A regular meeting of the Civil Service Commission was held on Wednesday, December 3, 2008, in Trenton, New Jersey.
PRESENT: Chairperson Hope L. Cooper, Commission Members Flavella Branham, John Currie and Margaret E. L. Howard; Pamela Ullman, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Chairperson Hope L. Cooper, opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 21, 2007, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey. All actions were by unanimous vote unless otherwise specified.
STATE
The Civil Service Commission recorded the recommended changes in the State Classification Plan, copies of which are attached hereto and made a part hereof. It is noted that the Civil Service Commission held over the classification plan of the Department of Human Services title series for the identification and modification of behavior, which appeared on page 4 and 5 of Part 2 of the Agenda.

ACTION: The Civil Service Commission directed that this matter be held over.

Charles Hawkins, III, Police Officer, Township of Woodbridge, Police Department, two removals effective February 28, 2005, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty, and other sufficient cause.

Andrew Pettit, Cottage Training Technician, Woodbine Developmental Center, Department of Human Services, removal effective October 26, 2007, on charges of physical or mental abuse of a patient, client, resident, or employee and verbal abuse of a patient, client, resident or employee.
Recommendation of the Administrative Law Judge - Modify the removal to a 90-day suspension.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to a six-month suspension.
A-9 CHRISTOPHER M. PORTALE (REMAND)
Christopher M. Portale, Truck Driver, Single Axle, Department of Transportation, removal effective August 17, 2007, on the charge of violation of Federal regulations concerning drug and alcohol use by, and testing of, employees who perform functions related to the operation of commercial motor vehicles, and state and local policies issued thereunder.
Recommendation of the Administrative Law Judge - Uphold the removal.

Lee G. Riggins, Heavy Laborer, City of Trenton, Department of Public Works, removal effective October 3, 2007, on charges of failure to pass a drug and alcohol impaired screening and job abandonment.

ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-17 DANIELLE M. GAINES
Danielle M. Gaines, County Correction Officer, Burlington County, County Jail, 130-working day suspension on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee and other sufficient cause.
Recommendation of the Administrative Law Judge - Uphold the 130-working day suspension.
ACTION: The Civil Service Commission rejected the Administrative Law Judge's initial decision and acknowledged the withdrawal of the appeal.
A-18 LINDA PERKINS
Linda Perkins, Program Monitor, City of Elizabeth, Department of Planning and Community Development, return to formerly held permanent title of Senior Planning Aide at the end of the working test period effective August 10, 2007.
Recommendation of the Administrative Law Judge - Uphold the return to the formerly held permanent title.

Matthew Vander Velden, Police Sergeant, City of Paterson, Police Department, 60-day suspension on charges of conduct unbecoming a public employee, neglect of duty and other sufficient cause.
Recommendation of the Administrative Law Judge - Uphold the 60-day suspension.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to a six-month suspension.
A-20 COLOSSAIN DAVIS
Colossain Davis, Police Aide, City of Newark, Police Department, removal effective November 13, 2006, on charges of incompetency or inefficiency and chronic or excessive absenteeism and violation of Police Department rules and regulations and removal effective November 13, 2006, on charges of disobedience of orders and violation of Police Department rules and regulations.
Recommendation of the Administrative Law Judge - Uphold the charge of chronic and excessive absenteeism, modify the removal to a 30-day suspension. Dismiss the remainder of the charges and reverse the second removal.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to a 60-working day suspension.
A-21 DEZONNE DENSON
Dezonne Denson, Human Services Assistant, Ancora Psychiatric Hospital, Department of Human Services, removal effective December 21, 2007, on charges of physical abuse of a patient, inappropriate physical contact or mistreatment of a patient, violation of rule, regulation, policy, procedure or administrative decision and conduct unbecoming a public employee.
Recommendation of the Administrative Law Judge - Modify the removal to a 30-day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-22 FREDERICK LEE
Frederick Lee, Human Services Assistant, Ancora Psychiatric Hospital, Department of Human Services, removal effective June 26, 2007, on charges of falsification, negligence in performing duty resulting in injury to persons or damage to property and violation of a policy.
Recommendation of the Administrative Law Judge - Modify the removal to a six-month suspension.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to uphold the removal.
A-23 JAY GLASS
Jay Glass, Correction Lieutenant, New Jersey State Prison, Department of Corrections, removal effective March 26, 2007 on charges of conduct unbecoming a public employee, use, possession or sale of any controlled dangerous substance and violation of rule, regulation or policy, procedure, order, or administrative decision.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-24 TERRENCE JOHNSON
Terrence Johnson, Senior Correction Officer, Central Reception and Assignment Facility, Department of Corrections, removal effective March 3, 2008, on charges of falsification, loss or careless control of keys, pager/beeper or cellular telephones, violation of administrative procedures and/or regulations involving safety and security and other sufficient cause.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-25 DOREEN PATTERSON
Doreen Patterson, Institutional Trade Instructor 2, Cooking, Garden State Correctional Facility, Department of Corrections, removal effective April 16, 2007, on charges of conduct unbecoming a public employee, violation of rules regarding safety and security, improper or unauthorized contact with an inmate and undue familiarity with inmates, parolees their families or friends.

