Notice of Adjudicatory Hearing & Additional Written Comment Period

April 15, 2020 Adjudicatory Hearing (Postponed)

The Delaware River Basin Commission will hold an adjudicatory hearing (a trial-like proceeding) commencing April 15, 2020, on Docket D-2017-009-2, issued by the Commission on June 12, 2019, to Delaware River Partners, LLC for the project known as Gibbstown Logistics Center Dock 2. John D. Kelly, a hearing examiner with the Pennsylvania Department of State, will serve as Hearing Officer.

Hearing Location: The hearing will take place at the State of New Jersey Office of Administrative Law, Quakerbridge Plaza Building 9, Mercerville (Hamilton), NJ 08619, Hearing Room 1.

Hearing Dates: April 15, 2020 and successive business days through completion.

Hearing Start Time: The hearing on April 15, 2020 will run from 9 a.m. until no later than 4 p.m. The schedule on each successive hearing day is at the discretion of the Hearing Officer and may vary. During the hearing, please check this page daily after 4 p.m. for updates.

Seating: The hearing is open to the public. Approximately 40 seats will be available on a first-come, first-served basis. The building opens at 8 a.m. and all visitors must pass through security screening, operated by the State of New Jersey Office of Administrative Law, upon entering.

Hearing Procedure

The adjudicatory hearing will be conducted pursuant to Article 6 (Subpart F) of the Rules of Practice and Procedure – Sections 2.6.1 through 2.6.10 (18 CFR 401.71 – 401.90).

Accordingly, participants are limited to those interested parties who have been identified pursuant to Section 2.6.4(a) (18 CFR 401.84(a)), consisting of:

  • Docket holder Delaware River Partners, LLC;
  • Objectors The Delaware Riverkeeper and The Delaware Riverkeeper Network; and
  • Members of the Commission staff.

Members of the public will not be afforded an opportunity to speak during the hearing.

Written Comments

Additional written comments on Docket D-2017-009-2 for the Gibbstown Logistics Center Dock 2 will be accepted through April 24, 2020. Written comments may be submitted through the Commission’s web-based comment system: http://hearing.drbc.commentinput.com/

Supplementary Information

The Commission on June 6, 2019 held a duly noticed public hearing on a draft of Docket D-2017-009-2 for the Gibbstown Logistics Center Dock 2. The Commission accepted written comment on the draft docket through 5 p.m. on June 7, 2019. Pursuant to Section 3.8 of the Delaware River Basin Compact, Pub.L. 87-328, 75 Stat. 688, the Commission by unanimous vote at its regularly scheduled quarterly business meeting on June 12, 2019 approved the final docket, incorporating changes made in response to comments received on the draft.

In accordance with Article 6 (Subpart F) of the Commission’s Rules of Practice and Procedure, The Delaware Riverkeeper and The Delaware Riverkeeper Network (collectively, "DRN") by letter dated July 11, 2019 requested an adjudicatory hearing on the docket approval, and during its business meeting of September 11, 2019, the Commission granted DRN’s request.
