Subject | [SRRA] Critical Update - SRP proposed rule changes/Compliance Advisory |
The Department has proposed amendments to the Administrative Requirements for the Remediation of Contaminated Sites (ARRCS) rules at N.J.A.C. 7:26C and the Technical Requirements for Site Remediation rules (Technical Regulations) at N.J.A.C. 7:26E that amends certain mandatory timeframes and regulatory timeframes. The proposal also amends the trigger for what constitutes a vapor intrusion immediate environmental concern in the Technical Regulations and creates a new class of cases that will be called "vapor concern" cases. The proposal can be found on DEP's Web site at https://www.nj.gov/dep/rules/proposals/100410a.pdf . The Department has also issued a Compliance Advisory which provides critical information and updates relating to these proposed rule changes. https://www.nj.gov/dep/enforcement/advisories/2010-12.pdf The Compliance Advisory applies to all persons who are responsible for conducting remediation in New Jersey, regardless of when remediation was initiated or whether a licensed site remediation professional has been retained.
