Medical Aid in Dying

On August 14, 2019, the New Jersey Superior Court, Chancery Division, entered an Order enjoining the Attorney General of New Jersey from enforcing the New Jersey Medical Aid in Dying for the Terminally Ill Act.

On August 15, 2019, the Division of Law filed a letter requesting clarification of the Chancery Court’s Order. On August 16, 2019, the Appellate Division granted the Attorney General permission to seek emergency relief from the Chancery Court’s Order. The response to the Attorney General’s motion for emergent relief is due on August 23, 2019.

Until further action is taken by the courts, the Chancery Court’s Order of August 14, 2019, places licensed professionals at legal risk for actions taken pursuant to the Medical Aid in Dying Act, including issuing or filling prescriptions.

The Medical Aid in Dying for the Terminally Ill Act (sometimes referred to as "MAID") is effective in New Jersey as of August 1, 2019.

MAID allows an adult New Jersey resident, who has the capacity to make health care decisions and who has been determined by that individual’s attending and consulting physicians to be terminally ill, to obtain medication that the patient may self-administer to end the patient’s life.

Submission Instructions:

Under P.L.2019, c.59, the compliance forms and the Medication Dispensing Record must be filed with the New Jersey Department of Health.  Currently, the forms must be mailed to the Office of the Chief State Medical Examiner, 120 South Stockton Street, 3rd floor, PO Box 360, Trenton, NJ 08625.  An electronic submission process is forthcoming.  Any changes or additional submission processes will be posted here.
