A regular meeting of the Civil Service Commission was held on Wednesday, February 5, 2025, at 10:00 a.m., in Trenton, New Jersey.
PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca; Daniel O’Mullan, Diomedes Tsitouras and Christina Mongon; Levi Klinger-Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary. All individuals listed participated via teleconference.
In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 27, 2024, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.

WITHDRAWAL OF APPEALS
The following appeals were withdrawn and removed from the hearing calendar:

ACTION: The Civil Service Commission noted the withdrawal of appeals without prejudice.

Shanee Dawkins, Judiciary Clerk 3, Judiciary, Morris/Sussex Vicinage, release at the end of the working test period, effective July 2, 2024.
Recommendation of the Administrative Law Judge – Uphold the release at the end of the working test period.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-3 JUAN ESTRELLA – CSC DOCKET NO. 2024-65
Juan Estrella, Police Officer, Union City, Department of Public Safety, 10 working day suspension, on charges of inability to perform duties and other sufficient cause.
Recommendation of the Administrative Law Judge – Modify the 10 working day suspension to a six working day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-4 JORGE FLORES – CSC DOCKET NO. 2024-645
Jorge Flores, Sheriff’s Officer, Camden County, Sheriff’s Department, 30 working day suspension, on charges of conduct unbecoming a public employee, neglect of duty, misuse of public property and other sufficient cause.
Recommendation of the Administrative Law Judge – Uphold the 30 working day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5 MATTHEW RADECKY – CSC DOCKET NOS. 2024-1788 AND 2024-2104
Matthew Radecky, Police Sergeant, Pohatcong, Police Department, demotion, effective December 28, 2023, and removal, effective May 2, 2024, on charges of insubordination.
Recommendation of the Administrative Law Judge – Reverse the demotion and removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-6 JONATHAN RIVERA – CSC DOCKET NO. 2024-554
Jonathan Rivera, Police Officer, Union City, Department of Public Safety, 20 working day suspension, on charges of chronic or excessive absenteeism or lateness and other sufficient cause.
Recommendation of the Administrative Law Judge – Reverse the 20 working day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
SECTION B – MISCELLANEOUS MATTERS
B-1 MINERVA MARTINEZ – CSC DOCKET NOS. 2024-1744, ET AL.
Minerva Martinez appeals the determination of the Division of Agency Services which found that she was not permanent in a title to which the examination was open for Senior Investigator County Welfare Agency (PC4228E), Hudson County. She also appeals her eligibility for six additional promotional examinations announced by Hudson County.
ACTION: The Civil Service Commission directed that these appeals be denied.
B-2 FRANCES PEREZ – CSC DOCKET NOS. 2024-1751, ET AL.
Frances Perez appeals the determination of the Division of Agency Services which found that she was not permanent in a title to which the examination was open for Senior Investigator County Welfare Agency (PC4228E), Hudson County. She also appeals her eligibility for three additional promotional examinations announced by Hudson County.
ACTION: The Civil Service Commission directed that these appeals be denied.
B-3 NICHOLAS CZANDER – CSC DOCKET NO. 2024-1075
Nicholas Czander appeals his score on the oral portion of the promotional examination for Fire Captain (PM5027D), Harrison.
ACTION: The Civil Service Commission directed that this appeal be granted in part.
B-4 MATTHEW FERRELL – CSC DOCKET NO. 2024-1077
Matthew Ferrell appeals his score on the oral portion of the promotional examination for Fire Captain (PM5040D), Willingboro.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-5 ANGELINA TIRADO – CSC DOCKET NO. 2024-1142
Angelina Tirado appeals her score on the oral portion of the promotional examination for Fire Captain (PM5020D), Clifton.
ACTION: The Civil Service Commission directed that this appeal be granted in part.
B-6 RAYMOND TREMER, III – CSC DOCKET NO. 2024-1143
Raymond Tremer III appeals his score on the oral portion of the promotional examination for Fire Captain (PM5027D), Harrison.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-7 B.C. – CSC DOCKET NO. 2024-1722
B.C., Personnel Assistant 1 with the Motor Vehicle Commission, appeals the determination of the Director of the Division of EEO/AA at the Civil Service Commission, stating that it substantiated some of the appellant’s allegations that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission held this matter for further review.
B-8 ALEXANDRE GABLER – CSC DOCKET NOS. 2025-83 AND 2025-84
Alexandre Gabler requests reconsideration of the final administrative action in In the Matters of Alexandre Gabler, Librarian 3 (M0424E), Elizabeth Library (CSC, decided May 22, 2024).
ACTION: The Civil Service Commission directed that this request be denied.
B-9 JUAN MENDOZA – CSC DOCKET NOS. 2025-435 AND 2025-436
Juan Mendoza, a Sheriff’s Officer with Hudson County, represented by Michael L. Prigoff, Esq., requests reconsideration of In the Matter of Juan Mendoza (CSC, decided July 24, 2024).
ACTION: The Civil Service Commission directed that this request be denied.
B-10 ADAM AUSTINO – CSC DOCKET NO. 2024-2361
Adam Austino, a Police Captain with the Vineland Police Department, represented by Katherine D. Hartman Esq., petitions the Civil Service Commission to determine back pay, benefits and counsel fees in accordance with its decision rendered on March 20, 2024.
ACTION: The Civil Service Commission awarded gross back pay in the amount of $64,926 and counsel fees in the amount of $35,022.50.
B-11 SUZANNE RAGONE – CSC DOCKET NOS. 2025-733
Suzanne Ragone, a Quality Assurance Coordinator with the Division of Aging Services, Department of Human Services, requests to have her title from the period of September 2016 until February 2022 changed from Regional Staff Nurse Medical Assistance to Quality Assurance Specialist Health Services, with back pay, benefits, and adjustments to her pension.
ACTION: The Civil Service Commission directed that this request be denied.
B-12 KEVIN MCCLONE – CSC DOCKET NO. 2025-8
Kevin McClone appeals the decision of Stockton University to reassign him from Galloway to Atlantic City.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-13 REGIONAL STAFF NURSE, MEDICAL ASSISTANCE – CSC DOCKET NO. 2025-1385
The Division of Agency Services requests the reallocation of the Regional Staff Nurse, Medical Assistance title be to the noncompetitive division of the career service on an interim basis for a period of 12 months in accordance with N.J.A.C. 4A:3-1.2.
ACTION: The Civil Service Commission directed that this request be granted.
B-14 DISASTER RECOVERY AND MITIGATION DIVISION, DEPARTMENT OF COMMUNITY AFFAIRS – CSC DOCKET NO. 2025-607
The Department of Community Affairs requests that the Civil Service Commission extend the December 31, 2026, deadline established in In the Matter of Disaster Recovery and Mitigation Division, Department of Community Affairs (CSC, decided June 2, 2021) to make temporary unclassified appointments to various career service titles in the Disaster Recovery Mitigation Division.
ACTION: The Civil Service Commission directed that this request be granted.
