    A regular meeting of the Civil Service Commission was held on Wednesday, December 19, 2018 at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Nicholas F. Angiulo, Deputy Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 17, 2017, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

 

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    CASSY POLLANDER

 

Cassy Pollander, Police Officer, City of Gloucester, Police Department, release at the end of the working test period, effective August 24, 2017.

 

Recommendation of the Administrative Law Judge – Uphold the release at the end of the working test period.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    SERENA SWAGGERTY

 

Serena Swaggerty, Clerk 1, Atlantic County, Department of Community Development and Economic Assistance, resignation not in good standing, effective February 21, 2017.

 

Recommendation of the Administrative Law Judge – Modify the resignation not in good standing to a resignation in good standing.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

A-4    SEAN TONNER

 

Sean Tonner, Senior Investigator, Parole and Secured Facility, East Jersey State Prison, Department of Corrections, 60 working day suspension and demotion to Correction Sergeant on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the 60 working day suspension and demotion.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    RAMONE WILSON

 

Ramone Wilson, Police Officer, City of Newark, Department of Public Safety, removal effective March 14, 2016 on charges of conduct unbecoming a public employee and falsification.

 

Recommendation of the Administrative Law Judge – Reverse the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    ANDREW BARNES – CSC DOCKET NO. 2018-3554

 

          Andrew Barnes appeals his removal from the eligible list for Police Officer (S9999U), Newark on the basis of an unsatisfactory background.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    MARC CALDWELL – CSC DOCKET NO. 2018-3044

 

          Marc Caldwell appeals his removal from the eligible list for Police Officer (S9999U), Long Branch on the basis of falsification of his pre-employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    SHAWN CARTER – CSC DOCKET NO. 2018-3315

 

          Shawn Carter, represented by Arthur J. Murray, Esq., appeals the removal of his name from the eligible list for Medical Security Officer (S0239T), Department of Health on the basis of unsatisfactory employment record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    STACIE SALA – CSC DOCKET NO. 2019-297

 

          Stacie Sala appeals her removal from the eligible list for Correction Officer Recruit, Juvenile Justice Commission (S9999U), Juvenile Justice Commission on the basis that she possessed an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    TRAVIS BRUMFIELD – CSC DOCKET NO. 2019-959

 

          Travis Brumfield appeals his removal from the eligible list for Correctional Police Officer (S9988T), Department of Corrections on the basis that he possessed an unsatisfactory criminal record, had an unsatisfactory background and falsified his application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    JILLIAN GORMLEY – CSC DOCKET NO. 2018-2493

 

          Jillian Gormley appeals the decision of the Division of Agency Services that the proper classification of her position with Stockton University is Technical Assistant, Higher Education. The appellant seeks a Professional Services Specialist 4, Administrative Services job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied, and the position be reclassified to Technical Assistant 1, or the appellant be assigned duties consistent with her permanent title of Principal Clerk Typist.

 

B-7    SHAMEKA KIDD – CSC DOCKET NO. 2019-1377

 

          Shameka Kidd appeals the determination of the Division of Agency Services that the proper classification of her position with the Department of the Treasury is Technical Assistant. The appellant seeks a Technical Assistant 1, Treasury job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-8    MICHAEL AJAYI – CSC DOCKET NO. 2018-3197

 

          Michael Ajayi appeals the bypass of his name on the eligible list for Quality Assurance Specialist, Health Services (PS1431K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    KELLY CHESLER – CSC DOCKET NO. 2018-2632

 

          Kelly Chesler, represented by Matthew T. Clark, Esq., appeals the bypass of her name on the eligible list for Police Captain (PM0863S), Jersey City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-10  CRAIG G. HOWLETT AND LORI A. SOARES – CSC DOCKET NOS. 2019-687 AND 2019-688

 

          Craig G. Howlett and Lori A. Soares, represented by Maurice W. McLaughlin, Esq., appeal their respective bypasses from the eligible lists for Police Sergeant (PM0721P), Borough of Roselle (Roselle) and Police Lieutenant (PM1255T), Roselle.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-11  MANAGEMENT SPECIALIST (SPECIAL AND C0256T), BERGEN COUNTY – CSC DOCKET NO. 2018-3273

 

          Bergen County requests permission not to make an appointment from the February 4, 2017 certification for Management Specialist (Special and C0256T).

 

ACTION:     The Civil Service Commission directed that this request be granted and the appointing authority be assessed for the costs of the selection process in the amount of $2,048.

 

B-12  PHILIP PARICHUK – CSC DOCKET NO. 2019-549

 

          Philip Parichuk appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirement for the promotional examination for Maintenance Supervisor (PC1642W), Warren County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13  DANIEL R. SCHETTINO, POLICE SERGEANT (PM0807P), TOWNSHIP OF NUTLEY – CSC DOCKET NO. 2019-1110

 

          The Township of Nutley requests a retroactive permanent appointment date for Daniel R. Schettino to the title of Police Sergeant, effective July 10, 2017.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-14  NICHOLAS ZIENIUK – CSC DOCKET NO. 2018-3717

 

          Nicholas Zieniuk requests that he be permitted to amend his residency on his application after the closing date for the Entry Level Law Enforcement Examination (S9999U).

