LIEP Types (N.J.A.C. 6A:15-1.4)

In addition to full-time LIEPs, LEAs may implement instructional program alternatives (N.J.S.A. 18A:35-18). An LEA must request a waiver annually, to establish an instructional program alternative. An LEA must demonstrate that it would be impractical to provide eligible multilingual learners with a full-time bilingual program (See Waiver Process).

Instructional program alternatives are designed and implemented to meet the same goal as a full-time LIEP, to prepare students with the knowledge and skills to succeed in a global society. This goal is achieved by supporting multilingual learners to develop their ELP, while learning the knowledge and skills to master the NJSLS.

The types of instructional program alternatives in NJ are:

  • English language services
  • English as a second language (ESL) program
  • High-intensity ESL
  • Sheltered English Instruction
  • Bilingual tutorial program
  • Bilingual resource program
  • Bilingual part-time program

LEAs with less than 10 multilingual learners of any language can implement English language services.

LEAs with 10 to less than 20 multilingual learners of any language can implement an ESL program only.

LEAs with 20 or more multilingual learners in a single language can implement one or more of the remaining instructional program alternatives with an approved waiver.

Instructional program alternatives must be selected based on data which considers the instructional need, ELP level, cultural and linguistic capital, and social emotional status of the multilingual learner. LEAs may concurrently implement more than one LIEP type. The various LIEP types are described in more detail.

 

LIEP alternative Description NJSLS ELD Standards Teacher Certification
English language services Instruction focused on building language skills through the ELD standards instead of content knowledge. The structured time should be linked to grade-level instructional material. Services may be given in one-on-one, small group, or inclusive whole class setting. Students receive grade-level content area instruction in English. Students do not receive one daily class period of ESL. Rather they receive a structured number of minutes weekly designed to improve reading, writing, speaking, and listening based on the ELD language domains. Language is taught through academic content instruction, and not for translation. Certified basic skills teacher or any instructional certificate and PD per N.J.A.C. 6A:15-1.7.
ESL Second-language acquisition taught through the WIDA ELD standards and based on the student’s ELP level during designated times to provide systematic, explicit, language-focused instruction. ESL is a required component of all LIEPs, except for English language services. (For additional information, see English as a Second Language Requirements). Same as above. Daily class period in duration as a content area class. 2020 WIDA K-12 ELD standards for the language of Science, Social Studies, English language arts, and Science in the language competencies of listening, speaking, reading, and writing. Language is taught through academic content instruction, and not for translation. Appropriately with ESL endorsement.
High-intensity ESL ESL is provided for two or more class periods each day in session. Same as above. Same as above. Same as above.
Sheltered English instruction Instruction is provided to multilingual learners in English by teachers who are trained in sheltered English instruction strategies and have received professional Students receive one period daily of push-in or pull-out ESL (For additional information, see English as a Second Language Requirements). Same as above. Same as above. Content area teacher with at least 15 hours of SEI training and a certified teacher with ESL endorsement. Certification requirements may be fulfilled by one or more teachers.
Bilingual tutorial Instruction is provided to multilingual learners primarily in English in all content areas, except one identified by the school. One period of instruction from a certified bilingual teacher in a content area required for graduation. A second period of tutoring in other required content areas by a bilingual certified teacher is provided in a 1-to-1 or small group setting to provide additional support in an area of need. Students receive one period daily of push-in or pull-out ESL (For additional information, see English as a Second Language Requirements). Students receive grade-level content area instruction in English. Except one content area required for graduation is selected to be provided in the primary language. Same as above. A teacher has the appropriate instructional certification for the selected content area to be delivered in the primary language and a bilingual/bicultural endorsement.
Bilingual resource Students receive instruction and resources that are individualized for each student, daily instruction from a certified bilingual teacher in academic content areas as identified by the LEA, as well as ESL instruction. Students receive one period daily of push-in or pull-out ESL (For additional information, see English as a Second Language Requirements). Same as above. Same as above. Same as above.
Bilingual part-time Instruction is provided to multilingual learners in English and their primary language by content area course. Students receive one period daily of push-in or pull-out ESL (For additional information, see English as a Second Language Requirements). Same as above. Except, English language arts and mathematics is provided in the primary language. Same as above ELA + Math content teacher has a bilingual/bicultural endorsement.

Identification of students as multilingual learners is required in all preschools which are state approved under Chapter 13A.

Multilingual learners who are identified in preschool must receive English language development support, while also supporting the development of their primary language. ESL is not a requirement for preschool age multilingual learners.

A program that meets the NJ Preschool Teaching and Learning Standards of Quality and is approved pursuant to N.J.A.C. 6A:13A will be considered a preschool LIEP. Teachers do not have to be certified with a bilingual/bicultural or ESL endorsement.  All teachers shall be trained on instructional adaptational strategies (N.J.A.C. 6A:8-3.1) and the WIDA Early Language Development Standards.
