[EXTERNAL]: Prioritized Initial Remedial Action Permit (RAP) Application Addendum available

The New Jersey Department of Environmental Protection (Department) posted a Prioritized Initial Remedial Action Permit (RAP) Application Addendum form. This form will be used to prioritize the review of certain RAP Applications based on the implemented remedial action. The Initial RAP Application Types include:

  • Prioritized RAP Type 1: An Initial Soil RAP Application where the restricted use soil remedial action does not include an engineering control. Specifically, all contamination remaining in soil and all upland sediment sample locations within the restricted area are below the applicable Non-Residential Soil Remediation Standards and below the applicable Soil Remediation Standards for the Migration to Ground Water Exposure Pathway.
  • Prioritized RAP Type 2: An Initial Soil RAP Application where a presumptive remedy listed in Table 5-1 of N.J.A.C. 7:26E-5.3 is used, but is not required. Specifically, the site is not a school, child care center, or residence but is using a Presumptive Remedy.
  • Prioritized RAP Type 3: An Initial Soil RAP Application where an alternative remedy pursuant to N.J.A.C. 7:26E-5.3 has been pre-approved by the Department. A copy of the Department's pre-approval letter/correspondence should be provided with this submission.
  • Prioritized RAP Type 4: An Initial Soil RAP Application where historic fill is the only area of concern being addressed by the RAP Application. Prior to submitting the RAP Application it is necessary that either: (1) a PA/SI was conducted that indicates that all of the areas of concern at the site have or will be addressed with a final remediation document; or (2) sampling that was conducted for the historic fill AOC has been submitted to the Department.
  • Prioritized RAP Type 5: An Initial Ground Water RAP Application for Monitored Natural Attenuation (MNA) where the extent of the Classification Exception Area (CEA) is limited to the property boundaries and no receptors are impacted.

The Prioritized Initial RAP Application Addendum should be completed if a site meets the requirements/conditions noted above. For sites that have already submitted an Initial Soil or Ground Water RAP Application, complete and submit this addendum to csrr_brap_submissions@dep.nj.gov. For sites that have not submitted an Initial Soil or Ground Water RAP Application yet, complete and include this addendum with the RAP Application that is submitted to the Department. Please be advised that the Department will not accept any variances to these Prioritized RAP requirements/conditions.
