    A regular meeting of the Civil Service Commission was held on Wednesday, December 1, 2021, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Allison Chris Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2020, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of November 17, 2021.

 

ACTION:      The Civil Service Commission adopted the minutes of its meeting of November 17, 2021.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

Jeffrey Barrett, at al., employees of the Irvington Housing Authority, layoffs effective April 20, 2016, for reasons of economy or efficiency.

 

Recommendation of the Administrative Law Judge - Uphold the layoffs.

 

ACTION:    The recommendation of the Administrative Law Judge was deemed adopted as there was a tie vote by the Civil Service Commission.

Agenda Item A-2 was held to be considered after Agenda Item A-3 was decided. At that time, a motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Civil Service Commission entered into Executive Session for the purpose of legal advice. The Commission subsequently reconvened the public meeting

 

A-3    WAYNE GREEN – CSC DOCKET NO. 2020-2445

 

Wayne Green, Residential Services Worker, New Jersey Veterans Memorial Home – Vineland, Department of Military and Veterans Affairs, removal effective January 6, 2020, on charges of conduct unbecoming a public employee, falsification and other sufficient cause.  

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Mary Porter, Sheriff’s Officer, Middlesex County, Sheriff’s Department, removal effective October 7, 2020, on charges of inability to perform duties and other sufficient cause.  

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    MARK TAVLAN – CSC DOCKET NO. 2021-418

 

Mark Tavlan, Human Services Specialist 4, Passaic County Board of Social Services, 10 working day suspension on charges of insubordination and other sufficient cause.  

 

Recommendation of the Administrative Law Judge Uphold the 10 working day suspension.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    SEAN TONNER – CSC DOCKET NO. 2017-3792

 

Sean Tonner, Senior Investigator, Parole and Secured Facilities, East Jersey State Prison, Department of Corrections, 15 working day suspension and demotion to Correctional Police Sergeant, effective May 27, 2017, on charges of conduct unbecoming a public employee, falsification and other sufficient cause.

 

Recommendation of the Administrative Law Judge Reverse the 15 working day suspension and demotion.      

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    JACKELINE EGAN – CSC DOCKET NO. 2022-289

 

          Jackeline Egan appeals the decision of the Division of Agency Services which found that her position with Department of the Treasury is properly classified as Investment Analyst 1. The appellant seeks an Investment Analyst 2 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    SACHINA EVANS – CSC DOCKET NO. 2020-1906

 

          Sachina Evans appeals the decision of the Division of Agency Services that the proper classification of her position with Camden is Paralegal Specialist. The appellant seeks a Contract Administrator 2 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    LILY HILL – CSC DOCKET NO. 2022-291

 

          Lily Hill appeals the decision of the Division of Agency Services which found that her position with the Department of the Treasury is properly classified as Investment Analyst 1. The appellant seeks an Investment Analyst 2 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    JOHN LYLE – CSC DOCKET NO. 2022-299

 

          John Lyle appeals the decision of the Division of Agency Services which found that his position with the Department of the Treasury is properly classified as Building Services Coordinator 1. The appellant seeks a Property Management Services Specialist 2 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    CINDY YANUCIL – CSC DOCKET NO. 2022-347

 

          Cindy Yanucil appeals the decision of the Division of Agency Services that the proper classification of her position with the Department of Health is Administrative Analyst 4, Fiscal Management. The appellant seeks a Section Supervisor, Fiscal Resources job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    JILL DAWSON – CSC DOCKET NO. 2022-360

 

          Jill Dawson requests a retroactive effective date of the reclassification of her position from Administrative Analyst 1 to Administrative Analyst 2.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-7    ALBERTO FIGUEROA – CSC DOCKET NO. 2022-795

 

          Alberto Figueroa appeals the decision to remove his name from the County Correctional Police Officer (S9999A), Essex County eligible list on the basis of falsification of application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    BRYAN LEWIS – CSC DOCKET NO. 2021-1780

 

          Bryan Lewis appeals the bypass of his name on the Police Officer (S9999A), South Orange eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    VETERANS SERVICE OFFICER (C0143C), PASSAIC COUNTY – CSC DOCKET NO. 2022-802

 

          Passaic County requests permission not to make an appointment from the August 31, 2021 certification for Veterans Service Officer (C0143C), Passaic County.

