Underground Storage Tanks (UST) 1998 Tank Upgrade Requirements

Heating Oil Conditional Extension

Recently enacted legislation, P.L. 1998, c.59, allows owners and operators of regulated underground storage tank systems with a capacity of over 2000 gallons used to store heating oil for on site consumption to take advantage of a conditional five-year extension to the December 22, 1998 deadline by entering into a contract to have the system integrity tested prior to August 31, 1999. The contract to test the USTs must be submitted by December 22, 1998. Results of the integrity tests must be submitted to the Department within 15 days of testing. The law also provides an extension until August 31, 1999 for applicable heating oil owners and operators to apply to the Petroleum Underground Storage Tank Remediation, Upgrade and Closure Fund.
