A regular meeting of the Merit System Board was held on Tuesday, November 10, 1998 in Trenton, New Jersey. PRESENT: Merit System Board Members, Julius J. Mastro, Presiding; Judith L. Shaw, and Edward W. Verner, M.D., Elizabeth Laufer, Deputy Attorney General; Henry Maurer, Director, Elizabeth A. Napolitano, Sybil Janowitch, and Charles Spano, Division of Merit System Practices and Labor Relations. In accordance with L.1975, c.231, Julius J. Mastro, presiding Board Member, Merit System Board, opened the meeting with the following statement:
Notice of this Meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 1, 1997 and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All other actions were by unanimous vote unless otherwise specified. State The Merit System Board approved the recommended changes in the State Classification Plan, copies of which are attached hereto and made a part hereof. DATE: November 10, 1998

SUBJECT: Change in State Classification Plan
DEPARTMENT OF HUMAN SERVICES
The Department of Human Services has requested that one (1) title be allocated to the unclassified service for use by the New Jersey Developmental Disabilities Council and the State Office of Disabilities Services in order to employ the developmentally disabled.
The New Jersey Developmental Disabilities Council is responsible, through change and advocacy, for promoting the development of a comprehensive system of services, designed to assist the disabled and their families to achieve independence and integration in the community. While allocated to the Department of Human Services, N.J.S.A. 30:1AA-1 provides that the Developmental Disabilities Council be independent of any control or supervision by the Department of Human Services. Because of its autonomy, the Council is considered a separate layoff unit, and individuals employed by the Council are not impacted by any departmental reduction-in-force. The Council must maintain compliance with the Developmental Disabilities Assistance and Bill of Rights Act, federal legislation which limits the length of time for certain projects and encourages employment of the disabled or their family members.
The Office of Disabilities Services, created in October 1997 and strongly supported by Governor Whitman, was established to provide cross-disabilities information and referral services to all New Jersey residents. It is requested that the State Office of Disabilities Services also be permitted to use the same unclassified title, pursuant to its mission of providing employment opportunities to the disabled.
Since neither agency currently has the ability to select disabled individuals for particular projects or to encourage employment of people with disabilities, the creation of this unclassified title would enable maximum diversity in employing persons with disabilities, eliminate any impact from a departmental reduction- in-force, and allow the Department of Human Services to maintain compliance with the Developmental Assistance and Bill of Rights Act.
Appointment to this title will require notification of the appointee's specific disability and the approval of the Division of Human Resource Management.
With your approval, the following title may be relegated to the unclassified service in accordance with N.J.S.A. 11A:3-4(l).

Faruq Muhammad Abdul-Aziz, Police Officer, Newark Police Department, suspension for 10 days, beginning March 3, 1996 and ending March 16, 1996, on charges of violating the Newark Police Department's Rules and Regulations -obedience to orders.
Recommendation of the Administrative Law Judge - Uphold the suspension.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-3 ROSALIND CANDELARIA
Rosalind Candelaria, Clerk Typist, City of Hoboken, removal during working test period, effective July 28, 1995.
Recommendation of the Administrative Law Judge - Reverse the removal during the working test period; grant a new working test period; and award back pay, benefits, and seniority only from 7/25/98 to the end of the working test period.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

John DeBenedictis, Correction Sergeant, Northern State Prison, Department of Corrections, suspension for 10 days, on charges of racial and/or sexual harassment, discrimination and/or retaliation.
Recommendation of the Administrative Law Judge - Reverse the suspension.
ACTION: The Merit System Board remanded this matter to the Office of Administrative Law.

Hollis Bruce, Jr., Senior Correction Officer, Bayside State Prison, Department of Corrections, removal effective November 6, 1996, on charges of discrimination that affects equal employment opportunity including sexual harassment, racial and/or sexual harassment.

