    A regular meeting of the Civil Service Commission was held on Wednesday, November 5, 2025, at 10:00 a.m., in Trenton, New Jersey.

 

           PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca; Daniel W. O’Mullan, Diomedes Tsitouras, and Christina Mongon; Levi Klinger-Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos-Goff, Commission Secretary.  All individuals listed participated via teleconference.

 

      In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 27, 2024, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

A-2    MICHAEL BONNER – CSC DOCKET NO. 2025-1600

 

          Michael Bonner County Correctional Police Officer, Cumberland County,  Department of Corrections, 10 working day suspension, on charges of violation of departmental policy regarding personal conduct. 

 

          Recommendation of the Administrative Law Judge – Uphold the suspension.     

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    ALEXIS FERNANDEZ – CSC DOCKET NO. 2025-1455

 

Alexis Fernandez, Supervising Mechanic, Golf Facilities, Passaic County, Department of Parks and Recreation, removal, effective September 27, 2024, on charges of inability to perform duties, chronic or excessive absenteeism or lateness and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.     

 

ACTION:    The Civil Service Commission affirmed the recommendation of the   Administrative Law Judge.

 

A-4    QUANTARA ROSS – CSC DOCKET NO. 2022-3250

 

Quantara Ross, Communication Operator, Secured Facilities, Youth Justice Commission, removal, effective June 3, 2022, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.     

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1    E.A. – CSC DOCKET NO. 2025-1298

 

         E.A., represented by Michael L. Prigoff, Esq., appeals his rejection as a Sheriff’s Officer candidate by Essex County and its request to remove his name from the eligible list for Sheriff’s Officer (C0218D).

 

          ACTION:    The Civil Service Commission directed that this appeal be granted.

 

B-2    J.H. – CSC DOCKET NO. 2025-829

 

          J.H., represented by Michael L. Prigoff, Esq., appeals his rejection as a Fire Fighter candidate by Cape May and its request to remove his name from the eligible list for Fire Fighter (M2212D).

 

          ACTION:    The Civil Service Commission directed that this appeal be granted.

 

B-3    DANIEL FITZGERALD – CSC DOCKET NO. 2025-2445

 

          Daniel Fitzgerald, represented by Patrick P. Toscano, Jr., appeals the bypass of his name on the Police Chief (PM2068B), Seaside Park, eligible list.

 

          ACTION:    The Civil Service Commission directed that this appeal be denied.

 

B-4    JOSEPH MOONEY – CSC DOCKET NO. 2024-1982

 

          Joseph Mooney, represented by David R. Castellani, Esq., appeals the bypass of his name on the Fire Fighter (M2250D), Atlantic City eligible list.

 

          ACTION:    The Civil Service Commission directed that a hearing be granted. 

 

B-5    BRIA BOST, ET AL. – CSC DOCKET NOS. 2026-690, ET AL.

 

          Bria Bost, Shaaron Crossland, Filomeno Cuino, Vivian Harris, Reylan Malvern, and Deidra Samuel appeal the test administration of the Program Support Specialist 1 (PS6095K), 2 (PS7139K) and 3 (PS7567K), Assistance Programs, Department of Human Services, Division of Family Development promotional examinations.

 

          ACTION:    The Civil Service Commission directed that these appeals be denied.

 

B-6    LUIS GARCIA, ET AL. – CSC DOCKET NO. 2025-1849, ET AL.

 

          Luis Garcia, Carrie Scharpnick and William Shoemaker, II, appeal the March 1, 2025, test administration of the Police Sergeant promotional examination (various symbols).

 

          ACTION:    The Civil Service Commission directed that these appeals be dismissed.

 

B-7    CHRISTOPHER WESTON AND JOHN TOLERICO – CSC DOCKET NOS. 2025-2757 AND 2025-2699

 

         Christopher Weston (PC5114F), Bergen County; and John Tolerico (PC5121F), Passaic County; appeal the examination for Sheriff’s Officer Lieutenant (various jurisdictions).

 

          ACTION:    The Civil Service Commission directed that these appeals be denied.

 

B-8    C.C. – CSC DOCKET NO. 2026-359

 

          C.C., an Assistant Deputy Public Defender 2, Office of the Public Defender, appeals the determination of the Equal Employment Opportunity/Affirmative Action Officer, which found that the appellant had not been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

          ACTION:    The Civil Service Commission directed that this appeal be denied.

