A regular meeting of the Civil Service Commission was held on Wednesday, December 2, 2009, in Trenton, New Jersey.

PRESENT: Hope L. Cooper, Chairperson, Members Flavella Branham, John Currie and Margaret E. L. Howard; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Hope L. Cooper, Chairperson, opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 17, 2008, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

ACTION: The Civil Service Commission acknowledged the settlements.

A-2 ZOBARIA ANSARI

Zobaria Ansari, Human Services Specialist 1, Bergen County Board of Social Services, release at the end of the working test period effective February 27, 2009.

Recommendation of the Administrative Law Judge - Uphold the release at the end of the working test period.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-3 HUBERT JOHNSON

Hubert Johnson, Zoning Officer, Atlantic City, Administration Department, 30-day suspension and demotion to the position of Truck Driver effective December 10, 2007, on charges of conduct unbecoming a public employee and violation of the City's policy on solicitation.

Recommendation of the Administrative Law Judge - Uphold the 30-day suspension and demotion to the position of Truck Driver.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.


A-4 THOMAS J. NOVAK (CONSOLIDATION)

Thomas J. Novak, Senior Probation Officer, Judiciary, Morris-Sussex Vicinage, five-day suspension and 15-day suspension on charges of insubordination, conduct unbecoming a public employee and other sufficient cause, and 20-day suspension on charges of conduct unbecoming a public employee, neglect of duty and other sufficient cause.

Recommendation of the Administrative Law Judge - Dismiss the appeal.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5 KEITH RUSSELL

Keith Russell, Police Officer, Jersey City, Police Department, 10-day suspension, on the charge of violation of rules regarding knowledge of laws and regulations.

Recommendation of the Administrative Law Judge - Uphold the 10-day suspension.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-6 NICOLE WILSON

Nicole Wilson, Human Services Specialist 1, Bergen County Board of Social Services, release at the end of the working test period effective February 27, 2009.

Robert A. Andrews, Police Lieutenant, Township of Berkeley, Police Department, removal effective December 7, 2005, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause. This matter was held over from the September 16, 2009 Civil Services Commission meeting.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-8 JOHN ONUKOGU

John Onukogu, Cottage Training Technician, Hunterdon Developmental Center, Department of Human Services, 10-day suspension on the charge of insubordination and removal effective July 27, 2008, on the charge of neglect of duty.

Recommendation of the Administrative Law Judge - Dismiss the appeal as moot.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-9 DOUGLAS PETERSON

Douglas Peterson, Public Health Investigator, City of Hoboken, Department of Human Services, removal effective September 12, 2008, on charges of conduct unbecoming a public employee, misuse of public property including motor vehicles and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.


A-10 CATHY VAS

Cathy Vas, Cottage Training Technician, Hunterdon Developmental Center, Department of Human Services, removal effective June 13, 2008, on charges of physical or mental abuse of a client, inappropriate physical contact or mistreatment of a patient, client, resident or employee, conduct unbecoming a public employee, and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-11 RON SMITH

Ron Smith, Repairer, Kean University, removal effective February 25, 2008 on charges of conduct unbecoming a public employee and violation of the State of New Jersey Workplace Violence Policy. This matter was held over from the November 5, 2009 Civil Services Commission meeting.

Recommendation of the Administrative Law Judge - Modify the removal to a 30-day suspension.

ACTION: The Civil Service Commission rejected the recommendation of the Administrative Law Judge to uphold the removal.

SECTION B - MISCELLANEOUS MATTERS

B-1 SAMUEL LAOYE

Samuel Laoye appeals his rejection as a County Correction Officer candidate by Essex County and its request to remove his name from the eligible list for County Correction Officer (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION: The Civil Service Commission directed that this appeal be granted.


B-2 LINDA ACEVEDO

Linda Acevedo, a Cottage Training Technician with the North Jersey Developmental Center, Department of Human Services, represented by Mark Nulman, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION: The Civil Service Commission directed that this appeal be granted.

B-3 NICOLE BAILEY

Nicole Bailey, a Substance Abuse Assistant with the Juvenile Justice Commission, Department of Law and Public Safety, appeals the denial of sick leave injury (SLI) benefits.

B-37 JAMAL MUHAMMAD

Jamal Muhammad, represented by Maury R. Winkler, Esq., appeals the decision of the Division of Local Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for Fire Fighter (M2289E), Newark for being outside the residency scope.

ACTION: The Civil Service Commission directed that this appeal be denied.


B-38 PAUL PHILIPPS

Paul Philipps, represented by Gary D. Tomasella, Esq., appeals his non-appointment from the Deputy Police Chief (PM3589G), Parsippany-Troy Hills, eligible list.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-39 HAYDEE ZAMORA-DALTON

Haydee Zamora-Dalton appeals the decision of the Division of State and Local Operations, which removed the appellant's name from the Supervising Family Service Specialist 1 (PS6046K), Department of Children and Families, employment list due to the appellant's failure to respond to the Certification Notice.

ACTION: The Civil Service Commission directed that this appeal be granted.

