    A regular meeting of the Civil Service Commission was held on Wednesday, March 29, 2023, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Allison Chris Myers, Acting Chairperson; Members Dolores Gorczyca, and Daniel O’Mullan; Levi Klinger Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 23, 2022, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

ACTION:     The Civil Service Commission adopted the minutes of its meeting of March 15, 2023.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Ranaldo Gonzalez, Police Lieutenant, Hoboken, Department of Public Safety, suspension.

 

ACTION:     The Civil Service Commission noted the withdrawal of appeals without prejudice.

ACTION:     The Civil Service Commission acknowledged the settlement.

 

A-2    JEFFREY BENTON – CSC DOCKET NO. 2018-3183

 

Jeffrey Benton, Senior Correctional Police Officer, East Jersey State Prison, Department of Corrections, removal, effective April 12, 2018, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge Reverse the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    ARMINDA MEDINA – CSC DOCKET NO. 2016-3718

 

Arminda Medina, Judiciary Clerk 3, Judiciary, Union Vicinage, removal, effective January 25, 2016, on charges of inability to perform duties.    

 

Recommendation of the Administrative Law Judge – Grant the appointing authority’s motion for summary decision and uphold the removal.     

 

ACTION:     The Civil Service Commission held this matter over.

 

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    B.B. – CSC DOCKET NO. 2022-1509

         

B.B., represented by Michael L. Prigoff, Esq., appeals his rejection as a Police Officer candidate by Jersey City and its request to remove his name from the eligible list for Police Officer (S9999A) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    VIOLET BELL – CSC DOCKET NO. 2023-1420

         

Violet Bell appeals the removal of her name from the eligible list for Family Service Specialist 1 (PS5386K), Department of Children and Families, on the basis that she failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    KENNETH GRANGER – CSC DOCKET NO. 2023-773

         

Kenneth Granger appeals the removal of his name from the eligible list for Sheriff’s Officer (S9999A), Atlantic County Sheriff’s Office, on the basis that he failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-4    MARIA MCALLISTER – CSC DOCKET NO. 2023-1124

         

Maria McAllister appeals the removal of her name from the eligible list for Family Service Specialist 1 (PS5386K), Department of Children and Families, on the basis that she failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-5    ROBERT MCGURK – CSC DOCKET NO. 2023-1543

 

Robert McGurk appeals the decision of the Division of Agency Services which found that, per the substitution clause for education, he did not meet the experience requirements for the promotional examination for Technician, Management Information Systems (PS8056I), Department of Corrections.

 

ACTION:     The Civil Service Commission directed that this appeal be denied, and the matter of the appellant’s position classification be referred to Agency Services for review.

 

B-6    ELIZABETH SANTOS – CSC DOCKET NO. 2023-903

         

Elizabeth Santos appeals the denial of her request for a make-up examination for Police Sergeant, Palisades Interstate Park (PS9221V), Palisades Interstate Park Commission.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    ANDREYA SMITH – CSC DOCKET NO. 2023-204

         

Andreya Smith requests a make-up of the open competitive examination for Sheriff’s Officer (C0222D), Mercer County.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-8    LEKISHA BONDURANT – CSC DOCKET NO. 2022-2113

         

Lekisha Bondurant, represented by Valerie Palma DeLuisi, Esq., appeals the determination of the Division of Agency Services which found that she was below the minimum requirements in experience for the qualifying examination for Assistant Director, Property Improvement, East Orange.

 

ACTION:     The Civil Service Commission directed that this appeal be denied, and the matter of the appellant’s position classification be referred to Agency Services for review.

 

B-9    FRANK SERMARINI – CSC DOCKET NO. 2023-1414

         

Frank Sermarini appeals the determination of the Division of the Agency Services which found that he was below the minimum requirements in experience for a qualifying examination for Administrative Analyst 3, Information Systems, Department of Labor and Workforce Development.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-10   MINA EKLADIOUS – CSC DOCKET NO. 2023-922

         

Jersey City, represented by Arthur R. Thibault, Jr., Esq. and Kyle J. Trent, Esq., requests reconsideration of In the Matter of Mina Ekladious (CSC, decided September 21, 2022).  In the alternative, Jersey City requests that this matter be stayed pending an appeal to the Appellate Division.

 

ACTION:     The Civil Service Commission directed that these requests be denied.

 

B-11   SIMONNE ALI – CSC DOCKET NO. 2023-1684

         

Plainfield, represented by Edward J. Kologi, Esq., and Michael S. Simitz, Esq., requests a stay of the Civil Service Commission decision in In the Matter of Simonne Ali (CSC, decided December 7, 2022), pending its appeal to the Appellate Division.

 

ACTION:     The Civil Service Commission directed that this request be denied

 

B-12   GEORGE MEADOWS – CSC DOCKET NOS. 2023-1247 AND 2023-1530

         

George Meadows, Principal Planner, Paterson, Department of Economic Development, represented by Seth Gollin, Staff Attorney, AFSCME New Jersey Council 63, requests enforcement of In the Matter of George Meadows (CSC, decided September 21, 2022).  Paterson, represented by Nicole M. DeMuro, Esq., requests a stay pending its appeal to the Appellate Division.

 

ACTION:     The Civil Service Commission directed that the request for enforcement be granted in part and the request for a stay be denied.

 

B-13   VOCATIONAL REHABILITATION COUNSELOR 2 – CSC DOCKET NO. 2023-1450

         

The Commission for the Blind and Visually Impaired, Department of Human Services, requests permission not to make an appointment from the June 6, 2022 certification for Vocational Rehabilitation Counselor 2 (S0404D).

 

ACTION:     The Civil Service Commission granted the appointment waiver and deferred selection costs.

 

B-14   CERTIFIED NURSE’S AIDE AND SENIOR CERTIFIED NURSE’S AIDE – CSC DOCKET NOS. 2023-1907 AND 2023-1908

         

The Division of Agency Services requests the establishment of the noncompetitive title of Certified Nurse’s Aide; the establishment of the competitive title of Senior Certified Nurse’s Aide; and the inactivation of the titles of Quality Assurance Specialist, Health Services and Assistant Hospital Maintenance Supervisor.

 

ACTION:     The Civil Service Commission directed that these requests be granted.