Jay W. Rivers, III, appeals his rejection as a Sheriff's Officer candidate by Camden County and its request to remove his name from the eligible list for Sheriff's Officer (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be granted.

Joseph Wannamaker appeals the removal of his name from the (S9999H) eligible list for the title of County Correction Officer, County of Hudson on the basis of psychological unfitness.

Cooper, Jr., appeals the decision of the Division of State Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for Parole Officer Recruit (S2049H), New Jersey State Parole Board, on the basis of an unsatisfactory background report.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-11 MARVIN J. MINNEY, JR.
Marvin J. Minney, Jr. appeals the decision of the Division of State Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Assistant Family Service Worker 2 (S0529H), Department of Children and Families eligible list, on the basis of an unsatisfactory criminal background.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-12 PATRICIA WARREN, ET AL.
Patricia Warren, Gabriel Spiler, Deborah Johnson-Kinnard and Karen Dolan appeal the Department of Children and Families' request to remove their names from the eligible list for Quality Assurance Coordinator (PS3327K), Department of Human Services on the basis they were not serving in the proper unit scope.
ACTION: The Civil Service Commission directed that these appeals be denied.
B-13 ADMINISTRATIVE CLERK (M1181H), JERSEY CITY
Jersey City requests permission not to make an appointment from the January 29, 2007 certification for Administrative Clerk (M1181H).
ACTION: The Civil Service Commission granted an appointment waiver and assessed no selection costs at this time.
B-14 COMPUTER SERVICE TECHNICIAN (M1563J), JERSEY CITY FREE PUBLIC LIBRARY
The Jersey City Free Public Library requests permission not to make an appointment from the April 9, 2007 certification for Computer Service Technician (M1563J).
ACTION: The Civil Service Commission granted an appointment waiver and waived selection costs.
B-15 FIRE PROTECTION SUBCODE OFFICIAL (C9850G) AND (C9993J), OCEAN COUNTY
Ocean County requests permission not to make an appointment from the July 13, 2007 certification for Fire Protection Subcode Official (C9850G) and (C9993J).
ACTION: The Civil Service Commission granted an appointment wavier but assessed selection costs in the amount of $2,048.
B-16 PRINCIPAL ENGINEER, STRUCTURAL EVALUATION (PS1795T)
The Division of State Human Resource Management, on behalf of the Department of Transportation (DOT), requests that it be permitted to selectively certify eligibles on the promotional list for Principal Engineer, Structural Evaluation (PS1795T) who possess specialized credentials needed to serve as a Team Leader in accordance with 23 C.F.R 650.309(b).
ACTION: The Civil Service Commission granted the request.
B-17 SOCIAL SERVICE TECHNICIAN, BILINGUAL IN SPANISH AND ENGLISH (M1452H), KEARNY
The matter of whether Kearny should be granted permission not to make an appointment from the October 22, 2007 certification for Social Service Technician, Bilingual in Spanish and English (M1452H), has been referred to the Civil Service Commission for review.
ACTION: The Civil Service Commission granted an appointment waiver and assessed selection costs in the amount of $2,048.
B-18 EUNICE CAREY
Eunice Carey, a former Clerk Typist with the Department of Human Services, appeals the determination of the Chief of Staff of the DHS, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-19 FARUQUE CHOWDHURY
Faruque Chowdhury, the Director of the Office of Human Resources with Kean University, appeals the determination of the President of Kean University, stating that there was probable cause to substantiate a finding that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission granted a hearing.
B-20 JAVIER ROBLES
Javier Robles, a Deputy Executive Director with the Division of Disability Services, Department of Human Services, appeals the decision of the Chief of Staff which found that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace (State Policy).
ACTION: The Civil Service Commission directed that this appeal be denied.
B-21 KAREN CHRUCKY
Leonid Chrucky, on behalf of his wife, Karen Chrucky, a Nursing Administrator Psychiatric Services, with the Department of Human Services, appeals his wife's receipt of a 3% salary increase pursuant to the Fiscal Year 2008 Management Salary Program.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-22 RICHARD IORIO
Richard Iorio, an Assistant Director, Temporary Disability Insurance, with the Department of Labor and Workforce Development, appeals his receipt of a 4% salary increase pursuant to the Fiscal Year 2008 Management Salary Program.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-23 DEBORAH MOORE
Deborah Moore, a Systems Analyst with Newark, represented by Estelle Flynn Lord, Esq., requests counsel fees in accordance with the decision rendered on July 16, 2008.
ACTION: The Civil Service Commission granted counsel fees in the amount of $3,340.
B-24 LOIS JOHANN
Lois Johann, a Landscape Designer with the Department of Transportation, appeals the decision of the Department of Transportation, which denied her request to participate in the School Volunteer Leave Program.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-25 TARNECA BRADLEY
Tarneca Bradley appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Technical Assistant 3. The appellant seeks a Technical Assistant 2, Treasury classification.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-26 ARTHUR HUGHES
Arthur Hughes appeals the decision of the Division of State Human Resource Management that the proper classification of his position is Senior Environmental Specialist, Site Remediation. The appellant seeks a Principal Environmental Specialist, Site Remediation classification.
ACTION: The Civil Service Commission directed that this appeal be denied.

