A regular meeting of the Merit System Board was held on Tuesday, December 8, 1998 in Trenton, New Jersey. PRESENT: Chairwoman Janice Mitchell Mintz; Merit System Board Members, Margaret E.L. Howard, Judith L. Shaw, Julius J. Mastro, and Edward W. Verner, M.D., Elizabeth Laufer, Deputy Attorney General; Henry Maurer, Director, Elizabeth A. In accordance with L.1975, c.231, Janice Mitchell Mintz, Chairwoman, Merit System Board, opened the meeting with the following statement: Notice of this Meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 1, 1997 and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey. a client.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.


A-3 MICHAEL CALDWELL, NANCY NIELSEN AND MARGIE CALDWELL

Michael Caldwell, Lieutenant, Department of Adult
Corrections - Middlesex County, removal effective November
8, 1996, on charges of incompetency, inefficiency or failure
to perform duties (7 counts).

Nancy Nielsen, Correction Officer, Department of Adult
Corrections - County of Middlesex, removal effective October
28, 1996, on charges of incompetency, inefficiency or
failure to perform duties (4 counts).

Margie Caldwell, Correction Officer, Department of Adult
Corrections, Middlesex County, removal effective November
19, 1996, on charges of incompetency, inefficiency or
failure to perform duties (5 counts).

Recommendation of the Administrative Law Judge - Michael
Caldwell - removal modified to demotion to Correction
Officer and a six months suspension; Nancy Nielsen - removal
modified to a four month suspension; and Margie Caldwell -
removal modified to a six month suspension.

ACTION: The Merit System Board affirmed the
recommendations of the Administrative Law Judge.


A-4 ROBERT JOYNER, JR.

Robert Joyner, Jr., Juvenile Detention Officer, Youth
Detention Center, Monmouth County, removal effective October
10, 1995, on charges of sexual assault of a female resident
and conduct unbecoming an employee in public service.

Recommendation of the Administrative Law Judge -Reverse the
removal.

ACTION: The Merit System Board directed that this matter
be held over.

A-5 LAWRENCE ZAMENSKY

Lawrence Zamensky, Senior Correction Officer, Garden State
Reception and Youth Correctional Facility, Department of
Corrections, removal effective July 13, 1994, on charges of
conduct unbecoming a public employee and conviction of an
offense involving dishonesty or of a crime of a third degree
or above, or of an offense involving or touching his/her
office, position or employment.

Recommendation of the Administrative Law Judge - Six month
suspension for the first charge and removal for the second
charge.

ACTION: The Merit System Board directed that this matter
be held over.

A-6 LAWRENCE T. COPLING

Lawrence Copling, Senior Correction Officer, Riverfront
State Prison, Department of Corrections, suspension for 15
days, on charges of insubordination; intentional
disobedience or refusal to accept an order, assaulting or
resisting authority, disrespect or use of insulting or
abusive language to a supervisor.

Recommendation of the Administrative Law Judge -Reverse the
suspension and award back pay, benefits and seniority.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-7 ADRIAN KLIGE

Adrian Klige, Police Officer, City of Plainfield concerning
the promotional examination for Police Sergeant (PM0981U).

Recommendation of the Administrative Law Judge - Examination
disqualification, Police Sergeant (PM0981U).

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-8 DINA PARKER-TODD

Dina Parker-Todd, Administrative Analyst, City of Asbury
Park, layoff effective May 9, 1995, for reasons of economy
(position abolished).

Recommendation of the Administrative Law Judge - Uphold the
layoff.

ACTION: The Merit System Board remanded this matter to the
Office of Administrative Law.

A-9 PAUL RICHTER

Paul Richter, Department of Environmental Protection, layoff
effective July 8, 1995 for reasons of economy.

Recommendation of the Administrative Law Judge - Uphold the
layoff.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-10 GEORGE SYDLAR

George Sydlar, Police Officer, Police Department, City of
Jersey City, suspension for 30 days, beginning March 27,
1995 and ending April 25, 1995, on charges of refusal to
obey a lawful order on March 16, 1995 and March 27, 1995.