 

ACTION:     The Civil Service Commission directed that this request be denied.

          Juan Colon appeals his removal from the eligible list for Sheriff’s Officer (S9999U), Camden County on the basis he falsified his application.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-17  KIMBERLY LESHYNSKI – CSC DOCKET NOS. 2019-278 AND 2019-284

 

          Kimberly Leshynski appeals her removals from the eligible lists for Sheriff’s Officer (S9999U), Monmouth County, on the basis of failure to respond to the certification notice and Correction Officer Recruit, Juvenile Justice Commission (S9999U), Juvenile Justice Commission on the basis of falsification.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

 

B-18  MATTHEW WATSON – CSC DOCKET NO. 2019-66

 

          Matthew Watson, represented by Randy P. Davenport, Esq., appeals his removal from the eligible list for Fire Fighter (M1544T), Jersey City on the basis that he falsified his application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-19  NEIL O’SULLIVAN – CSC DOCKET NO. 2019-61

 

          Neil O’Sullivan, represented by Robert J. Pompliano, Esq., appeals his removal from the eligible list for Fire Fighter (M1544T), Jersey City on the basis that he lacks the required background.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-20  SEAN VERDI – CSC DOCKET NO. 2019-1485

 

          Sean Verdi appeals the correct responses for the examination for Fire Officer 3 (PM2647V), Jersey City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-21  CHIZOBA ONUBOGU – CSC DOCKET NO. 2019-1380

 

          Chizoba Onubogu, a Family Services Specialist 1, requests to be permitted to submit an application for the promotional examination for Supervising Family Service Specialist 2 (PS4837K), Department of Children and Families, after the filing deadline.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-22  GEORGE TORRES – CSC DOCKET NO. 2019-1088

 

          George Torres, represented by Bette Grayson, Esq., appeals the denial by the Division of Agency Services of his request to file a late application for the promotional examination for Police Lieutenant (PM2013W), Newark.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-23  BERNACINE BARNES – CSC DOCKET NO. 2019-205

 

                    Bernacine Barnes, a former Senior Receptionist with Monmouth County, requests enforcement of In the Matter of Bernacine Barnes (CSC, decided May 2, 2018), which granted her back pay, benefits and seniority pursuant to N.J.A.C. 4A:2-2.10.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-24  JAMES WARD – CSC DOCKET NOS. 2019-388 AND 2019-591

 

          James Ward appeals his removals from the eligible lists for Correctional Police Officer, Juvenile Justice Commission (S9999U), Juvenile Justice Commission, on the basis of falsification and Fire Fighter (M1585T), Woodbridge Fire District 2 on the basis of an unsatisfactory employment record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-25  BERGEN COUNTY, ACCOUNTANT AND SENIOR ACCOUNT CLERK – CSC DOCKET NOS. 2019-706 AND 2019-707

 

          Bergen County’s failure to dispose of the certifications for Accountant (C0001T/C0651U) and Senior Account Clerk (C0248V) while provisionals are serving in the titles has been referred to the Civil Service Commission for enforcement.

 

ACTION:    The Civil Service Commission ordered the appointing authority to remove the provisional appointees, make appointments from the certifications and pay compliance costs. Also, it ordered the Division of Agency Services to perform a classification review of the position encumbered by Salwomir Pobjarzyn.

 

B-26  JERSEY CITY, NINE VARIOUS LISTS – CSC DOCKET NOS. 2019-850, ET AL.

 

          The City of Jersey City’s failure to dispose of the certifications for Analyst Grant Applications/Program Monitor (M0373V); Clerk 2 (M0124V); Technical Assistant to the Construction Official (M0373V); Coordinator of Monitoring and Evaluation (M0604V); Supervising Data Control Clerk (M0773V); Plumber (M0814U); Research Assistant Criminal Information (M0190U); Secretarial Assistant (M0444S); and Program Specialist 3 (M0367V), while provisionals are serving in the titles, has been referred to the Civil Service Commission for enforcement.

 

ACTION:     The Civil Service Commission ordered the appointing authority to remove the provisional appointees, make appointments from the certifications and pay compliance costs.

 

B-27  ROSA AQUINO AND PHULMANIE SHIEVKUMAR – CSC DOCKET NOS. 2019-1470 AND 2019-1457

 

          Rosa Aquino and Phulmanie Shievkumar appeal the determination of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Administrative Analyst (PM0559W), Jersey City Public Schools.

 

ACTION:     The Civil Service Commission directed that these appeals be denied and the classification of the appellants’ provisional positions be referred to the Division of Agency Services for review.

 

B-28  CIVIL SERVICE COMMISSION MEETING DATES FOR 2019

 

          The proposed revised 2019 Civil Service Commission meeting dates are submitted for approval.

 

ACTION:     The Civil Service Commission adopted the revised Civil Service Commission meeting dates for 2019.

 

B-29  MICHAEL WOODS – CSC DOCKET NO. 2019-624

 

          Michael Woods, represented by Michael L. Prigoff, Esq., requests reconsideration of the final decision rendered on August 1, 2018, which upheld the removal of the petitioner’s name from the eligible list for Fire Fighter (M1544T), Jersey City on the basis that he falsified his preemployment application.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

PUBLIC PORTION

 

 No comment.