B-40 ACCOUNT CLERK (C0377K), BERGEN COUNTY SHERIFF'S OFFICE

The Bergen County Sheriff's Office requests permission not to make an appointment from the February 9, 2009 certification for Account Clerk (C0377K).

ACTION: The Civil Service Commission granted an appointment waiver but assessed selection costs in the amount of $2,048.

B-41 ASSISTANT ADMINISTRATIVE SUPERVISOR, SOCIAL WORK (PC0800H), UNION COUNTY

Union County requests that the eligible list for Assistant Administrative Supervisor, Social Work (PC0800H) be extended for one year beyond its expiration date.

ACTION: The Civil Service Commission granted the request.


B-42 HOUSING COORDINATOR (M0181K), NEWARK

The appointing authority's failure to dispose of the certification for Housing Coordinator (M0181K), Newark, while a provisional is serving in the title, has been referred to the Civil Service Commission for enforcement.

ACTION: The Civil Service Commission ordered the appointing authority to dispose of the outstanding certification and pay compliance costs.

B-43 JOHN LEONARD

John Leonard, an Electrician with The College of New Jersey (the College), appeals the determination of the College President, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-44 DEBORA LEONARDI

Debora Leonardi, a Technical Assistant 3 with the Division of Criminal Justice, Department of Law and Public Safety (DLPS), appeals the determination of the Chief of Staff, DLPS, which found that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION: The Civil Service Commission directed that this appeal be denied.


B-45 ALEXANDRA LEPORE

Alexandra Lepore, a Secretarial Assistant 3 with the Department of Labor and Workforce Development (DL&WD), appeals the determination of the Commissioner of the DL&WD that the appellant failed to present sufficient evidence to support findings of violations in the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-46 TROY ALLEN

Troy Allen, represented by Charles J. Sciarra, Esq., and the City of Paterson, represented by Charles C. Festa, III, Assistant Corporation Counsel, seek acknowledgement of a settlement agreement.

ACTION: The Civil Service Commission acknowledged the settlement.

B-47 MICHELLE ALUOTTO, ET AL.

The Department of Human Services (DHS) requests relief on behalf of Michelle Aluotto, Judith Fornier, Dana Martucci, and Michele Shufeldt, Family Service Specialist Trainees with the DHS.

ACTION: The Civil Service Commission granted the request.

B-48 KATHY BOARDLEY

Kathy Boardley appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Technical Program Assistant. The appellant seeks an Administrative Analyst 3 classification.

ACTION: The Civil Service Commission directed that this appeal be denied.


B-49 BOROUGH OF ROSELLE APPOINTING AUTHORITY

The Division of State and Local Operations requests that the Civil Service Commission resolve a dispute regarding the appointing authority for the Borough of Roselle. It is noted that this matter was held over from the Commission's October 7, 2009 meeting.

ACTION: The Civil Service Commission recognized the Borough Council as the appointing authority.

B-50 TIMOTHY CASSIDY

Timothy Cassidy, a Security Officer with Kean University, represented by Stephen E. Klausner, Esq., seeks enforcement of the Civil Service Commission decision rendered on July 22, 2009, awarding counsel fees.

ACTION: The Civil Service Commission directed that this appeal be granted in part and awarded $19,860 in counsel fees.

B-51 DALE CHIACCHIO

Dale Chiacchio, a Technical Assistant, Personnel, with the Department of Transportation, requests review of his reassignment.

ACTION: The Civil Service Commission directed that this appeal be denied, but directed that the classification of the appellant's position be referred to the Division of Sate and Local Operations.

B-52 BELKIS ENCARNACION

Belkis Encarnacion, a Housing Assistant Technician with Long Branch Housing Authority, represented by Clairmont Mali Chung, Esq., petitions the Civil Service Commission for a stay of her removal on charges, effective September 30, 2009, pending the outcome of her hearing at the Office of Administrative Law.

ACTION: The Civil Service Commission denied the request.
B-53 SEAN NALLY

Sean Nally, a former Police Officer with Jersey City, appeals his resignation in good standing.

ACTION: The Civil Service Commission directed that this appeal be denied.

B-54 KENNETH PORTER

Kenneth Porter requests a retroactive regular date of appointment to Human Services Specialist 2, effective January 27, 2003.

ACTION: The Civil Service Commission granted the request.

B-55 CARMELA THOMPSON

The Superior Court, Appellate Division, has remanded the matter of Carmela Thompson's entitlement to back pay and benefits for the period of her indefinite suspension to the Civil Service Commission for a final decision.

ACTION: The Civil Service Commission dismissed the appeal for lack of jurisdiction.

B-56 RENEE BANCROFT

Renee Bancroft requests reconsideration of the decision rendered on June 24, 2009, which upheld the determination of the Division of State Human Resource Management that the proper classification of her position is Principal Geologist, Environmental Protection.

ACTION: The Civil Service Commission denied the request for reconsideration.


B-57 DAVID MCCLENDON

David McClendon, a former Police Officer with Newark, represented by Anthony J. Fusco, Jr., Esq., petitions the Civil Service Commission for reconsideration of the final administrative decision rendered on January 23, 2009, in which the Director of the Division of Merit System Practices and Labor Relations denied his request for a hearing with respect to his removal from employment.