Recommendation of the Administrative Law Judge - Modify the
30 day suspension to a 7 day suspension and reimbursement
for 23 days back pay.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-11 DONALD EVANS - SETTLEMENT

Initial removal effective June 3, 1997, on charges of
chronic or excessive absenteeism or lateness, conduct
unbecoming a public employee and neglect of duty. Settled
to reinstatement to his position on the condition that he
submits to a drug/alcohol test and the results of the
screening are negative. The Merit System Board at its
meeting of October 14, 1998 directed that this matter be
held over for receipt of a letter of clarification.

ACTION: The Merit System Board acknowledged the settlement
as clarified.

A-12 BRYON DOUGLAS

Bryon Douglas, Senior Correction Officer at the Garden State
Reception and Youth Correctional Facility, Department of
Corrections, suspension for 30 days on charges of
incompetency, inefficiency and failure to perform duties.
Specifically, the appointing authority asserted that the
appellant negligently contributed to the elopement or escape
of an inmate. The Board considered this matter at its
meeting on October 27, 1998 but requested more information
concerning the hearing record before the Office of
Administrative Law.

Recommendation of the Administrative Law Judge - Reverse the
30-day suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.


SECTION B - MISCELLANEOUS MATTERS

B-1 PABLO COSME, JR.

Pablo Cosme, Jr., appeals the request by the City of Trenton
to remove his name from the Police Officer (M4332S) eligible
list on the basis of medical unfitness to effectively
perform the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-2 TOWANDA HOPPER

Towanda Hopper appeals her rejection as a County Correction
Officer candidate by the County of Union and its request to
remove her name from the eligible list for County Correction
Officer on the basis of psychological unfitness to perform
effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-3 RODNEY BAGBY

Rodney Bagby, represented by Mitchell L. Goldstein, Esq.,
appeals his rejection as a Police Officer candidate by the
City of Newark and its request to remove his name from the
eligible list for Police Officer on the basis of
psychological unfitness to perform effectively the duties of
the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-4 HOWARD E. KEE, JR.

Howard E. Kee, Jr., appeals his rejection as a Correction
Officer Recruit candidate by the Department of Corrections
and its request to remove his name from the eligible list
for Correction Officer Recruit on the basis of psychological
unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be granted.

B-5 HEATHER LIGHTBODY

Heather Lightbody appeals her rejection as a Campus Police
Officer candidate by William Patterson College and its
request to remove her name from the priority hiring list for
Campus Police Officer on the basis of psychological
unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-6 ALEXANDER PAUL BELLINO

Alexander Paul Bellino, a Correction Sergeant at the Adult
Diagnostic and Treatment Center, Department of Corrections,
represented by Jeffrey Smith, New Jersey Law Enforcement
Supervisors Association, appeals the denial of sick leave
injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal
be granted.

B-7 ERIK SANTIAGO

Erik Santiago, a County Correction Officer with the Sussex
County Sheriff's Office, represented by Robert G. Stahl,
Esq., petitions the Merit System Board for interim relief.

ACTION: The Merit System Board denied the request.

B-9 CHARLES BRUCCOLIERE

Charles Bruccoliere appeals the decision of Human Resource
Information Services which found that the Department of
Labor had presented a sufficient basis to remove his name
from the eligible list for Inspector, Boiler and Pressure
Vessel Compliance (S1641T).

ACTION: The Merit System Board directed that this appeal
be denied.

B-10 SWAPNA DAS

Swapna Das appeals the request of the Department of
Environmental Protection appointing authority to remove her
name from the Environmental Specialist (S6039O) eligible
list based on a claimed inability to communicate effectively
in English in order to perform the duties of the position.

ACTION: The Merit System Board granted a hearing.

B-11 HOMER I. ROZIER

Homer I. Rozier, represented by Jeffrey F. Belz, Esq.,
appeals the decision of the Certification/Placement Services
Unit which found that the Department of Corrections had
presented a sufficient basis to remove appellant's name from
the Correction Officer Recruit (S9676P and S9678P) eligible
lists due to an unsatisfactory driving record.

