[EXTERNAL]: Pre-Purchase Administrative Consent Order Administrative Guidance and related forms now available! The Contaminated Site Remediation & Redevelopment Program (CSRRP) has posted the Pre-Purchase Administrative Consent Order Administrative Guidance. This document explains how a prospective purchaser of a contaminated site can obtain a pre-purchase Administrative Consent Order (ACO). Pre-Purchase ACOs allows potential buyers of contaminated sites subject to direct oversight to obtain adjustments to certain direct oversight requirements, provided the potential buyer meets certain requirements set forth in statute and regulation. Without the benefits of a Pre-Purchase ACO, a potential buyer of a non-compliant site subject to direct oversight is in violation upon purchase and must strictly comply with all the direct oversight requirements set forth at the Administrative Requirements for the Remediation of Contaminated Sites N.J.A.C. 7:26C-14.2(b). In addition, CSRRP has also posted the Pre-Purchase Administrative Consent Order Form and Instructions. The forms and supporting instructions are available on the forms library: https://www.nj.gov/dep/srp/srra/forms/. Eligible potential buyers should send a letter requesting a Pre-Purchase ACO and the Pre-Purchase ACO Certification Form to the Bureau of Enforcement and Investigations Chief Ann Wolf at the address listed in the instructions of the form and via email: prepurchase.aco@dep.nj.gov. |