 

ACTION:     The Civil Service Commission granted the appointment waiver and ordered that no selection costs presently be assessed.

 

B-10   LISA WILLIAMS – CSC DOCKET NO. 2022-643

 

          Lisa Williams, represented by Lisa Maddox-Douglas, President, Public Employees Supervisors Union, appeals her non-appointment on the Assistant Training Supervisor, County Welfare Agency (PC0084B), Essex County eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-11   SAIMA AHMAD – CSC DOCKET NO. 2022-765

 

          Saima Ahmad appeals the scoring and ranking of the Claims Adjudicator Supervisor, Disability Determinations (PS0927N), Department of Labor and Workforce Development promotional examination.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-12   HELEN AJIBADE – CC DOCKET NO. 2022-306

 

          Helen Ajibade appeals the determination of the Division of Agency Services that found that she did not meet the experience requirements for the open competitive examination for Program Specialist 2 (M0033C), Jersey City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13   LISA CLARK – CSC DOCKET NO. 2022-489

 

          Lisa Clark requests to file a late application for the promotional examination for Senior Biologist, Wildlife Management (PS5940G), Department of Environmental Protection.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-14   PATRICIA RUBERTI – CSC DOCKET NO. 2022-61

 

          Patricia Ruberti requests to be permitted to submit a late application for the Technical Assistant (PS3734K), Department of Human Service, examination.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-15   TIFFANY DIAZ – CSC DOCKET NO. 2022-591

 

          Tiffany Diaz appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Senior Library Assistant (PM3348C), Perth Amboy.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-16   LINDA GEORGE – CSC DOCKET NO. 2021-1817

 

          Linda George appeals the determination of the Division of Agency Services, which deemed her ineligible for the promotional examination for Agency Services Representative 4 (PS3746K), Department of Human Services on the basis that she was below the minimum requirements for experience.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-17   NANCY GOMES – CSC DOCKET NO. 2022-501

 

          Nancy Gomes appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Supervisor, Information Technology Help Desk (PM2491C), Linden.

 

ACTION:     The Civil Service Commission directed that this appeal be denied and the classification of Nancy Gomes’ position be referred to Agency Services for further review.

 

B-18   ANDREW HOFFMAN – CSC DOCKET NO. 2022-918

 

          Andrew Hoffman appeals the determination of the Division of Agency Services, which found that he did not meet the permanent service requirement for the promotional examination for Human Services Specialist 3 (PC4485C), Ocean County Board of Social Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-19   ANTHONY JACKSON – CSC DOCKET NO. 2021-1851

 

          Anthony Jackson appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirements for the open competitive examination for Investigator 2 (M0549B), Newark School District.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-20   BRIAN SIMMONS – CSC DOCKET NO. 2022-543

 

          Brian Simmons appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Senior Systems Analyst (PC2477C), Ocean County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-21   JASON BABBITT AND JAMES MCADOO – CSC DOCKET NOS. 2022-444 AND 2022-460

 

          Jason Babbitt (PC1543A), Morris County and James McAdoo (PC1541A), Middlesex County appeal the promotional examination for County Correctional Police Sergeant (various jurisdictions).

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-22   DANIEL DONOVAN – CSC DOCKET NO. 2022-462

 

          Daniel Donovan appeals the promotional examination for Sheriff’s Officer Sergeant (PC1563A), Ocean County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-23   RICHARD JOYCE AND JOSEPH REGATEIRO – CSC DOCKET NOS. 2022-42 AND 2022-433

 

          Richard Joyce and Joseph Regateiro appeal the promotional examination for County Correctional Police Captain (PC1523A), Essex County.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-24   BRIAN REILLY – CSC DOCKET NO. 2022-1018

 

          Brian Reilly appeals his disqualification from the examination for Fire Lieutenant (PM2361C), Clifton.
