A regular meeting of the Civil Service Commission was held on Wednesday, November 1, 2017, in Trenton, New Jersey.
PRESENT: Robert M. Czech (via telephone), Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.
In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 28, 2016, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.
WITHDRAWAL OF APPEALS
The following appeals were withdrawn and removed from the hearing calendar:

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT
ACTION: The Civil Service Commission acknowledged the settlements.
A-2 DARYL LINDSEY
Daryl Lindsey, Police Officer, City of Newark, Newark Police Department, 45 working day suspension on charges of disobedience of orders and misconduct.
Recommendation of the Administrative Law Judge – Grant the appeal based on failure to prosecute.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-3 ERICA MOFFITT
Erica Moffitt, Cottage Training Technician, Woodbine Development Center, Department of Human Services, removal effective March 3, 2016 on charges of neglect of duty, conduct unbecoming a public employee and other sufficient cause.
Recommendation of the Administrative Law Judge – Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-4 MARISHA PENN
Marisha Penn, Human Service Specialist 4, Hudson County, Department of Family Services, 20 working day suspension on charges of insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.
Recommendation of the Administrative Law Judge – Modify the 20 working day suspension to a 10 working day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1 S.Q.H. – CSC DOCKET NO. 2016-1006
S.Q.H., represented by Darryl M. Saunders, Esq., appeals his rejection as a Police Officer candidate by the Newark Police Department and its request to remove his name from the eligible list for Police Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-2 M.L. – CSC DOCKET NO. 2016-3828
M.L., represented by Craig S. Gumpel, Esq. appeals his rejection as a Police Officer candidate by the Little Egg Harbor Police Department and its request to remove his name from the eligible list for Police Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be granted.

Jessica DiBiasi appeals the removal of her name from the eligible list for Correction Officer Recruit (S9988T), Department of Corrections, on the bases of an unsatisfactory criminal record and falsification of the preemployment application.
ACTION: The Civil Service Commission directed that this appeal be denied.

Matthew Fields appeals the removal of his name from the eligible list for Police Officer (S9999U), Mount Holly Township on the basis that he failed to respond to the certification notice.

Orlando Alicea, a Senior Parole Officer with the State Parole Board (NJSPB), represented by Robert A. Fagella, Esq., petitions the Civil Service Commission for reconsideration of the attached decision rendered on August 30, 2017, in which the Director of the Division of Appeals and Regulatory Affairs, denied his request for a hearing with respect to his 180 calendar day suspension.
ACTION: The Civil Service Commission directed that this petition be granted.

Desiree Jones, a Keyboarding Clerk 1 with Union County, represented by Corey Sergeant, Esq., requests that the Civil Service Commission reinstate the appeal of her eight working day suspension, which was dismissed based on her failure to appear at the scheduled hearing.
ACTION: The Civil Service Commission directed that this request be granted.

The Division of Agency Services requests that the Irvington Township be ordered to return the May 2, 2016 certification OL160577 of the eligible list for Fire Fighter (M1540T), for proper disposition.
ACTION: The Civil Service Commission ordered the appointing authority to properly dispose of the outstanding certification and pay compliance costs in the amount of $1,000.
