New Jersey Department of Health Specially Adopts, and Concurrently Proposes to Readopt, New Rules at N.J.A.C. 8:97 Implementing Nursing Home Financial Transparency Reporting and National Health Care Safety Network Participation

The New Jersey Department of Health (Department), with the approval of the Health Care Administration Board, specially adopts new rules at N.J.A.C. 8:97 to implement N.J.S.A. 26:2H-46.1 through 46.4.  Pursuant to N.J.S.A. 26:2H-46.4, the specially adopted new rules became effective upon the Department’s filing of the notice of special adoption with the Office of Administrative Law on February 21, 2024, and remain effective for 18 months thereafter, until August 21, 2025.  The Department concurrently proposes to readopt the specially adopted new rules, thereby extending the chapter’s effectiveness for an additional 180 days, to February 17, 2026 (due to an inadvertent error, the notice indicates an incorrect expiration date, which will be corrected in a notice of administrative correction to be published in an upcoming issue of the New Jersey Register).

The specially adopted new rules require a New Jersey licensed nursing home to implement financial transparency reporting and to participate in the Long-term Care Facility Annual Survey and Monthly Reporting Plan of the National Health Care Safety Network of the Centers for Disease Control and Prevention (CDC).

The notice of special adoption of, and concurrent proposal to readopt, new rules at N.J.A.C. 8:97 appears in the March 18, 2024, issue of the New Jersey Register.  Persons wishing to comment on the proposed readoption must submit written comments either (1) electronically by ‎May 17, 2024, ‎to www.nj.gov/health/legal/ecomments.shtml; or (2) by regular mail postmarked by ‎May 17, 2024, to Kimberly E.
