    A regular meeting of the Civil Service Commission was held on Wednesday, April 30, 2025, at 10:00 a.m., in Trenton, New Jersey.

 

     PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca; Daniel O’Mullan, Diomedes Tsitouras and Christina Mongon; Levi Klinger-Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

    In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 27, 2024, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

A-2    AKMAL AQUIL – CSC DOCKET NOS. 2024-334, ET AL. (Consolidated)

 

Akmal Aquil, Laborer 1, Newark, Department of Water and Sewer, 15, 20, 25 and 30 working day suspensions, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the 15 working day suspension, and modify the 20, 25 and 30 working day suspensions to 15 working day suspensions.   

 

ACTION:     The Civil Service Commission upheld the 15, 20, 25 and 30 working day suspensions.

 

A-3    NICOLO CALDAROLA – CSC DOCKET NO. 2024-1312

 

Nicolo Caldarola, Automotive Mechanic, Motor Vehicle Commission, removal, effective November 8, 2023, on charges of inability to perform duties, insubordination, conduct unbecoming a public employee and neglect of duty.

 

Recommendation of the Administrative Law Judge Uphold the removal.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-4    MICHAEL FLEURY – CSC DOCKET NO. 2024-1622

         

Michael Fleury, Maintenance Worker 1, Grounds, Millville, Department of Parks and Public Property, removal, effective November 13, 2023, on charges of incompetency, inefficiency or failure to perform duties, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law JudgeModify the removal to a six-month suspension. 

 

ACTION:     The Civil Service Commission upheld the removal.

 

A-5    MIGUEL HIDALGO – CSC DOCKET NO. 2024-2527   

 

Miguel Hidalgo, Sheriff’s Officer, Hudson County Sheriff’s Office, removal, effective May 2, 2024, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law JudgeUphold the removal. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    NADRELL MCMILLAN – CSC DOCKET NO. 2024-1326

         

Nadrell McMillan, Sanitation Worker, New Brunswick, Department of Public Works, removal, effective September 14, 2023, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Reverse the removal.   

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-7    ANGEL SOTO – CSC DOCKET NO. 2025-697

         

Angel Soto, Assistant Supervising Mechanic, Jersey City, Department of Public Works, 10 working day suspension, on charges of insubordination, conduct unbecoming a public employee, neglect of duty, misuse of public property and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Dismiss the appeal for lack of jurisdiction.  

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-8    FLETCHER STOKELY – CSC DOCKET NO. 2024-1308

         

Fletcher Stokely, Custodian, Newark School District, removal, effective September 5, 2023, on charges of insubordination, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Modify the removal to a six-month suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

SECTION B – MISCELLANEOUS MATTERS

 

B-1    K.H.-D. – CSC DOCKET NO. 2025-127

 

          K.H.-D., represented by Robert K. Chewning, Esq., appeals her rejection as a Parole Officer Recruit candidate by the State Parole Board and its request to remove her name from the eligible list for Parole Officer Recruit (S2403E).

 

          ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-2    K.H.-D. – CSC DOCKET NO. 2025-162

 

          K.H.-D., represented by Robert K. Chewning, Esq., appeals her rejection as a Police Officer candidate by Kearny and its request to remove her name from the eligible list for Police Officer (M2341E).

 

          ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    MARCO SANTANA – CSC DOCKET NO. 2025-541

 

Marco Santana appeals the decision of Millburn Township to remove his name from the eligible list for Police Officer (M2353E), Millburn.

 

          ACTION:     The Civil Service Commission directed that this appeal be granted.

 

 B-4    MARCHELLA DELUCA – CSC DOCKET NO. 2025-1664

                  

Marchella DeLuca appeals the determination of the Division of Agency Services that she was not eligible for the Assistant Personnel Officer (C1644F), Passaic County open competitive examination. 

 

          ACTION:     The Civil Service Commission directed that this appeal be denied and the matter of the proper classification of the appellant’s provisional position be referred to Agency Services.

 

B-5    GREGORY HORNE – CSC DOCKET NO. 2024-2555

                  

Gregory Horne appeals the determination of the Division of Agency Services  which found that he was not eligible for the promotional examination for Supervising Medical Security Officer (PS5107H), Ann Klein Forensic Hospital.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    JASON BROWN – CSC DOCKET NO. 2025-1484

 

          Jason Brown appeals his score on the oral portion of the promotional examination for Battalion Fire Chief (PM2230F), Winslow.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    DAVID GUADIANE – CSC DOCKET NO. 2025-1589

 

          David Guadiane appeals his score on the oral portion of the promotional examination for Battalion Fire Chief (PM2227F), Roselle.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    BETZAIDA PLAZA – CSC DOCKET NO. 2024-1537

 

          Betzaida Plaza appeals her score on the Vocational Rehabilitation Counselor 2 (PS0652N), Department of Labor and Workforce Development promotional examination.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

  

B-9    DARRYL WRIGHT – CSC DOCKET NO. 2024-635

 

          Darryl Wright appeals his score on the examination for Deputy Police Chief (PM2303E) East Orange. He also appeals the procedures utilized during the examination review process. 

 

            ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-10   S.R. – CSC DOCKET NO. 2025-1404

 

          S.R., a Quality Assurance Coordinator with the Division of Aging Services, Department of Human Services, appeals the determination of an Assistant Commissioner, which was unable to substantiate that she was subject to a violation under the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-11   PURCHASING ASSISTANT (M1057F), PASSAIC VALLEY WATER COMMISSION – CSC DOCKET NO. 2025-1335

 

The Passaic Valley Water Commission requests permission not to make an appointment from the October 1, 2024, certification for Purchasing Assistant (M1057F).

 

ACTION:     The Civil Service Commission directed that this request be granted and deferred selection costs.

 

B-12   ASSISTANT COORDINATOR OF NURSE EXAMINERS, VICTIMS OF SEXUAL ASSAULT PROGRAM – CSC DOCKET NO. 2025-2230

 

          The Division of Agency Services requests the establishment of the noncompetitive title of Assistant Coordinator of Nurse Examiners, Victims of Sexual Assault Program, for use in local government in accordance with N.J.A.C. 4A:3-1.2.

 

          ACTION:     The Civil Service Commission directed that this request be granted.

 

B-13   DEPARTMENT OF EDUCATION TITLES – CSC DOCKET NO. 2025-2128

 

          The Division of Agency Services requests that specified titles within the Department of Education be placed in the noncompetitive division of the career service on an interim basis.  Additionally, the New Jersey Governor’s Office of Employee Relations and the Communications Workers of America request certain vacation time allotment for the affected employees.

 

          ACTION:     The Civil Service Commission directed that these requests be granted.

 

B-14   EXECUTIVE DIRECTOR, PASSAIC VALLEY WATER COMMISSION – CSC DOCKET NO. 2025-2056

 

The Division of Agency Services requests the establishment of the unclassified title of Executive Director, Passaic Valley Water Commission.

 

          ACTION:     The Civil Service Commission directed that this request be granted.

 

B-15   PERSONNEL TRAINEE, EMPLOYEE RELATIONS – CSC DOCKET NO. 2025-2057

 

The Division of Agency Services requests the establishment of the noncompetitive title of Personnel Trainee, Employee Relations in accordance with N.J.A.C. 4A:3-1.2.

 

          ACTION:     The Civil Service Commission directed that this request be granted.
