    A regular meeting of the Civil Service Commission was held on Wednesday, September 4, 2024, at 10:00 a.m., in Trenton, New Jersey.

 

    PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca; Daniel O’Mullan, Diomedes Tsitouras and Christina Mongon; Levi Klinger Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

     In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2023, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of August 14, 2024.

 

ACTION:     The Civil Service Commission adopted the minutes of its meeting of August 14, 2024.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Nabila Abdul-Warith, Judiciary Clerk 3, Judiciary, Mercer Vicinage, suspensions (2).

 

Joseph Baldwin, Senior Medical Security Officer, Ann Klein Forensic Center, Department of Health, removal.

 

Rashiem Barnes, Police Officer, Newark, Police Department, removal.

 

Marquay Cherry, Police Officer, Atlantic City, Police Department, removal.

ACTION:     The Civil Service Commission noted the withdrawal of appeals without prejudice.

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

ACTION:     The Civil Service Commission noted the dismissal of appeals without prejudice.

            ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    CALVIN ENGIME – CSC DOCKET NO. 2022-1472

 

Calvin Engime, Judiciary Clerk 3, Judiciary, Mercer Vicinage, removal, effective December 18, 2021, on charges of insubordination, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    SALVATORE SPILLETTI – CSC DOCKET NO. 2023-2657

         

Salvatore Spilletti, County Correctional Police Officer, Hudson County, Department of Corrections, 90 working day suspension, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law JudgeGrant the appellant’s motion for summary decision and reverse the 90 working day suspension.

 

ACTION:     The Civil Service Commission held this matter for further review.

 

A-4    GREGORY WILLIAMS – CSC DOCKET NOS. 2019-1386 AND 2019-1923 (Consolidated)

 

Gregory Williams, Senior Correctional Police Officer, South Woods State Prison, Department of Corrections, 15 and 60 working day suspensions on charges of other sufficient cause and violating several departmental regulations. 

 

Recommendation of the Administrative Law Judge – Uphold the 15 working day suspension and modify the 60 working day suspension to a 15 working day suspension.   

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge to uphold the 15 working day suspension. However, the Commission modified the recommendation to modify the 60 working day suspension to a 15 working day suspension and imposed a 30 working day suspension.   

 

A-5    TALAYA WOODS AND SHAUNA INGRAM – CSC DOCKET NOS. 2018-3116 AND 2018-3226 (Consolidated)

 

Talaya Woods and Shauna Ingram, Public Safety Telecommunicators, Trenton, Police Department, removals, effective April 10, 2018, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removals. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    RANIQUE WOODSON – CSC DOCKET NO. 2024-832

 

Ranique Woodson, Clerk 1, Newark, Mayor’s Department, removal, effective August 10, 2022, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Grant the appointing authority’s motion for summary decision and modify the removal to a six-month suspension. 

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge to grant the motion for summary decision. However, the Commission modified the recommendation to modify the removal to a six-month suspension and imposed a 60 working day suspension.    

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    C.A. – CSC DOCKET NO. 2024-597

 

            C.A., represented by Stephen B. Hunter, Esq., appeals his rejection as a Police Officer candidate by Long Branch and its request to remove his name from the eligible list for Police Officer (M0082D) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    H.H. – CSC DOCKET NO. 2024-1450

 

            H.H. appeals his rejection as a Sheriff’s Officer candidate by the Hudson County Sheriff’s Office and its request to remove his name from the eligible list for Sheriff’s Officer (C0220D) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.         

 

B-3    AAMIR ALI – CSC DOCKET NO. 2024-1914

 

            Aamir Ali appeals the removal of his name from the eligible list for Fire Fighter (M2211D), Camden, on the basis that he resided outside of the residency scope.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

  

B-4    ANTHONY CARAMIELLO – CSC DOCKET NO. 2024-2544

 

            Anthony Caramiello, represented by Jacqueline M. Vigilante, Esq., appeals the decision to remove his name from the Police Sergeant (PM4553C), Gloucester Township eligible list on the basis of an unsatisfactory employment record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    TRACEY GREENE – CSC DOCKET NO. 2024-1314

 

            Tracey Greene appeals the determination of the Division of Agency Services  which found that she did not meet the requirements for Records Technician 3 MVC (PS2675T), Motor Vehicle Commission.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    JOHN PACUTA, III – CSC DOCKET NO. 2024-2040

 

            John Pacuta, III appeals the determination of the Division of Agency Services, which found that, per the substitution clause for education, he did not meet the experience requirement for the promotional examination for Administrative Analyst 3 (PS3897H), Department of Health.

 

ACTION:     The Civil Service Commission directed that this appeal be denied, and the matter of the appellant’s position classification be referred to Agency Services for review.

 

B-7    RAMESH PATEL – CSC DOCKET NO. 2024-327

 

            Ramesh Patel appeals the determination of the Division of Agency Services that he did not meet the education requirements for the promotional examination for Project Engineer, Maintenance (PS9607T), Department of Transportation.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    SHEQUELL RICHARDS – CSC DOCKET NO. 2022-1555

 

            Shequell Richards appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the open competitive examination for Behavior Support Technician (S0303C).

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    KAMIL WARRAICH – CSC DOCKET NO. 2024-2590

 

            Kamil Warraich, a Police Lieutenant with the Asbury Park Police Department, represented by Zinovia H. Stone, Esq., petitions the Civil Service Commission for interim relief regarding his immediate suspension without pay, effective May 24, 2024.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

B-10   CAROLYN WHITEHEAD – CSC DOCKET NOS. 2024-2129 AND 2024-2436

 

             East Orange, represented by Arthur L. Margeotes, Esq., petitions the Civil Service Commission (Commission) for a stay of its decision in In the Matter of Carolyn Whitehead (CSC, decided February 28, 2024) in which the Commission reversed the removal of Carolyn Whitehead.  Additionally, Whitehead petitions the Commission for enforcement.

 

ACTION:    The Civil Service Commission directed that the petition for a stay be denied and the petition for enforcement be granted.

 

B-11   WILLIAM BESNECKER – CSC DOCKET NO. 2025-227

 

            Seaside Park, represented by Brandon A. Klimakowski, Esq., requests the  transfer of William Besnecker from Pemberton Borough, a non-Civil Service jurisdiction, to the title of Police Officer, retroactive to September 29, 2023.

 

ACTION:     The Civil Service Commission directed that this request be granted in part.         

  

B-12   NICHOLAS CORNETT – CSC DOCKET NO. 2025-62

 

            Magnolia requests to transfer Nicholas Cornett, a Police Officer, from Hi-Nella Borough, a non-Civil Service jurisdiction, to the title of Police Officer in the Magnolia Police Department.

  

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-13   TECHNICAL ASSISTANT, MOTOR VEHICLE COMMISSION – CSC DOCKET NO. 2025-276

 

            The Division of Agency Services, on behalf of the Motor Vehicle Commission, requests the creation of the Technical Assistant, Motor Vehicle Commission title in the competitive division of the career service and the reallocation of the title to the noncompetitive division of the career service on an interim basis. 

  

ACTION:     The Civil Service Commission directed that this request be granted.
