Recommendation of the Administrative Law Judge - Modify the 30 day suspension to a 7 day suspension and reimbursement for 23 days back pay.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-11 DONALD EVANS - SETTLEMENT
Initial removal effective June 3, 1997, on charges of chronic or excessive absenteeism or lateness, conduct unbecoming a public employee and neglect of duty. Settled to reinstatement to his position on the condition that he submits to a drug/alcohol test and the results of the screening are negative. The Merit System Board at its meeting of October 14, 1998 directed that this matter be held over for receipt of a letter of clarification.
ACTION: The Merit System Board acknowledged the settlement as clarified.
A-12 BRYON DOUGLAS
Bryon Douglas, Senior Correction Officer at the Garden State Reception and Youth Correctional Facility, Department of Corrections, suspension for 30 days on charges of incompetency, inefficiency and failure to perform duties. Specifically, the appointing authority asserted that the appellant negligently contributed to the elopement or escape of an inmate. The Board considered this matter at its meeting on October 27, 1998 but requested more information concerning the hearing record before the Office of Administrative Law.
Recommendation of the Administrative Law Judge - Reverse the 30-day suspension.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

The appeal of Lizette Priliszh, Deputy Municipal Court Administrator, Municipal Court, Woodbridge Township, regarding her seven-day suspension on charges of conduct unbecoming a public employee, was heard by Administrative Law Judge (ALJ) Walter F. Sullivan, who rendered his initial decision on October 15, 1998. The Merit System Board, at its meeting on November 24, 1998, adopted the ALJ's recommendation that the seven-day suspension be modified to a four-day suspension. However, the Board noted its disapproval of certain language in the ALJ's initial decision.
ACTION: The Merit System Board adopted the final decision.
B-17 ROSALIND CANDELARIA
The appeal of Rosalind Candelaria, Clerk Typist, City of Hoboken, concerning her removal during her working test period, was heard by Administrative Law Judge Diana C. Sukovich (ALJ), who rendered her initial decision on September 23, 1998. The Merit System Board, at its meeting on November 10, 1998, ordered that the removal be reversed and that appellant be provided a new working test period.

The appointing authority's failure to properly dispose of the certification for Community Service Aide while a provisional appointee is serving in the title has been referred to the Merit System Board for enforcement.
ACTION: The Merit System Board ordered the appointing authority to remove the provisional appointee, make an appointment from the certification and pay compliance costs.

Rachel Ann Burris, Police Officer, Township of West Orange, represented by David C. Stanziale, Esq., seeks enforcement of that part of the Merit System Board decision rendered on May 8, 1998, granting her back pay, seniority and counsel fees.
ACTION: The Merit System Board granted the request in part and ordered the appointing authority to pay appellant a back pay award of $117,588.23 and counsel fees in the amount of $9,179.19.

Spring, Esq., seeks a stay pending the outcome of its appeal to the Superior Court, Appellate Division, of the decision of the Merit System Board rendered on September 10, 1998 which denied the District's request for reconsideration of the prior Board decision which reinstated Ms. Caldwell to a position as a Custodial Worker following a six-month suspension. Additionally, Ms. Caldwell, represented by John M. Esposito, Esq., petitions the Board for further enforcement of the order.

The appeal of Glyndell Curry, Residential Living Specialist, Vineland Developmental Center, Department of Human Services, removal effective June 30, 1997 on charges, was heard by Administrative Law Judge Lillard E. Law (ALJ), who rendered his initial decision on October 9, 1998. The Merit System Board, at its meeting on November 24, 1998, ordered that this matter be remanded to the Office of Administrative Law.
ACTION: The Merit System Board adopted the final decision.

The Manager, Public Safety Testing, requests that the provisions of N.J.A.C. 4A:4-2.9(b) be relaxed in order to permit Sergeant Theaudric Holmes to take a make-up examination for the promotional examination for Police Lieutenant (PM1624W), City of Asbury Park.
ACTION: The Merit System Board granted the request.