ACTION: The Civil Service Commission denied the request.

B-58 ERIC MIKKELSON

The appeal of Eric Mikkelson, a Laborer with the Township of Lakewood, of his removal, effective January 23, 2009, on charges was heard by Administrative Law Judge Susan M. Scarola (ALJ), who rendered her initial decision on October 8, 2009. At its meeting on November 18, 2009, the Civil Service Commission (Commission) adopted the recommendation of the ALJ to reverse the appellant's removal. The proposed decision is now submitted for the Commission's review.

ACTION: The Civil Service Commission adopted the decision.

B-59 AIVERY WALDEN

The appeal of Aivery Walden, a Fire Fighter with Paterson, of his removal effective January 26, 2009, on charges, was heard by Administrative Law Judge Edith Klinger (ALJ), who rendered her initial decision on September 9, 2009. At its meeting on November 18, 2009, the Civil Service Commission (Commission) adopted the ALJ's recommendation to uphold the removal. The proposed final decision is now submitted for the Commission's review.

ACTION: The Civil Service Commission adopted the final decision.


B-60 CHRISTINA ALBIZATI, ET AL.

Christina Albizati, Kimberly Kerkuska, Jo Legg, Stacey MacEwan, Christopher Squazzo, and Kristen Symanski appeal the determinations of the Division of Selection Services which found that they were below the minimum requirements in experience for the promotional examination for Principal Environmental Specialist (Costal Resources) (PS1401G), Department of Environmental Protection.

ACTION: The Civil Service Commission directed that these appeals be denied.

B-61 SANDRA BLECKMAN

Sandra Bleckman appeals the determination of the Division of Selection Services, which found that she did not meet the experience requirements for the promotional examination for Assistant Personnel Officer (PC1069J), Bergen County.

The Township of Hillside requests relaxation of N.J.A.C. 4A:4-7.1A(c) so as to permit the intergovernmental transfer of Joseph Vetter from the title of Sheriff's Officer Warren County Sheriff's Office to the title of Police Officer, Hillside.

B-77 PROPOSED NEW RULE: N.J.A.C. 4A:3-3.7B CORRECTION OFFICER APPRENTICE: STATE SERVICE

Submitted for the Civil Service Commission's review is a Notice of Proposal to promulgate a new rule, N.J.A.C. 4A:3-3.7B, Correction Officer Apprentice: State service; and an amendment to N.J.A.C. 4A:4-5.2, Duration (of working test period). The proposed new rule and amendment would codify a new Correction Officer Apprentice program as required by the Superior Court, Appellate Division, in Liik, et al. v. New Jersey Department of Personnel, et al., (decided 7/23/09). It is recommended that this proposal be approved for publication in the New Jersey Register for public notice and comment.

ACTION: The Civil Service Commission approved the proposal for publication in the New Jersey Register.

B-78 PROPOSED AMENDMENT TO N.J.A.C. 4A:6-1.7, SICK LEAVE INJURY (SLI) REPORTING AND APPEAL PROCEDURES: STATE SERVICE

Submitted for the Civil Service Commission's review is a Notice of Proposal to amend N.J.A.C. 4A:6-1.7, Sick Leave Injury (SLI) reporting and appeal procedures: State Service. The amendment would add language inadvertently omitted from recently adopted amendments regarding the 20-day time period required for an appointing authority to issue an SLI determination following receipt of an employee's claim. It is recommended that this proposal be approved for publication in the New Jersey Register for public notice and comment.

ACTION: The Civil Service Commission approved the proposal for publication in the New Jersey Register.


B-79 PROPOSED AMENDMENTS TO N.J.A.C. 4A:6-1.22, DONATED LEAVE PROGRAM

Submitted for the Civil Service Commission's review is a Notice of Proposal to amend N.J.A.C. 4A:6-1.22, Donated leave program. In response to a rule petition received from Department of Corrections Commissioner George W. Hayman, the amendments would allow a leave donor in the donated leave program to provide up to 30 sick or vacation days rather than the current limit of 10, and also permit a leave recipient to receive no more than 260 sick or vacation days rather than the current limit of 180. It is recommended that this proposal be approved for publication in the New Jersey Register for public notice and comment.

ACTION: The Civil Service Commission approved the proposal for publication in the New Jersey Register.

B-80 SALARY REGULATIONS, FY 2010

Submitted for the Civil Service Commission's review are the Salary Regulations, Fiscal Year 2010. These salary regulations, which include Section 1 - Aligned Salary Regulation and Non-Aligned Salary Regulation (with Attachments A and B); Section 2 - Emergency Conditions Salary Regulation; Section 3 - Special Incentive Salary Regulation; and Section 4 - Miscellaneous Salary Regulation, have been approved by Hope L. Cooper, Chair/CEO, Civil Service Commission, and Charlene M. Holzbaur, Director, Division of Budget and Accounting. It is recommended that the Commission record this salary regulation package.

ACTION: The Civil Service Commission recorded the salary regulations.

There being no further business before the Civil Service Commission, the meeting was adjourned to convene on Wednesday, December 16, 2009, at 10:00 a.m., at 3 Station Plaza, Trenton, New Jersey.
