Guidelines for Amending BDA

The sites in a Brownfield Development Area can be amended once a year, between January 1 and March 31, as part of the renewal of the Memorandum of Understanding between the Steering Committee and the DEP.  Adding or removing sites is not guaranteed.  All requests will be evaluated by DEP after the submission of the following:

  1. A letter from the city and the Steering Committee  requesting the specific additions or deletion of sites from a BDA;
  2. A revised BDA map identifying the new sites (or removal of sites) ;
  3. An summary of why the addition or removal of sites is critical to the BDA;
  4. An summary of why the sites were not originally included; and
  5. A BDA Baseline Datasheet for each new site.

After evaluation of the information above, DEP will make a determination regarding your BDA modification request.