 

B-9    G.R. – CSC DOCKET NO. 2025-2818

 

          G.R., a Supervising Family Service Specialist 2 with the Department of Children and Families, appeals the determination of a Deputy Commissioner which found that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

          ACTION:    The Civil Service Commission directed that this appeal be denied.

 

B-10  JENNIFER AKTURK - CSC DOCKET NO. 2026-993

 

     Jennifer Akturk, a Correctional Police Sergeant with the Garden State Youth Correctional Facility, Department of Corrections, requests reconsideration of In the Matter of Jennifer Akturk (CSC, decided September 24, 2025), which denied her appeal of a five working day suspension.

 

          ACTION:   The Civil Service Commission directed that this request be denied.             

 

B-11  SUPERVISOR OF PATIENTS’ ACCOUNTS 1 (S1043A) - CSC DOCKET NO. 2025-466

 

          In In the Matters of Richard Oliva and Supervisor of Patients’ Accounts 1 (S1043A) (CSC, decided June 28, 2023), the Civil Service Commission (Commission) granted the request of Trenton Psychiatric Hospital for an appointment waiver for the August 30, 2021 and February 15, 2022 certifications and ordered that no selection costs would be assessed at that time since there was a possibility that the list could be utilized prior to its expiration.  However, the appointing authority did not utilize the subject eligible list and the matter of the assessment of costs is now before the Commission.

 

          ACTION:    The Civil Service Commission directed that no selections costs be assessed.      

 

B-12  JUDICIARY CLERK 3, AND ITS BILINGUAL VARIANTS – CSC DOCKET NO. 2026-1056

 

The Judiciary, via the Administrative Office of the Courts, requests to extend for an additional year the reallocation of the Judiciary Clerk 3 and Judiciary Clerk 3, Bilingual in Spanish and English titles to the noncompetitive division of the career service on an interim basis. 

 

          ACTION:    The Civil Service Commission directed that this request be granted.

  

B-13  GABRIELE SPALLACCI, ET AL. – CSC DOCKET NO. 2026-1023

 

          The Superior Court of New Jersey, Appellate Division, in In the Matter of Gabriele Spallacci, et al., Docket No. A-1777-23 (App. Div. August 22, 2025), reversed and remanded the determination of the Civil Service Commission in In the Matter of Gabriele Spallacci, et al. (CSC, decided January 17, 2024), which found that the elimination of the final 10 questions from the February 23, 2019, administration of the Police Sergeant examination was justified.

 

          ACTION:    The Civil Service Commission ordered that the February 23, 2019, administration of the Police Sergeant examination be invalidated for Newark and Paterson and that a new examination be administered.

 

B-14  PROPOSED RULE AMENDMENT: N.J.A.C. 4A:7-3.1

 

         Submitted for approval is a Notice of Proposal to amend N.J.A.C. 4A:7-3.1, New Jersey State Policy Prohibiting Discrimination in the Workplace.  The proposal specifically calls for amendment to N.J.A.C. 4A:7-3.1(j) to ensure consistency with the New Jersey Supreme Court’s decision, In the Matter of Viktoriya Usachenok v. Department of the Treasury, 257 N.J. 184 (2024).

 

          ACTION:    The Civil Service Commission approved the proposed rule amendments for public notice and comment.

 

B-15  JOINT ORDER ON CONSOLIDATION AND PREDOMINANT INTEREST – MATTHEW PISAENO v. UNION COUNTY, DEPARTMENT OF ENGINEERING, PUBLIC WORKS AND FACILITIES – CSC DOCKET NOS. 2024-1474 and 2025-2337

 

Administrative Law Judge William J. Courtney (ALJ) issued an Order of Consolidation and Predominant Interest in Matthew Pisaeno v. Union County, Department of Engineering, Public Works and Facilities, In the Matter of Union Council 8 and Matthew Pisaeno v. Union County and Matthew Pisaeno v. Union County.  Based on the ALJ’s Order, the Civil Service Commission and the Public Employment Relations Commission developed a Joint Order. 

 

          ACTION:     The Civil Service Commission adopted the joint order.

 

B-16  CIVIL SERVICE COMMISSION MEETING DATES FOR 2026

 

          The proposed 2026 Civil Service Commission meeting dates are submitted for approval.

 

          ACTION:    The Civil Service Commission adopted the 2026 meeting dates.
