2021 Real Estate Commission Disciplinary Actions

David A. Beach, a licensed New Jersey real estate Broker-Salesperson, Camden County – By Final Order of Determination dated October 1, 2021, the Commission determined Beach demonstrated incompetency pursuant to N.J.S.A. 45:15-17(e) by providing the access code to the buyer of a property and leaving her unattended at the property prior to the closing of the title; and, in violation of N.J.A.C. 11:5-6.4(a) by failing to deal fairly with all parties to the transaction. Beach’s license will be held on probation for a period of one year.  Within six months of the issuance of the Order, Beach is required to complete six hours of Continuing Education – three each in the content areas of Ethics and Agency which will not count towards his required hours for renewal. A $3,250 fine is imposed.

Jose Rodrigues, a licensed New Jersey real estate Broker Salesperson, Bergen County By Final Order of Determination dated October 1, 2021, the Commission found Rodrigues in violation of N.J.A.C. 11:5-6.1(r) in that the language used in Rodrigues’ property advertisement constituted false, misleading or deceptive claims; and, in violation of N.J.S.A. 45:15-17(e) in that the above conduct demonstrates incompetency. Rodrigues is required to complete an additional nine hours of Continuing Education – three each in the content areas of Ethics, Disclosure and Agency which will not count towards his required hours for renewal. A $2,500 fine is imposed.

George Denney, a licensed New Jersey real estate Broker, Camden County – By Final Order of Determination dated August 27, 2021, the Commission found Denney in violation of N.J.A.C. 11:5-4.2(a)(1) in that as the broker of record Denney is responsible for the actions of persons licensed through his real estate business. Denney is required to complete an additional three hours of Continuing Education in the content area of Agency which will not count towards his required hours for renewal within six months of issuance of this Order. A $2,500 fine is imposed.

Terry Grayson, a licensed New Jersey real estate Salesperson, Camden County – By Final Order of Determination dated August 27, 2021, the Commission found Grayson in violation of N.J.A.C. 11:5-5.1(e) in that he failed to deposit the money of a buyer into the business trust account. Grayson is required to complete an additional three hours of Continuing Education in the content area of Agency which will not count towards his required hours for renewal within six months of issuance of this Order. A $500 fine is imposed.

Ricardo Belgrave, a licensed New Jersey real estate Salesperson, Atlantic County – By Final Order of Determination dated June 17, 2021, the Commission determined Belgrave demonstrated incompetency pursuant to N.J.S.A. 45:15-17(e) in that he purposefully left his clients unaccompanied by a licensee, allowing them unauthorized and unsupervised access to the property. Belgrave’s license was suspended for thirty days and any license issued following suspension will be held on probation for a period of six months. A $2,000 fine is imposed.

Franklin H. Levin, a licensed New Jersey real estate Salesperson, Cape May County – By Consent Order dated June 7, 2021, Levin admitted to a violation of N.J.S.A. 45:15-17(a) in that he made a substantial misrepresentation by falsely representing to the listing agent that he would accompany his clients to access and view a property when he was, in fact, out of state at the time; and, a violation of N.J.S.A. 45:15-17(e) in that his conduct demonstrates dishonesty and unworthiness. Levin’s license is suspended for a period of thirty days from the issuance of the Order. A $3,500 fine is imposed. No license shall be issued/re-issued until payment in full of fine is made. Any license issued following suspension shall be held on probation for a period of six months. Levin agrees to complete three hours of Continuing Education in the content area of Ethics which will not count towards his required hours for renewal.

Paula Lyden, a licensed New Jersey real estate Salesperson, Essex County – By Consent Order dated June 7, 2021, Lyden admits to a violation of N.J.S.A. 45:15-17(e), incompetency, in that she failed to confirm that her client was the legal owner of a property prior to marketing said property and entering into a contract of sale for the property. Lyden agrees to pay in full the outstanding balance of a fine assessed against her in conjunction with a previous Consent Order within ninety days of issuance of this Order. Lyden agrees to pay an additional fine in the amount of $4,000 also within ninety days of issuance of the Order. Failure to pay within the set timeframe is grounds for immediate suspension of license until obligations are paid in full. Lyden agrees to a thirty-day license suspension, with any license issued following suspension to be held on probation for a period of one year. Lyden agrees to complete three hours of Continuing Education in the content area of Disclosure which will not count towards her required hours for renewal.

Raymond J. Rice, a formerly licensed New Jersey Real Estate Broker-Salesperson, Morris County – By Final Order of Determination dated May 27, 2021, the Commission found Rice in violation of N.J.S.A. 45:15-1 & 3 in that he transacted real estate activity outside the scope of his employment without authorization from his employing broker; and, in violation of N.J.S.A. 45:15-17(m) in that he collected commission from someone other than his employing broker; and, in violation of N.J.S.A. 45:15-17(q) in that he failed to indicate license status on an executed contract of sale; and; in violation of N.J.S.A. 45:15-17(e) in that the above conduct demonstrates bad faith and dishonesty. Rice’s license is suspended for a period of three months from the date of issuance of the Order. Rice is required to complete an additional six hours of Continuing Education – three each in the content areas of Ethics and Agency  – which will not count towards his required hours for renewal. A $3,000 fine is imposed.

Albert Diodonet, a licensed New Jersey real estate Salesperson, Passaic County By Final Order of Determination dated March 9, 2021 the Commission dismissed the matter for insufficient evidence to prove allegations as set forth in the Order to Show Cause.
