Am I a retailer?
Answer: You are a retailer if you sell new computers, monitors, laptops and/or televisions in New Jersey, by any means, to a consumer.
Retailers can only sell products that are labeled with the manufacturers brands.
A retailer can only sell compliant or pending compliant manufacturer products. In accordance with the "Electronic Waste Management Act" N.J.S.A. 13:1E-99.94 et seq 13:1E-99.99 (c) and (d) The Department shall maintain this list of manufacturers in compliance with the requirements of the Ewaste Law and retailers of covered electronic devices must consult this list prior to selling covered electronic devices in this state. Retailers may only sell covered electronic devices produced by compliant manufacturers. A covered electronic device includes but is not limited to a television, computer, laptop, portable computer and monitor. Retailers must consult the manufacturer compliance list, found here.
Retailers must provide printed information regarding e-waste recycling opportunities in New Jersey. Click here to find the NJDEP suggested outreach template. This information must be provided by retailers to the consumer at the point of sale to customers purchasing new computers, laptops, monitors, or televisions. Additionally, internet or catalog sellers must include this information in an easily visible location on their website and in their hard copy.
