New Jersey Department of Health Specially Repeals and Specially Adopts, and Concurrently Proposes to Readopt, New Rules at N.J.A.C. 8:63 Harm Reduction Services

On June 12, 2023, the Division of HIV, STD, and TB Services of the Public Health Services Branch of the New Jersey Department of Health (Department) filed a Notice of Special Repeal and Special Adoption of, and Concurrent Proposal to Readopt, New Rules at N.J.A.C. 8:63 Harm Reduction Services.  Pursuant to N.J.S.A. 26:5C-31 and 52:14B-5.1(c)(2), the specially adopted repeal and new rules took effect on filing, and the new rules will remain in effect until June 6, 2024.

The specially adopted new rules, which the Department concurrently proposes to readopt, implement the Department’s rulemaking obligation pursuant to the “Bloodborne Disease Harm Reduction Act,” codified in part at N.J.S.A. 26:5C-25, et seq., particularly at 26:5C-31, to establish standards for the establishment, operation, and Department oversight of harm reduction services centers in the State.  The rules establish general provisions; forms and procedures to register, or renew the registration of, a harm reduction services center with the Department; harm reduction center operating standards; and Department procedures for enforcement of the chapter.

The Notice of Special Repeal and Special Adoption of, and Concurrent Proposal to Readopt, New Rules at N.J.A.C. 8:63 Harm Reduction Services, appears in the July 17, 2023, issue of the New Jersey Register.  Persons wishing to comment on the proposed readoption of the specially adopted new rules must submit written comments either (1) electronically by September 15, 2023, to www.nj.gov/health/legal/ecomments.shtml; or (2) by regular mail postmarked on or before September 15, 2023, to Joy L.
