A regular meeting of the Merit System Board was held on Wednesday October 10, 2007, in Trenton, New Jersey.
PRESENT: Chairman Rolando Torres, Jr., Merit System Board Members, John Currie, Flavella Branham, Margaret E. L. Howard and Robert J. Long; Pamela Ullman, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Chairman Rolando Torres Jr., opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 8, 2006, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.

ACTION: The Merit System Board acknowledged the settlements.
A-2 MITCHELL CHASMAR
Mitchell Chasmar, Police Sergeant, Township of Weehawken, Department of Public Safety, 10-day suspension on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, other sufficient cause.
Recommendation of the Administrative Law Judge - Modify the 10-day suspension to a 30-day suspension.
ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to uphold the 10-day suspension.
A-3 STEVEN HUBBS
Steven Hubbs, Police Officer, City of Camden, Police Department, fine $6,902 (equal to 25 days pay) (five days held in abeyance) on the charge of violation of Police Department rules and regulations regarding truthfulness.
Recommendation of the Administrative Law Judge - Uphold the fine $6,902 (equal to 25 days pay) (five days held in abeyance).
ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a 60-working day suspension.
A-4 EDITH RIOS
Edith Rios, Senior Clerk Typist, City of Trenton, Housing and Economic Development Department, 10-working day suspension on charges of insubordination and failure to comply with Department policy.
Recommendation of the Administrative Law Judge - Dismiss the appeal for lack of jurisdiction.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

Patricia David, County Correction Officer, County of Gloucester, Department of Correctional Service, removal effective October 6, 2006, on the charge of conduct unbecoming a public employee.

Carlton Mayfield, Laborer, City of Orange, Department of Public Works, removal effective February 21, 2006, on the charge of neglect of duty.

A-9 SHELBY COWANS AND RAUL MENDEZ (CONSOLIDATION)
Shelby Cowans and Raul Mendez, Senior Correction Officers, Northern State Prison, Department of Corrections, removal effective September 6, 2006, on charges of neglect of duty and other sufficient cause.
Recommendation of the Administrative Law Judge - Reverse the removals.
ACTION: The Merit System Board directed that this matter be held over.
A-10 ANN MARIE MORRIS
Ann Marie Morris, Senior Correction Officer, Garden State Youth Correctional Facility, Department of Corrections, removal, on charges of conduct unbecoming a public employee, violation of rule, regulation, policy, procedures, order or administrative decision and use, possession or sale of any controlled dangerous substance.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-11 JOHN ROBERTSON
John Robertson, Building Maintenance Worker, County of Hudson, Department of Roads and Public Property, removal effective August 9, 2006, on charges of insubordination, job abandonment, conduct unbecoming a public employee, falsification of records and violation of the County no smoking policy.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board modified the removal to a 4-month suspension.
A-12 LESLYE SCIPIO
Leslye Scipio, Senior Medical Security Officer, Ann Klein Forensic Center Psychiatric Hospital, Department of Human Services, removal effective March 22, 2006, on the charge of physical abuse of a patient.
Recommendation of the Administrative Law Judge - Reverse the removal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-13 APRIL WILSON
April Wilson, Clerk, County of Essex, Prosecutor's Office, was removed effective July 26, 2004, on charges of incompetency, inefficiency and failure to perform duties, insubordination, inability to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause. This matter was held over from the September 26, 2007 Merit System Board meeting.
Recommendation of the Administrative Law Judge - Modify the removal to a 30-day suspension and a resignation in good standing.
ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to uphold the removal.
A motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Merit System Board entered into Executive Session for the purpose of viewing a confidential video on A-14 Robert Zorn and to obtain legal advice on the matter of A-15 Anthony Hearn. The Board subsequently reconvened the public meeting.
A-14 ROBERT ZORN, JR.,
Robert Zorn, Jr., Youth Worker, County of Mercer, Department of Human Services, removal effective May 11, 2005, on charges of conduct unbecoming a county employee, failure to perform duty and failure to a follow rule, policy or procedure. This matter was held over from the September 26, 2007 Merit System Board meeting.
Recommendation of the Administrative Law Judge - Reverse the removal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-15 ANTHONY HEARN
Anthony Hearn, an Educational Program Development Specialist 1, with the Department of Education, appeals the determination of the Commissioner of Education which stated that he violated the State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.
Recommendation of the Administrative Law Judge - Reverse the State's determination that Mr. Hearn violated the State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace and purge that finding from his personnel records and restore him to the Manager 1 title. The ALJ also awarded back pay and counsel fees.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge to reverse the determination, restore the appellant to the Manager 1 title, but the Board denied back pay and counsel fees.
SECTION B - MISCELLANEOUS MATTERS
B-1 FLORIN DEVRIES
Florin DeVries appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9999F) on the basis psychological unfitness to perform effectively the duties of the position.
ACTION: The Merit System Board directed that this appeal be denied.
B-2 THADDEUS FONTANILLA
Thaddeus Fontanilla, represented by Thomas J. Cammarata, Esq., appeals his rejection as a Police Officer candidate by the City of Jersey City and its request to remove his name from the eligible list for Police Officer (S9999F) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Merit System Board directed that this appeal be denied.
B-3 LUIS J. VELASCO, JR.
Luis J. Velasco, Jr., represented by Jennifer N. Selliti, Esq., appeals his rejection as a Correction Officer Recruit, Juvenile Justice candidate by the Juvenile Justice Commission and its request to remove his name from the eligible list for Correction Officer Recruit, Juvenile Justice (S9999F) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION:The Merit System Board directed that this appeal be granted .

