A regular meeting of the Merit System Board was held on Tuesday, March 9, 1999 in Trenton, New Jersey.PRESENT: Chairwoman Janice Mitchell Mintz; Merit System Board Members, Margaret E.L. Notice of this Meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 1, 1997 and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

The Department of Labor requests the redesignation of a position previously allocated to the Senior Executive Service. The position is currently vacant as result of the retirement of its most recent incumbent. The Department of Labor proposes that the position remain in the Senior Executive Service; however, different duties would be assigned before the positon is refilled.Redesignation of Current Senior Executive Service PositionsSenior Executive Service Position Number 040807 is currently vacant. It was previously designated as Director of Workforce New Jersey Support. It would now be designated as Assistant Director Work First Operations and assigned duties commensurate with that title. The Department of Labor states the position will retain substantial managerial, policy influencing and policy executing responsibilities at the Assistant Director level.Justification --Position # 040807The incumbent of this position will serve as Assistant Director, Work First Operations. The position will function under the general direction of the Director, Division of Employment and Training. The position will be responsible to administer the division welfare-to-work program services, which will include Tempory Assistance for Needy Families (TANF), Non-Public Assistance Food Stamp Program (NPAFS) and General Assistance Program (GAP). The position will plan and develop program services and formulate policies; supervise staff in the evaluation of program services; maintain liaison with other state departments and public agencies, and coordinate federal, state and local program services.

DEPARTMENT OF STATE

The Department of Personnel is requesting the creation of two
titles to be utilized in the Division of Archives and Records
Management, Department of State. Recently the Division of
Commercial Recording was transferred from the Department of State
to the Department of the Treasury. As a result, titles assigned
to perform technical work were also shifted to the Department of
the Treasury. Creation of these two titles will allow for proper
classification in the Division of Archives and Records
Management. The proposed salary ranges are comparable to
existing titles that perform similar duties.

A-13 MARGO MASCIANTONI - SETTLEMENT

Initial suspension for 10 days, on charges of neglect of
duty, loafing or willful failure to devote attention to
tasks which could result in danger to persons or property.
The Board at its meeting of January 26, 1999 directed that
this matter be held over.

Recommendation of the Administrative Law Judge - Uphold the
settlement.

charges of incompetency, inefficiency, or failure to perform

10, 1997, on charges of incompetence, inefficiency,
insubordination, conduct unbecoming a public employee,
neglect of duty and violence in the workplace.

Recommendation of the Administrative Law Judge - Uphold the
suspension and removal.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge to uphold the
suspension and modify the removal to a six month
suspension.

Appeal of Raymond Scott Freese, Correction Lieutenant,
Mountainview Youth Correctional Facility, Department of
Corrections, release at the end of the Working Test Period.

Recommendation of the Administrative Law Judge - Uphold the

ACTION: The Merit System Board granted a new working test
period.

A-20 THOMAS GRILL AND JAMES WALSH

Thomas Grill, Police Captain, Police Department, City of
Newark, suspended indefinitely beginning July 5, 1996,
pending disposition of criminal charges, and removal
effective May 28, 1997, on charges of conspiracy, official
misconduct, theft by deception and theft by extortion, and
James Walsh, Police Lieutenant, Police Department, City of
Newark, suspended indefinitely beginning July 5, 1996,
pending disposition of criminal charges, and removal
effective May 22, 1997 on charges of conspiracy, official
misconduct, theft by deception and theft by extortion.

Recommendation of the Administrative Law Judge - Reverse the
suspensions and modify the removals to formal written
reprimands and reinstate appellants with back pay, benefits,
seniority and counsel fees.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge to modify the
removal to a six month suspension.

A-21 WAYNE KELLER, SR.

Wayne Keller, Sr., Senior Correction Officer, Bayside State
Prison, Department of Corrections, suspension for 30 days,
on charges of conduct unbecoming an employee and being in
violation of a rule, regulation, policy, procedure or
administrative decision, and removals (2) effective June 5,
1996, on charges of conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the
30 day suspension and removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-22 JOHN PRIOR

John Prior, Fire Fighter, West Orange Fire Department,
suspension for 182 days effective December 2, 1997, on
charges which included neglect of duty, engaging in conduct
or activity which is detrimental to the department, and
conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the
suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-23 IRA ROCHELLE

Appeal of Ira Rochelle, Senior Buyer, County of Camden,
Department of Health and Human Services, layoff effective
May 11, 1997 for reasons of economy and efficiency.

