New Jersey Department of Health Proposes New Rules to Establish Procedures for Public Notice, Public Hearing, and Public Comment for the New Jersey Early Intervention System at N.J.A.C. 8:17-19
The New Jersey Department of Health (Department) is proposing a new rule at N.J.A.C. 8:17-19, Procedures for Public Notice, Public Hearing, and Public Comment, for the New Jersey Early Intervention System.
N.J.A.C. 8:17-19, would establish standards by which the Department would issue public notice of, announce and conduct a public hearing on, and provide opportunity for public comment on a proposed policy, procedure, or rule implementation of change to the New Jersey Early Intervention System to comply with Part C of the Individuals with Disabilities Education Act. The new rule would also establish a procedure by which the Department would announce the availability of its applications for Part C funds, and accept public comment thereon, in accordance with Part C.
The Notice of Proposal appears in the August 4, 2025, issue of the New Jersey Register. The Department will convene a public hearing on the proposed new rules on Tuesday, September 9, 2025, from 3:00 P.M. to 5:00 P.M., at the Judith M. Persichilli Building, New Jersey Department of Health, 55 North Willow Street, 1st Floor Conference Room, Trenton, NJ. The Department will provide public, web-based remote access to observe and participate in the hearing.

The Department requests that persons who want to be placed on the list of speakers or require accommodation to attend the hearing notify the Department at least five days before the hearing by telephoning (609) 913-5490. Persons who wish to participate remotely by web-based access may do so by telephoning the Department in advance of the hearing date to request the online login information for the web-based meeting platform. The Department requests that speakers provide a written copy of their remarks to the hearing officer at the hearing, if convenient.
Persons wishing to submit written comments on the proposal must submit the comments either electronically by October 3, 2025, to www.nj.gov/health/legal/ecomments.shtml, or by regular mail postmarked by October 3, 2025, to Kimberly E.