Cathleen Lombardo appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Principal Audit Account Clerk. The appellant seeks a Fiscal Analyst classification.

B-28 TERESA J. MELDE
Teresa J. Melde appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Clerk Typist 1, Evidence Handling. The appellant seeks a Clerk Typist 2, Evidence Handling classification.
ACTION: The Civil Service Commission directed that this appeal be denied but referred the matter of the appellant's classification since August 31, 2008 to the Division of State Human Resource Management for further review.
B-29 TITUS OSUAGWU
Titus Osuagwu appeals the decision of the Division of State Human Resource Management that the proper classification of his position is Senior Clerk Typist. The appellant seeks a Principal Clerk Typist classification.
ACTION: The Civil Service Commission directed that this appeal be denied. B-30 ENAYATOLLA POUSTCHI
Enayatolla Poustchi appeals the decision of the Division of State Human Resource Management that the proper classification of his position is Research Scientist 2. The appellant seeks a Research Scientist 1 classification.

B-31 CARVIN BETHEA
Carvin Bethea, a Human Services Assistant with Trenton Psychiatric Hospital, Department of Human Services, petitions the Civil Service Commission for reconsideration of the final administrative decision, rendered on October 30, 2006, in which the Director of the Division of Merit System Practices and Labor Relations, Department of Personnel denied his request for a hearing with respect to his removal.
ACTION: The Civil Service Commission denied the request for reconsideration.
B-32 DEBORAH HAYES
Deborah Hayes petitions the Civil Service Commission for reconsideration of the decision rendered on August 27, 2008, in which her request for admittance to the examination for Classification Officer 1 (PS6747I), Mountainview Correctional Institution, was denied.
ACTION: The Civil Service Commission denied the request for reconsideration.
B-33 CARLOS ALEJO
The appeal of Carlos Alejo, a County Correction Officer with Passaic County, of his removal on charges, effective April 19, 2007, was before Administrative Law Judge Mumtaz Bari-Brown (ALJ), who rendered her initial decision on May 12, 2008. At its meeting on November 6, 2008, the Civil Service Commission did not adopt the ALJ's recommendation to dismiss the appeal as moot. Rather the Commission remanded the matter to the Office of Administrative Law for further proceedings. The proposed decision is now submitted for the Commission's review.