Recommendation of the Administrative Law Judge - Uphold the
layoff.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge and reversed the
layoff.

Appeal of Max Wallenburg, Management Specialist, Camden
County Department of Health and Human Services, layoff

A-26 EUGENE E. ZAISS, JR.

Eugene E. Zaiss, Jr., Senior Correction Officer, Garden
State Youth Correctional Facility, Department of
Corrections, suspension for 10 days, on charges of
incompetency or inefficiency, threatening, intimidation,
harassing, coercing, or interfering with fellow employees on
State property, and conduct unbecoming an employee.

Recommendation of the Administrative Law Judge - Uphold the
suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-27 RAMONA COMER

Ramona Comer, Custodial Worker, Newark School District,
removal effective January 27, 1997, on charges of conduct
unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the

ACTION: The Merit System Board directed that this matter

A-28 FERNANDO GOTAY

Fernando Gotay, Senior Correction Officer, Northern State
Prison, Department of Corrections, removal effective March
20, 1997, on the charge of falsification.

Louis Putmon, Crew Supervisor, Ancora Psychiatric Hospital,
Department of Human Services, removal effective November 25,
1996, on charges of leaving assigned work area without
permission, sleeping while on duty, entering a restricted
area without specific permission, and conduct unbecoming a
public employee.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.


A-30 CARMEN SALTER

Carmen Salter, Senior Correction Officer, New Jersey State
Prison, Department of Corrections, removal effective March
7, 1997, on charges of inability to perform duty.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-31 HARRY ERVIN - SETTLEMENT

Initial 10 day suspension beginning August 21, 1997, on
charges of chronic or excessive absenteeism or lateness.
Settled to a seven day suspension and reimbursement of three
days back pay. The Board at its meeting of February 9, 1999
directed that this matter be held over for a clarifying
settlement information.

Recommendation of the Administrative Law Judge - Acknowledge
the settlement.

ACTION: The Merit System Board acknowledged the
settlement.

A-32 IYANA BYRD

Iyana Byrd, Human Services Assistant, Vineland Developmental
Center, Department of Human Services, removal effective
October 30, 1997, on charges of physical abuse of a client.
The Board at its meeting of January 26, 1999 directed that
this matter be held over for a testimony summary.

Recommendation of the Administrative Law Judge - Reverse the
removal.

ACTION: The Merit System Board remanded this matter to the
Office of Administrative Law.

ACTION: The Merit System Board directed that this appeal
be denied.

Kevin J. Farrington appeals his rejection as a Police
Officer candidate by the City of Camden and its request to
remove his name from the eligible list for Police Officer on
the basis of psychological unfitness to perform effectively
the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-3 JUAN ARIEL MUNIZ

Juan Ariel Muniz appeals his rejection as a Correction

ACTION: The Merit System Board directed that this appeal

Linda Cerminara, a Bus Driver with the Atlantic Regional

Lutis Holder, who was formerly employed as a Senior Laundry
Worker with North Jersey Developmental Center, Department of
Human Services, appeals the denial of sick leave injury
(SLI) benefits.

B-8 LOUISETTE JOHNSON

Louisette Johnson, a Judiciary Head Clerk with the Tax Court
of New Jersey, Administrative Office of the Courts,
represented by Jon Wineland, Staff Representative, CWA Local
1034, appeals the denial of sick leave injury (SLI)
benefits.

ACTION: The Merit System Board directed that this appeal

B-9 CURTIS A. ANDREWS

Curtis A. Andrews, a Research Scientist 2 with the
Department of Corrections (DOC), appeals the determination

James Avillo, Manolo F. Capili, Richard J. Delaney, Andre
Krawtschenko, Mark S. Maida, and James J. Yeager III
petition the Merit System Board for reconsideration of its
decision rendered on January 27, 1998 in which the Board
ordered that the scores of candidates who participated in
1994 Project Engineer promotional examinations be applied to
the 1997 administration of the Project Engineer, Surface
Design (PS4255T) promotional examination.

ACTION: The Merit System Board denied the request for
reconsideration.

B-87 ASSISTANT DIRECTOR OF ECONOMIC AND INDUSTRIAL DEVELOPMENT,
JERSEY CITY

The City of Jersey City, represented by Paul W. Mackey,
Esq., appeals the decision of the Division of Human Resource
Management that the special reemployment list for Project
Coordinator, Redevelopment is appropriate for use to fill
the position of Assistant Director of Economic and
Industrial Development.

ACTION: The Merit System Board directed that this appeal be
denied and the special reemployment list be
certified.