Allen R. Wade, Practical Nurse, Bergen Pines County Hospital, County of Bergen, removal effective February 16, 1996, on charges of ineffectiveness, ineptitude and compromise of patient-care health and safety.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-9 JORGE L. COLON
Jorge L. Colon, Senior Correction Officer, Riverfront State Prison, Department of Corrections, suspension for 20 days, on charges of insubordination and intentional disobedience or refusal to accept an order, assaulting or resisting authority, disrespect, or use of abusive language to a supervisor. The Merit System Board at its meeting of September 10, 1998, directed that this matter be held over for a summary of testimony.
Recommendation of the Administrative Law Judge - Reverse the suspension.
ACTION: The Merit System Board upheld the 20 day suspension.
A-10 BRIAN OLIVER
Brian Oliver, Laborer, City of Trenton, Department of Public Works, removal effective July 30, 1997, on charges of insubordination and conduct unbecoming a public employee. The Merit System Board at its meeting of October 27, 1998, directed that this matter be held over for further review.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board directed that this matter be held over.

B-1 GERARD GERARDI
Gerard Gerardi appeals his rejection as a Correction Officer Recruit candidate by the New Jersey Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit on the basis of medical unfitness to perform effectively the duties of the position.
ACTION: The Merit System Board directed that this appeal be denied.

John J. Schulz, Jr., a Senior Correction Officer with the Adult Diagnostic and Treatment Center, Department of Corrections, represented by Willard Geller, Esq., appeals the denial of sick leave injury (SLI) benefits.

George M. Johnson, represented by Steven A. Varano, Esq., appeals the decision of Human Resource Information Systems which found that the appellant had not been improperly bypassed by Deptford Township on the eligible list for Police Sergeant (PM4746P).
ACTION: The Merit System Board granted a hearing.
B-10 ANTHONY AMES
Anthony Ames, represented by Anthony P. Marcozzi, Jr., Esq., appeals the decision of the Certification/Placement Services Unit which upheld the Department of Correction's removal of the appellant's name from the Correction Officer Recruit (S9998U) eligible list due to an unsatisfactory driving record.
ACTION: The Merit System Board directed that this appeal be denied.
B-11 ANDREA MCCRAY
Andrea McCray appeals the decision of the Certification/Placement Services Unit which removed the appellant's name from the Sheriff's Officer Priority Hiring List #1 due to the appellant's non-appearance for an interview.
ACTION: The Merit System Board directed that this appeal be denied.
B-12 KYLE CAMPBELL
The Superior Court, Appellate Division, has stayed the decision of the Merit System Board in In the Matter of Kyle Campbell, and temporarily remanded the matter to the Board for reconsideration of its decision to consider the appointing authority's argument that Mr. Campbell's reinstatement to a non-school setting where he will not come into contact with students is impossible to implement.
ACTION: The Merit System Board ordered reinstatement to a non-school setting where he will have minimal contact with students.
B-13 JOHN FABIAN
The appeal of John Fabian, Police Officer, Police Department, Township of North Bergen, removal effective September 17, 1996 on charges, was heard by Administrative Law Judge Ken R. Springer (ALJ), who rendered his initial decision on August 24, 1998. The Merit System Board, at its meeting on October 14, 1998, ordered that the removal be vacated and awarded back pay, seniority and counsel fees.
ACTION: The Merit System Board directed that this matter be held over due to a lack of quorum of members from 10/14/98 meeting.
B-14 LESTER SMITH
The appeal of Lester Smith, Senior Building Maintenance Worker, The College of New Jersey, resignation not in good standing effective November 25, 1996, was heard by Administrative Law Judge Robert W. Scott (ALJ), who rendered his initial decision on September 4, 1998. The Merit System Board, at its meeting of October 14, 1998, concluded that the appointing authority's action in resigning the appellant not in good standing should be affirmed.
ACTION: The Merit System Board directed that this matter be held over due to a lack of quorum of members from 10/14/98 meeting.
B-15 MICHAEL QUINLAN
The appeal of Michael Quinlan, a County Correction Officer with the Sheriff's Department, Passaic County, concerning his removal effective February 23, 1996 on charges, was heard by Administrative Law Judge Jeffrey A. Gerson (ALJ), who rendered his initial decision on August 12, 1998. The Merit System Board, at its meeting of September 29, 1998, referred the matter to the Medical Examiners Panel for further review.
ACTION: The Merit System Board directed that this matter be held over due to a lack of quorum of members from 9/29/98 meeting.
B-16 JUSTINE BRANHAM, ET AL.
Justine Branham, Betty Burrows and Keith Hopkins petition the Merit System Board for back pay in regard to their retroactive appointments to the title of Police Officer with the Newark Police Department.
ACTION: The Merit System Board directed that this matter be held over for a full Board.
B-17 GEORGE LOPEZ
Cumberland County, represented by Richard Geiger, County Counsel, requests that the Merit System Board enter an order determining that George Lopez has waived his right to seek reinstatement to his position as a County Correction Captain.
ACTION: The Merit System Board ordered a departmental hearing be held within 30 days of the issuance of this decision.
B-18 WESLEY HOOD
Wesley Hood, a County Correction Officer with the Atlantic County Department of Public Safety, represented by A. J. Fusco, Jr., Esq., petitions the Merit System Board to reconsider its final decision dismissing his appeal without prejudice based on his failure to pursue.
ACTION: The Merit System Board denied the request for reconsideration.
B-19 HOBOKEN FIRE CAPTAIN PROVISIONAL APPOINTMENTS
The International Association of Fire Fighters, Local 1078 (IAFF), represented by Bruce D. Leder, Esq., appeals the August 1998 provisional appointments of Dennis Knapp, Heywood Blakely and John Cunning to the position of Fire Captain. Additionally, Mauro Andruela, Thomas Molta and William Montanez, represented by Samuel J. Samaro, Esq., appeal their non appointment as Fire Captains.

