[EXTERNAL]: Updated Soil and Ground Water Remedial Action Protectiveness/Biennial Certification Forms and Instructions available

The New Jersey Department of Environmental Protection (NJDEP) has updated the Soil and Ground Water Remedial Action Protectiveness/Biennial Certification Forms and Instructions.

Based on discussions with the Remedial Action Permit (RAP) stakeholder group, the forms were revised to clearly indicate what information should be submitted and when a certain submittal is required (i.e., RAP Transfer/Change of Property Ownership Application, RAP Modification Application, RAP Termination Application). Insufficient information, missing information, and missed submittals are the most common deficiencies with Soil and Ground Water Remedial Action Protectiveness/Biennial Certification Forms. These updated forms and instructions streamline the review of the Remedial Action Protectiveness/Biennial Certification-related submittals to the NJDEP in an effort to reduce the total processing time.

Some important changes/additions for the Soil and Ground Water Remedial Action Protectiveness/Biennial Certification Forms include the following:

  • Completed forms can now be emailed to srp_submissions@dep.nj.gov (except for Post-NFA Cases).
  • No contact information needs to be provided for the Person Responsible for Conducting the Remediation and Property Owner in Sections D and E, respectively.
  • Removed the lessee and operator sections as current site use information is already captured in Section H (Site Use, Changes, and Disturbances).
  • Attached Documents Section - An administrative checklist of what is required to be submitted with the form.
  • Other Information Provided Section - Encourages the user to list any/all other pertinent information to support the form submission and the protectiveness of the remedial action (i.e., professional judgement justification, variances from rules/deviations from guidance, etc.).
  • New questions on the forms to be consistent with current guidance include the following important topics: Contaminants of Emerging Concern (CECs); Indeterminate Vapor Intrusion Pathway status; Vapor Intrusion Long Term Monitoring Plan; ground water flow direction; ground water contamination related to an off-site source; and annual statements confirming the value of the Financial Assurance instrument.
  • Website links for the tax databases that the NJDEP uses to verify the site address and block/lot, and current owner of the site.
  • Prompts to ensure that all outstanding RAP annual fees have been paid in full.
