    A regular meeting of the Civil Service Commission was held on Wednesday, November 27, 2024, at 10:00 a.m., in Trenton, New Jersey.

 

     PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca; Daniel O’Mullan, Diomedes Tsitouras and Christina Mongon; Levi Klinger Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

     In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2023, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

A-2    QUARRI ANDERSON – CSC DOCKET NO. 2024-1871

 

Quarri Anderson, Laborer 1, Hillside, Department of Public Works, 60 working day suspension, on charges of conduct unbecoming a public employee, insubordination and failure to perform duties.

 

Recommendation of the Administrative Law Judge Uphold the 60 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    JOSEPH MOONEY – CSC DOCKET NO. 2023-1090

         

Joseph Mooney, County Correctional Police Officer, Middlesex County, Department of Corrections, removal, effective November 4, 2022, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law JudgeUphold the removal. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    JOHN JOSEPH MULHOLLAND – CSC DOCKET NO. 2023-200

 

John Joseph Mulholland, Senior Public Works Repairer, Ringwood, Department of Public Works, removal, effective July 12, 2022, on charges of insubordination and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Reverse the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    MAIBIS PUENTE LEON – CSC DOCKET NO. 2024-1844

 

Maibis Puente Leon, Sheriff’s Officer, Essex County Sheriff’s Office, removal, effective January 2, 2024, on charges of inability to perform duties. 

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    DEBORAH RICHARDSON – CSC DOCKET NO. 2023-1668

 

Deborah Richardson, Site Manager, Nutrition Program, Mercer County, Department of Human Services, removal, effective January 17, 2023 on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-7    GREGORY RINDOSH – CSC DOCKET NO. 2023-201

 

Gregory Rindosh, Fiscal Analyst, Burlington County, Department of Human Services, release at the end of the working test period, effective July 1, 2022.

 

Recommendation of the Administrative Law Judge – Uphold the release at the end of the working test period.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-8    MARC RISPOLI – CSC DOCKET NO. 2025-64

 

Marc Rispoli, Police Officer, Bergenfield, Police Department, 10 working day suspension, on charges of violating departmental policy and procedures. 

 

Recommendation of the Administrative Law Judge – Dismiss the appeal for failure to appear. 

 

ACTION:     The Civil Service Commission remanded the matter to the Office of Administrative Law.

 

A-9    JOSEPH RUSK, III – CSC DOCKET NO. 2024-2293

Joseph Rusk, III, Police Officer, Lakewood, Police Department, removal, effective March 7, 2024, on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, conduct unbecoming a public employee, neglect of duties and other sufficient cause. 

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

  

SECTION B – MISCELLANEOUS MATTERS

 

B-1    D.G. AND D.P. – CSC DOCKET NOS. 2024-1727 AND 2024-1728

 

             D.G. and D.P., represented by Michael (Miguel) Garcia, Esq., appeal their rejection as Police Officer candidates by Union Township and its request to remove their names from the eligible list for Police Officer (M0156D) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that these appeals be dismissed.

 

B-2    JEANA ABUAN – CSC DOCKET NO. 2024-2297

 

             Jeana Abuan appeals the bypass of her name on the Assistant Business Administrator (PM4185D), Jersey City, eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    KIANA BOLDS – CSC DOCKET NO. 2024-1379

 

             Kiana Bolds appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the open-competitive examination for Clerk 3 (M0970E), Newark School District.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    ROBERT DODSON – CSC DOCKET NO. 2024-953

 

             Robert Dodson, a Police Captain, appeals his ineligibility for the promotional examination for Deputy Police Chief (PM4472F), Atlantic City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    JOSEPH DIMASSI – CSC DOCKET NO. 2024-2497

 

            Joseph DiMassi appeals the determination of the Division of Agency Services, which found that he was not eligible for the promotional examination for Assistant Public Works Superintendent (PM2045F), Lopatcong because he was not employed in the announced department.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-6    JESSICA MOTATEY – CSC DOCKET NO. 2025-717

 

            Jessica Motatey appeals the determination of the Division of Agency Services, which found that she did not meet the experience requirement for the open competitive examination for Regulatory Officer 3 (S0920F).

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    SHARIF JENNINGS – CSC DOCKET NO. 2023-2286

 

             Sharif Jennings appeals his score on the oral portion of the promotional examination for Fire Captain (PM2341C), Orange.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    BRIAN LUIZZA – CSC DOCKET NO. 2023-2294

 

             Brian Luizza appeals his score on the oral portion of the promotional examination for Fire Lieutenant (PM2383C), Union.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

             Michael Martini appeals his score on the oral portion of the promotional examination for Fire Captain (PM2344C), Perth Amboy.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-10   PHILLIP MCMAHON – CSC DOCKET NO. 2023-2348

 

             Phillip McMahon appeals his score on the oral portion of the promotional examination for Fire Lieutenant (PM2385C), Vineland.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-11   JOHN PARISICK, JR. – CSC DOCKET NO. 2024-1181

 

             John Parisik, Jr. appeals his score on the oral portion of the promotional examination for Fire Captain (PM5026D), Hackensack.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

             Robert Schrump appeals his score on the oral portion of the promotional examination for Fire Lieutenant (PM2371C), Linden.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-13   JARNEL WILLIAMS – CSC DOCKET NO. 2023-2258

 

             Jarnel Williams appeals his score on the oral portion of the promotional examination for Fire Captain (PM2329C), Hillside.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

  

B-14   CURTIS YARBROUGH – CSC DOCKET NO. 2023-2591

 

             Curtis Yarbrough appeals his score on the oral portion of the promotional examination for Fire Lieutenant (PM2375C), New Brunswick.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15   MICHELE-LYNNE MUNI AND SABRINA HAUGEBROOK – CSC DOCKET NOS. 2024-1163 AND 2024-1164

 

            Michele-Lynne Muni and Sabrina Haugebrook, represented by Sean Thom, CWA Local 1040, appeal their non-selections to the non-competitive title of Research Scientist 1. 

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-16   C.V. – CSC DOCKET NO. 2025-705

 

C.V., a Manager 1 Vocational Rehabilitation Services with the Department of Labor and Workforce Development, appeals the determination of a Chief of Staff, which was unable to substantiate that she was subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-17   IMMANUEL JONES – CSC DOCKET NO. 2024-2462

 

            Immanuel Jones, a Laborer 1 with Union Township, Department of Buildings and Grounds, represented by Michael A. Bukosky, Esq., requests back pay and counsel fees in accordance with In the Matter of Immanuel Jones, Township of Union, Department of Buildings and Grounds (CSC, decided April 10, 2024).

 

ACTION:     The Civil Service Commission awarded back pay in the amount of $946.19 and counsel fees in the amount of $20,565.

 

B-18   KEITH MARTINEZ – CSC DOCKET NO. 2024-582

 

            Keith Martinez, a County Correctional Police Officer with Hudson County, Department of Corrections, represented by Stuart J. Alterman, Esq., requests back pay and counsel fees in accordance with In the Matter of Keith Martinez, Hudson County, Department of Corrections (CSC, decided February 1, 2023).

 

ACTION:     The Civil Service Commission denied the request for back pay and awarded counsel fees in the amount of $11,860 and costs in the amount of $123.75.

 

B-19   CIVIL SERVICE COMMISSION MEETING DATES 2025

 

            The proposed 2025 Civil Service Commission meeting dates are submitted for approval.

 

ACTION:     The Civil Service Commission approved the 2025 Civil Service Commission meeting dates.
