    A regular meeting of the Civil Service Commission was held on Wednesday, May 21, 2025, at 10:00 a.m., in Trenton, New Jersey.

 

    PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca; Daniel O’Mullan, and Christina Mongon; Levi Klinger-Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

     In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 27, 2024, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of April 30, 2025.

 

ACTION:      The Civil Service Commission adopted the minutes of its meeting of April 30, 2025.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

James Bennett, Vineland School District, removal.

 

A.C., Hunterdon Developmental Center, Department of Human Services, discrimination appeal.

 

Deirdre Healey, Bayonne, Department of Public Works, removal.

 

Julia McDevitt, Gloucester County, Emergency Response Department, suspension.

 

Michael Williams, Stratford, Department of Administration and Finance, resignation in good standing.

 

ACTION:     The Civil Service Commission noted the withdrawal of appeals without prejudice.

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

Ryleigh Killion, Department of Human Services, release at the end of the working test period.

 

ACTION:     The Civil Service Commission noted the dismissal of appeals without prejudice.

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    DARRIN DEWITT – CSC DOCKET NO. 2023-2770

 

Darrin DeWitt, Police Captain, Hackensack, Police Department, 10 working day suspension, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the 10 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    SEAN HILL – CSC DOCKET NO. 2023-2180

 

Sean Hill, Tree Maintenance Worker 2, Bayonne, Department of Public Works, removal, effective December 13, 2022, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty, misuse or public property and other sufficient cause. 

 

Recommendation of the Administrative Law Judge Uphold the removal.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    JOHN MARCIANTE – CSC DOCKET NO. 2023-265

         

John Marciante, Police Officer, Pleasantville, Police Department, removal, effective July 22, 2022, on charges of conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law JudgeModify the removal to a six-month suspension and additional training. 

 

ACTION:     The Civil Service Commission upheld the removal.

 

A-5    MUHAMMAD SHOUKI – CSC DOCKET NO. 2017-2637       

 

Muhammad Shouki, Custodial Worker, Newark School District, 45 working day suspension, on charges of insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law JudgeUphold the 45 working day suspension. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    DAMIEN GUILLEN – CSC DOCKET NO. 2025-210

 

        Damien Guillen appeals the removal of his name from the eligible list for Police Officer (M2405E), Elizabeth.

 

          ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-2    JOHN THOMAS – CSC DOCKET NO. 2025-76

 

          John Thomas appeals the removal of his name from the eligible list for Supervising Account Clerk (M0629B), Newark School District.

 

          ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    DANIEL BIBAUD – CSC DOCKET NO. 2024-656

 

          Daniel Bibaud, represented by Dudley Burdge, Senior Staff Representative, Communication Workers of America, appeals the determination of the Division of Agency Services that he did not meet the requirements for the Network Administrator 2, OIT (PS2377U), Office of Information Technology promotional examination.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    KRISTA DEVERS – CSC DOCKET NO. 2025-1808

 

          Krista Devers appeals the determination of the Division of Agency Services that she did not meet the requirements for the Administrative Analyst 1 (PS8786L), Department of Banking and Insurance promotional examination.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied and the matter of the proper classification of the appellant’s provisional position be referred to Agency Services.

 

B-5    M.J. – CSC DOCKET NO. 2025-890

 

          M.J., a Customer Representative 2, Public Utilities with the Board of Public Utilities, appeals the determination of the Director, Division of Administration, which substantiated that she violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    V.L. – CSC DOCKET NO. 2025-1679

 

          V.L., a former Head Cottage Training Supervisor with the New Lisbon Developmental Center, Department of Human Services, appeals the determination of an Assistant Commissioner, which was unable to substantiate that she was subject to a violation under the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    CLASSIFICATION OFFICER, DEPARTMENT OF CORRECTIONS TITLES SERIES – CSC DOCKET NO. 2025-2396

 

          The Department of Corrections requests reconsideration of the effective date for adversely impacted incumbents regarding In the Matter of Classification Officer, DOC Title Series (CSC, decided April 9, 2025).

 

          ACTION:     The Civil Service Commission directed that this request be granted.

 

B-8    SUPERVISOR OF PROFESSIONAL RESIDENTIAL SERVICES (PS4037K), DEPARTMENT OF HUMAN SERVICES – CSC DOCKET NO. 2025-1541

 

          The Department of Human Services requests permission not to make an appointment from the August 23, 2024, certification for Supervisor of Professional Residential Services (PS4037K).

 

          ACTION:     The Civil Service Commission granted the appointment waiver and deferred selection costs.      

 

B-9    TY SCIBILIA – CSC DOCKET NO. 2025-2276

 

          Hammonton, represented by Stephen Barse, Esq., requests to intergovernmentally transfer Police Officer Ty Scibilia from the Pine Hill Police Department, a non-Civil Service jurisdiction, to the title of Police Officer, Hammonton.

 

          ACTION:     The Civil Service Commission directed that this request be granted.

 

B-10   ROBERT SPEER – CSC DOCKET NO. 2025-2199

 

          North Arlington requests to intergovernmentally transfer Sheriff’s Officer Robert Speer from the Somerset County Sheriff’s Office, a non-Civil Service jurisdiction, to the title of Police Officer, North Arlington.

 

          ACTION:     The Civil Service Commission directed that this request be granted.

 

 B-11   ARTIFICIAL INTELLIGENCE POLICY AND ETHICS SPECIALIST – CSC DOCKET NO. 2025-2397

 

        The Division of Agency Services requests the establishment of the noncompetitive title of Artificial Intelligence Policy and Ethics Specialist for use in the Office of Information Technology.

 

          ACTION:     The Civil Service Commission directed that this request be granted.
