A regular meeting of the Civil Service Commission was held on Wednesday, June 7, 2023, at 10:00 a.m., in Trenton, New Jersey.

PRESENT: Allison Chris Myers, Acting Chairperson; Members Dolores Gorczyca, Daniel O’Mullan, and Diomedes Tsitouras; Levi Klinger-Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 23, 2022, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified.

CIVIL SERVICE COMMISSION MINUTES

Submitted for adoption are the Civil Service Commission minutes of its meeting of May 24, 2023.

ACTION:     The Civil Service Commission adopted the minutes of its meeting of May 24, 2023.

WITHDRAWAL OF APPEALS

The following appeals were withdrawn and removed from the hearing calendar:

Carlos Colon, Custodial Worker, Newark School District, removal.

Ramona Nixon, Teacher Aide, Handicapped Program, Jersey City School District, removal.

ACTION:     The Civil Service Commission noted the withdrawal of appeal without prejudice.

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    SHAMIL DAVIS – CSC DOCKET NO. 2022-545

Shamil Davis, Senior Correctional Police Officer, William H. Fauver Youth Correctional Facility, Department of Corrections, removal, effective August 27, 2021, on charges conduct unbecoming a public employee and other sufficient cause.    

Recommendation of the Administrative Law Judge – Uphold the removal.       

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.       

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    J.D. – CSC DOCKET NO. 2021-1335

         

J.D. appeals the request by the Department of Corrections to remove his name from the Correctional Police Officer (S9988A) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-2    MICHAEL ANDREWS – CSC DOCKET NO. 2023-1273

         

Michael Andrews appeals the removal of his name from the eligible list for Family Service Specialist 1 (PS5386K), Department of Children and Families on the basis that he failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

  

B-3    EMIL IMBRIANO – CSC DOCKET NO. 2023-808

         

Emil Imbriano, represented by Michael L. Prigoff, Esq., appeals the decision to remove his name from the Fire Fighter (M1855W), New Brunswick eligible list on the basis of falsification of his application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    KIYANA WILLIAMS – CSC DOCKET NO. 2023-1510

         

Kiyana Williams appeals the removal of her name from the eligible list for Human Services Specialist 1 (C0542A), Mercer County Board of Social Services on the basis that she failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-5    YVONNE ZIRRITH – CSC DOCKET NO. 2023-1734

         

Yvonne Zirrith, represented by Daniel J. Zirrith, Esq., appeals the bypass of her name on the Sheriff’s Officer Lieutenant (PC1557A), Middlesex County Sheriff’s Office eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    PRECIOUS BONAPARTE-HUNT – CSC DOCKET NO. 2023-2001

         

Precious Bonaparte-Hunt appeals her score on the Human Services Specialist 4 (PC5164D), Hudson County promotional examination.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    A.M. – CSC DOCKET NO. 2022-2055

         

A.M., a Registered Environmental Health Specialist, Public Health with Plainfield, requests vacation leave entitlement based on her years of service.

 

ACTION:     The Civil Service Commission directed that this request be granted in part.

 

B-8    LORENZO THOMPSON – CSC DOCKET NO. 2023-1603

         

Lorenzo Thompson, a former Laborer 1 with Hillside, requests enforcement of the Civil Service Commission decision rendered on June 15, 2022 granting him mitigated back pay, benefits and seniority. 

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-9    PLAINFIELD MUNICIPAL UTILITIES AUTHORITY – CSC DOCKET NO. 2023-2161

         

Plainfield requests that the former employees of the Plainfield Municipal Utilities Authority be recorded as permanent employees with Plainfield, effective July 1, 2022.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-10   RESEARCH DATA TITLE SERIES – CSC DOCKET NO. 2023-2565

         

The Division of Agency Services, on behalf of the Department of Law and Public Safety, requests the establishment of the Research Data title series in the competitive division of the career service and the reallocation of the title series to the noncompetitive division of the career service on an interim basis to facilitate the initial hiring of staff.  It also requests to inactivate various titles.

 

ACTION:     The Civil Service Commission directed that these requests be granted.

 

B-11   MODEL TELEWORK PILOT PROGRAM– CSC DOCKET NO. 2023-2575

         

The Acting Chairperson of the Civil Service Commission (Commission) recommends extending the Model Telework Pilot Program established by the Commission at its meeting on April 6, 2022.

 

ACTION:     The Civil Service Commission directed that this recommendation be granted.