B-27 ACCOUNT CLERK (M5626T), CITY OF NEWARK
The City of Newark requests reconsideration of that part of the decision rendered on February 10, 1998 by the Merit System Board ordering the appointing authority to pay compliance processing costs in the amount of $250 with regard to a certification for Account Clerk (M5626T).
ACTION: The Merit System Board denied the request for reconsideration.
B-28 CLAIMS INVESTIGATOR (M4895S), JERSEY CITY
The City of Jersey City requests reconsideration of the decision rendered on March 11, 1997 by the Merit System Board ordering the immediate disposition of the outstanding certification for Claims Investigator (M4895S), the immediate removal of the person against whom a salary disapproval had been issued and the assessment of $250 in compliance costs.
ACTION: The Merit System Board denied the request for reconsideration.
B-29 JOHN BIRD, ET AL.
John Bird, Joseph P. Faone, and Osvaldo Reyes appeal the determinations of the Division of Selection Services, which found that they did not meet the experience requirements for the open competitive examination for Truck Driver Single Axle (S6600S).
ACTION: The Merit System Board directed that this appeal be denied.
B-30 THOMAS G. BONFIGLIO
Thomas G. Bonfiglio appeals the determination of the Division of Human Resource Selection Services which denied his eligibility for admittance to the examination for Program Coordinator Mental Health (PS3754K), Hagedorn Geriatric Hospital.
ACTION: The Merit System Board directed that this appeal be granted.

Ermand D. Centofanti appeals the determination of the Division of Human Resource Management which found that he was ineligible for the promotional examination for Principal Clerk Typist (PM0516U), Brick Township.

Lisa Alexander-Taylor, Assistant Corporation Counsel/Newark Police Department requests administrative relief in order to deem Daniel DeLorenzi eligible for the Deputy Police Chief (PM0924W), Newark promotional examination which was announced in July, 1998, specifically, the request is for a retroactive regular appointment date of January 22, 1998 for Mr. DeLorenzi in the title of Police Captain.
ACTION: The Merit System Board directed that this request be granted.

The City of Newark, represented by Richee Lori Smith, Assistant Corporation Counsel, appeals the decision of the Division of Human Resource Management which determined that the provisional appointment of Edward Dunham to the position of Fire Chief was improper.
