil Service Commission directed that this appeal be denied and the classification of the appellant’s position be referred to the Division of Agency Services for further review.

Jeffrey Adams, represented by Giovanna Giampa, Esq., requests reconsideration of the decision rendered on March 24, 2021, which denied his appeal to have his name restored to the eligible list for County Correctional Police Officer (S9999U), Essex County on the basis that he falsified his preemployment application.

ACTION: The Civil Service Commission directed that this request be denied.

Jose Cardona, Jr., requests reconsideration of In the Matter of Jose Cardona, Jr., et al. James Hartnett, a former Police Captain with Pennsauken represented by Katherine D. Hartman, Esq., requests reconsideration of In the Matter of James Hartnett (CSC, decided June 30, 2021) which denied his petition for interim relief of his separation from employment, effective April 30, 2021.

ACTION: The Civil Service Commission directed that this request be denied.

B-49 D.F. – CSC DOCKET NO. 2021-1690

D.F., an Agency Services Representative 3 with the Department of Health, requests reconsideration of In the Matter of D.F. (CSC, decided Marth 24, 2021) which denied her appeal of the determination of the Chief of Staff, which was unable to substantiate her allegation that she was subject to discrimination or retaliated against in violation of the New Jersey State Police Prohibiting Discrimination in the Workplace.

ACTION: The Civil Service Commission directed that this request be denied.

B-50 VICTOR VAZQUEZ, ET AL. – CSC DOCKET NO. 2022-156

The City of Hackensack, represented by Raymond Wiss, Esq., requests a stay of the Civil Service Commission decision in In the Matter of Victor Vazquez, et al. (CSC, decided July 21, 2021), pending its appeal to the Appellant Division.

ACTION: The Civil Service Commission directed that this request be denied.

The Superior Court of New Jersey, Appellate Division, has remanded the matter of William Able’s request for back pay for further proceedings.

ACTION: The Civil Service Commission awarded back pay in the amount of $12,108.93

Jon Cohen appeals his eligibility for Auditor 2 (PS0425U), Department of the Treasury.

The Department of Environmental Protection (DEP) requests that Autumn Angelus, an Entomologist Mosquito Extermination with Salem County, be permitted to intergovernmentally transfer to the title of Principal Biologist Mosquito Control, Office of Mosquito Control, DEP.
