    A regular meeting of the Civil Service Commission was held on Wednesday, October 16, 2024, at 10:00 a.m., in Trenton, New Jersey.

 

   PRESENT: Allison Chris Myers, Chairperson; Members Daniel O’Mullan, Diomedes Tsitouras and Christina Mongon; Levi Klinger Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

   In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

   Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2023, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

   All actions were by unanimous vote unless otherwise specified.

A-2    ZAIRE BAILEY – CSC DOCKET NO. 2024-956

 

Zaire Bailey, Supervising Juvenile Detention Officer, Middlesex County, Department of Adult Corrections, removal, effective May 6, 2023, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge Reverse the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    SAVON BRITTINGHAM – CSC DOCKET NO. 2023-977

         

Savon Brittingham, County Correctional Police Officer, Mercer County Correction Center, release at the end of the working test period, effective October 27, 2022. 

 

Recommendation of the Administrative Law JudgeReverse the release at the end of the working test period. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    JOSEPH FUSCO – CSC DOCKET NO. 2022-386

 

Joseph Fusco, Custodial Worker, Brick Township School District, removal, effective June 16, 2021, on charges of conduct unbecoming a public employer and other sufficient cause. 

 

Recommendation of the Administrative Law Judge – Uphold the removal.   

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    THOMASINA LLOYD – CSC DOCKET NO. 2023-846

 

Thomasina Lloyd, Social Worker, Ocean County, Board of Social Services, removal, effective September 19, 2022, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Dismiss the appeal for failure to appear. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    STEPHAN PITTS – CSC DOCKET NO. 2024-476

 

Stephan Pitts, Road Repairer 2, Camden County, Department of Public Works, 20 working day suspension, on charges of insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the 20 working day suspension. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-7    SALVATORE SPILLETTI – CSC DOCKET NO. 2023-2657

         

Salvatore Spilletti, County Correctional Police Officer, Hudson County, Department of Corrections, 90 working day suspension, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Grant the appellant’s motion for summary decision and reverse the 90 working day suspension.

 

ACTION:     The Civil Service Commission remanded the matter to the Office of Administrative Law.

B-1    ERIC MORRISON – CSC DOCKET NO. 2024-1933

 

            Eric Morrison, represented by Russell L. Lichtenstein, Esq. appeals the decision to remove his name from the Fire Fighter (M2201D), Atlantic City, eligible list on the basis of an unsatisfactory driving record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-2    EDWARD SPAHR – CSC DOCKET NO. 2024-2629

 

            Edward Spahr appeals the decision to remove his name from the State Park Police Officer Trainee (S0231D), Department of Environmental Protection, eligible list on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    MARY SPAHR – CSC DOCKET NO. 2024-2630

 

            Mary Spahr appeals the decision to remove her name from the State Park Police Officer Trainee (S0231D), Department of Environmental Protection, eligible list on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-4    VINCENT GRANESE – CSC DOCKET NO. 2023-2269

 

            Vincent Granese appeals his score on the oral portion of the promotional examination for Fire Lieutenant (PM2384C), Ventnor City.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-5    G.V. – CSC DOCKET NO. 2023-2386

 

            G.V. appeals his score on the oral portion of the promotional examination for Fire Captain (PM2353C), Wildwood.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-6    JUAN BARROSO – CSC DOCKET NO. 2025-374

 

            Juan Barroso, a Fire Official, UFD with Kearny, represented by Zinovia H. Stone, Esq., petitions the Civil Service Commission for interim relief regarding his immediate suspension.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-7    S.J. – CSC DOCKET NO. 2025-86

 

S.J., a Police Captain with Boonton, represented by Matthew A. Peluso, Esq., petitions the Civil Service Commission (Commission) for interim relief of his indefinite suspension.

 

ACTION:     The Civil Service Commission directed that this petition be granted in part.

 

B-8    MARK KIEFFER III – CSC DOCKET NO. 2025-251

 

Mark Kieffer III, a Police Officer with Trenton, represented by Stuart J. Alterman, Esq., petitions the Civil Service Commission for interim relief of his immediate suspension.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-9    S.A. – CSC DOCKET NO. 2024-1673

 

            S.A., an Operating Engineer Repairer with Northern State Prison, Department of Corrections, represented by Arnold Shep Cohen, Esq., requests back pay pursuant to In the Matter of S.A. (CSC, decided May 19, 2021).

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-10   BUILDING MANAGEMENT SERVICES SPECIALIST TRAINEECSC DOCKET NO. 2025-755

 

            The Division of Agency Services requests the establishment of the noncompetitive title of Building Management Services Specialist Trainee in accordance with N.J.A.C. 4A:3-1.2.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-11   COMPLIANCE OFFICER, MVC – CSC DOCKET NO. 2025-668

 

            The Division of Agency Services requests that certain incumbents in the Safety Specialist, MVC title series be cross walked to the Compliance Officer, MVC Commercial Bus Unit title series. 

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-12   FISCAL YEAR 2025 SALARY REGULATIONS COMPENSATION COMPENDIUM

 

The Fiscal Year 2025 Salary Regulations Compensation Compendium includes the following: Section 1 - Aligned Salary Regulation, Non-Aligned Salary Regulation, and Attachments A and B; Section 2 - Emergency Conditions Salary Regulation; Section 3 - Special Incentive Salary Regulation; Section 4 - Miscellaneous Salary Regulation.  The Compendium has been approved by Allison Chris Myers, Chair/Chief Executive Officer, Civil Service Commission, and Tariq Shabazz, Acting Director, Office of Management and Budget.

 

ACTION:     The Civil Service Commission recorded the regulations.