ACTION: The Merit System Board directed that this appeal
be denied.

B-12 ADELE SAVALLI

Adele Savalli appeals the determination of the Division of
Human Resource Information Services, which removed her name
from the special reemployment list for Senior Clerk,
Department of Human Services.

ACTION: The Merit System Board directed that this appeal
be granted in part.

B-13 SYLVESTER HENDERSON

Sylvester Henderson, represented by David B. Beckett, Esq.,
petitions the Merit System Board for reconsideration of the
final administrative decision, rendered on May 19, 1998,
which upheld a 30-day suspension and a removal charge levied
against him.

ACTION: The Merit System Board denied the request for
reconsideration.

B-14 HOLLIS BRUCE, JR.

The appeal of Hollis Bruce, Jr., Senior Correction Officer,
Bayside State Prison, removal effective November 6, 1996 on
charges, was heard by Administrative Law Judge Lillard E.
Law (ALJ), who rendered his initial decision on October 1,
1998. The Merit System Board, at its meeting on November
10, 1998, ordered that the removal be upheld.

ACTION: The Merit System Board adopted the final decision.

The appeal of John DeBenedictis, a Correction Sergeant at
Northern State Prison, Department of Corrections, concerning
his 10 day suspension, on charges, was heard by
Administrative Law Judge Maria Mancini LaFiandra, who
rendered her initial decision on September 24, 1998. The
Merit System Board, at its meeting on November 10, 1998,
ordered that this matter be remanded to the Office of
Administrative Law.

ACTION: The Merit System Board adopted the final decision.

B-16 LIZETTE PRILISZH

The appeal of Lizette Priliszh, Deputy Municipal Court
Administrator, Municipal Court, Woodbridge Township,
regarding her seven-day suspension on charges of conduct
unbecoming a public employee, was heard by Administrative
Law Judge (ALJ) Walter F. Sullivan, who rendered his initial
decision on October 15, 1998. The Merit System Board, at
its meeting on November 24, 1998, adopted the ALJ's
recommendation that the seven-day suspension be modified to
a four-day suspension. However, the Board noted its
disapproval of certain language in the ALJ's initial
decision.

ACTION: The Merit System Board adopted the final decision.

B-17 ROSALIND CANDELARIA

The appeal of Rosalind Candelaria, Clerk Typist, City of
Hoboken, concerning her removal during her working test
period, was heard by Administrative Law Judge Diana C.
Sukovich (ALJ), who rendered her initial decision on
September 23, 1998. The Merit System Board, at its meeting
on November 10, 1998, ordered that the removal be reversed
and that appellant be provided a new working test period.

ACTION: The Merit System Board adopted the final decision.

B-18 JORGE L. COLON

The appeal of Jorge L. Colon, a Senior Correction Officer,
Riverfront State Prison, Department of Corrections,
concerning his suspension for 20 days on charges of
insubordination, intentional disobedience or refusal to
accept an order, assaulting or resisting authority and
disrespect or use of abusive language to a supervisor was
heard by Administrative Law Judge Jeff S. Masin, who
rendered his initial decision on July 28, 1998. The Merit
System Board, at its meeting on November 10, 1998, ordered
that the suspension be upheld.

ACTION: The Merit System Board adopted the final decision.

B-19 COMMUNITY SERVICE AIDE (M6197O), CITY OF JERSEY

The appointing authority's failure to properly dispose of
the certification for Community Service Aide while a
provisional appointee is serving in the title has been
referred to the Merit System Board for enforcement.

ACTION: The Merit System Board ordered the appointing
authority to remove the provisional appointee,
make an appointment from the certification and pay
compliance costs.

B-20 RACHEL ANN BURRIS

Rachel Ann Burris, Police Officer, Township of West Orange,
represented by David C. Stanziale, Esq., seeks enforcement
of that part of the Merit System Board decision rendered on
May 8, 1998, granting her back pay, seniority and counsel
fees.

ACTION: The Merit System Board granted the request in part
and ordered the appointing authority to pay
appellant a back pay award of $117,588.23 and
counsel fees in the amount of $9,179.19.