Kevin Savoy, an Assistant Engineer in Charge of Maintenance 1 with East Jersey State Prison, Department of Corrections, represented by Sarah A. Evans, Staff Representative, Communications Workers of America, Local 1040, appeals the denial of sick leave injury (SLI) benefits.
ACTION: The Merit System Board referred the matter to the Medical Examiners Panel.

James Valle, a Senior Field Representative, Wage and Hour Compliance, with the Department of Labor and Workforce Development, appeals the denial of sick leave injury (SLI) benefits.

The matter of whether the Township of Hillside should be granted permission not to make an appointment from the September 6, 2006 certification for Administrative Clerk Typing (M1027G), has been referred to the Merit System Board for review.
ACTION: The Merit System Board granted the appointment waiver but assessed selection costs in the amount of $2,048.
B-12 PROJECT COORDINATOR CRIME PREVENTION (M6308H), CITY OF NEWARK
The City of Newark requests permission not to make an appointment from the June 26, 2006 certification for Project Coordinator Crime Prevention (M6308H).
ACTION: The Merit System Board granted the appointment waiver but assessed selection costs in the amount of $2,048.

Freehold Township requests permission not to make an appointment from the December 14, 2006 certification for Purchasing Agent (M0529E).

Andrew Booker, a Senior Correction Officer with the Adult Diagnostic and Treatment Center, Department of Corrections represented by Colin M. Lynch, Esq., requests Merit System Board review of a suspension of five days. This matter was held over from the September 26, 2007 Merit System Board meeting.
ACTION: The Merit System Board granted a hearing.

Constance Garcia, a Human Services Assistant with Trenton Psychiatric Hospital, Department of Human Services, petitions the Merit System Board for back pay, benefits and seniority.
ACTION: The Merit System Board granted the request.

Gerald Napoliello, a Police Officer with the City of Newark, represented by Anthony J. Fusco, Jr., Esq., petitions the Merit System Board for interim relief on his removal, effective May 7, 2007, pending the outcome of his appeal on the merits.

Harry Barok petitions the Merit System Board for reconsideration of the decision rendered on February 28, 2007 which denied his request for a make-up for the promotional examination for Principal Community Program Specialist (PS7913K), Division of Developmental Disabilities, Department of Human Services.

Lourdes Nieves, a Senior Clerk with the Essex County Prosecutor's Office, petitions the Merit System Board for reconsideration of the final administrative decision, rendered on May 10, 2006, which upheld her removal effective May 22, 2002.

B-23 WILLIAM J. TANSEY, JR.
William J. Tansey, Jr., represented by Michael L. Prigoff, Esq., requests reconsideration of the decision rendered on June 20, 2007 by the Merit System Board which found him to be psychologically unfit for a position as a Fire Fighter (M2286E), Jersey City.
ACTION: The Merit System Board referred the matter for an independent psychological evaluation.
B-24 ANNA M. AYUSO
The appeal of Anna M. Ayuso, a Clerk Typist, bilingual in Spanish and English, with Hudson County, of her 90-day suspension (30 days held in abeyance for one year) on charges, was heard by Administrative Law Judge James A. Geraghty (SLJ), who rendered his initial decision on August 15, 2007, upholding the suspension. At its meeting on September 26, 2007, the Merit System Board adopted the ALJ's recommendation to uphold the suspension. The proposed final decision is now submitted for the Board's review.

Tassini (ALJ), who rendered his initial decision on August 17, 2007. At its meeting on September 26, 2007, the Merit System Board did not adopt the ALJ's recommendation to uphold the removal. Rather, the Board ordered that this matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Board's review.

The appeal of James Joyce a Police Officer with the City of Passaic, of his 60-working day suspension on charges, was heard by Administrative Law Judge (ALJ) Edith Klinger, who rendered her initial decision on August 23, 2007. At its meeting on September 26, 2007, the Merit System Board did not adopt the ALJ's recommendation to uphold the 60-working day suspension. Rather, the Board increased the penalty to a 120-working day suspension. The proposed final decision is now submitted for the Board's review.
