Alert: Public Notification and Outreach Compliance Deadline is September 2, 2009
On September 2, 2008, the Department of Environmental Protection (DEP) adopted rules requiring those responsible for cleanups of contaminated sites to post signs or distribute notification letters informing local residents of work progress. For sites already undergoing cleanup, these rules require notification to take place within one year of the effective date.
As the September 2, 2009 deadline approaches, please keep in mind the following:
- Contact information must be listed in all forms of notification and must include contact information for the person responsible for conducting the remediation and for the Department’s Office of Community Relations at (609) 984-3081 or 1-800-253-5647. Please do not include the DEP staff or case manager’s name or telephone number on notification signs or in notification letters.
- For sites where the remedial investigation or single-phase remediation was initiated prior to September 2, 2008, documentation of compliance must be submitted to the Department no later than September 16, 2009.
- Publication of the fact sheet as a display advertisement in a daily or weekly newspaper of general circulation in the vicinity of the site, as required pursuant to N.J.A.C. 7:26(k), must be completed no later than the week of September 2, 2009. Documentation can consist of a tear sheet or receipt from the newspaper and must be submitted to the Department no later than September 16, 2009.
- Please be sure to include the Preferred Identification Number or the number provided by the Department's hotline on all public notification submittals.