B-21 JAMES BALDINI

James Baldini appeals the decision of the Division of
Selection Services which found that appellant did not meet
the experience requirements for the open competitive
examination for Program Development Specialist, Community
Service (C0015O), Sussex County.

ACTION: The Merit System Board directed that this appeal
be denied.

B-22 MARY BATTLE

Mary Battle appeals the determination of the Division of
Selection Service which found that she did not meet the
education requirements for the open-competitive examination
for Administrative Analyst 2, Management Auditor (S1625T).

ACTION: The Merit System Board directed that this appeal
be denied.

B-23 JILL BRUZZANO

Jill Bruzzano appeals the decision of the Division of
Selection Services which found that appellant did not meet
the requirements for the promotional examination for Chief
of Administrative Services (PC4352V), Essex County.

ACTION: The Merit System Board directed that this appeal
be granted.

B-24 CHERYL L. BURNS

Cheryl L. Burns appeals the decision of the Division of
Selection Services which found that appellant did not meet
the experience requirements for the promotional examination
for Secretarial Assistant 3 (Non-Stenographic) (PS0629P),
Department of Law and Public Safety.

ACTION: The Merit System Board directed that this appeal
be denied.

James Comstock appeals the determination of the Division of
Selection Services which found that he did not meet the
experience requirements for the promotional examination for
Executive Assistant 2 (PS6105I), Department of Corrections.

ACTION: The Merit System Board directed that this appeal
be granted.

Kathryn Dawson appeals the determination of the Division of
Selection Services which found that she did not meet the
experience requirements for the promotional examination for
Executive Assistant 2 (PS6175D), Department of Community
Affairs.

Jeffrey J. Elder appeals the denial of his eligibility for

Elaine Evans appeals the determination of the Division of
Selection Services which found that she did not meet the
educational requirements for the open-competitive
examination for Employment Services Trainee (S0337W).

Constance Mester, Alpana Patel and Jesusa Sundiang appeal
the determinations of the Division of Selection Services
which found that they did not meet the educational

ACTION: The Merit System Board directed that this appeal
be denied.

Edward Lloyd appeals the determination of the Division of
Selection Services that he is not entitled to veterans
preference for merit system testing.

B-52 MINUTES

The Merit System Board Minutes for the meeting of November
24, 1998 are submitted for adoption.

ACTION: The Merit System Board adopted the minutes of its
meeting of November 10, 1998.

B-53 SHARON CALDWELL

The State-Operated School District of the City of Newark,
represented by Ronnie H. Spring, Esq., seeks a stay pending
the outcome of its appeal to the Superior Court, Appellate
Division, of the decision of the Merit System Board rendered
on September 10, 1998 which denied the District's request
for reconsideration of the prior Board decision which
reinstated Ms. Caldwell to a position as a Custodial Worker
following a six-month suspension. Additionally, Ms.
Caldwell, represented by John M. Esposito, Esq., petitions
the Board for further enforcement of the order.

ACTION: The Merit System Board denied the request for
stay, but granted the request for enforcement.

B-54 GLYNDELL CURRY

The appeal of Glyndell Curry, Residential Living Specialist,
Vineland Developmental Center, Department of Human Services,
removal effective June 30, 1997 on charges, was heard by
Administrative Law Judge Lillard E. Law (ALJ), who rendered
his initial decision on October 9, 1998. The Merit System
Board, at its meeting on November 24, 1998, ordered that
this matter be remanded to the Office of Administrative Law.

ACTION: The Merit System Board adopted the final decision.

B-55 THEAUDRIC HOLMES

The Manager, Public Safety Testing, requests that the
provisions of N.J.A.C. 4A:4-2.9(b) be relaxed in order to
permit Sergeant Theaudric Holmes to take a make-up
examination for the promotional examination for Police
Lieutenant (PM1624W), City of Asbury Park.

ACTION: The Merit System Board granted the request.

B-56 MICHAEL COTE

Michael Cote appeals his score on the promotional
examination for Equipment Operator (PM3474V), Rutherford.

ACTION: The Merit System Board directed that this appeal
be denied.
