[SRRA]: DEP Launches Initiative to Help Communities Combat "Dirty Dirt" and Prevent Illegal Dumping of Fill Material

The New Jersey Department of Environmental Protection (DEP) has created a web page "Guard Your Backyard," available at http://guardyourbackyard.nj.gov.

This web page is designed to help municipalities better manage the importation of fill material used for development and construction projects, landscape projects,or on private residential and commercial properties. The web page also includes a model ordinance that can be used to regulate the importation of fill material into a municipality for those purposes.

This web page and the model ordinance do not apply to site remediation sites (i.e., sites that are known to be contaminated). The use of fill material, whether clean or contaminated, at known contaminated sites is regulated by the Administrative Requirements for the Remediation of Contaminated Sites (ARRCS, N.J.A.C. 7:26C), the Technical Requirements for Site Remediation (Technical Requirements, N.J.A.C. 7:26E), and applicable Site Remediation technical guidance (e.g., "Fill Material Guidance for SRP Sites"). The model ordinance specifically states that it does not apply to soil/fill imported (a) for the purposes of remediation of a contaminated site, (b) for the operation and/or closure of sanitary landfills, or (c) to dredge repository sites.
