    A regular meeting of the Civil Service Commission was held on Wednesday, June 28, 2023, at 10:00 a.m., in Trenton, New Jersey.

 

 PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca, Daniel O’Mullan, and Diomedes Tsitouras; Levi Klinger-Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

  In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

  Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 23, 2022, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

   All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of June 7, 2023.

 

ACTION:      The Civil Service Commission adopted the minutes of its meeting of June 7, 2023

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Darren Brodie, Police Sergeant, Clifton, Department of Public Safety, suspension and demotion.

 

Waclaw Hein, Correctional Police Officer, East Jersey State Prison, Department of Corrections, suspension.

 

Connie Long, Human Services Specialist 1, Burlington County Board of Social Services, release at the end of the working test period.

 

ACTION:     The Civil Service Commission noted the withdrawal of appeal without prejudice.

A-2    SHREEK CRAWFORD – CSC DOCKET NO. 2020-1824

Shreekk Crawford, County Correctional Lieutenant, Essex County, Department of Corrections, 30 working day suspension, on charges of insubordination.  

 

Recommendation of the Administrative Law Judge – Modify the 30 working day suspension to a four working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    JOSEPH HANS – CSC DOCKET NO. 2022-1727

Joseph Hans, Police Officer, Lakewood, Police Department, removal, effective March 2, 2021, on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, neglect of duty and other sufficient cause.   

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    CLAUDIA MARTINEZ – CSC DOCKET NO. 2022-2510

Claudia Martinez, Police Officer, Newark, Department of Public Safety, six working day suspension, on charges of conduct unbecoming a public employee and violation of various departmental regulations.    

 

Recommendation of the Administrative Law Judge – Reverse the six working day suspension.       

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

  

A-5    J.T. – CSC DOCKET NO. 2020-2589

J.T., Police Officer, Trenton, Police Department, removal, effective April 15, 2020, on charges of inability to perform duties, conduct unbecoming a public employee and violation of departmental regulations.    

 

Recommendation of the Administrative Law Judge – Uphold the removal.       

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

  

SECTION B – MISCELLANEOUS MATTERS

 

B-1    BRADLEY BONITO AND ALEXANDER BOYCE – CSC DOCKET NOS. 2023-1602 AND 2023-1609

         

Bradley Bonito and Alexander Boyce appeal the removal of their names from the eligible list for Police Officer (M0047D), Freehold Township on the basis of failure to meet the residency requirement.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

 

B-2    ANTHONY GANDOLFO – CSC DOCKET NO. 2023-1608

         

Anthony Gandolfo appeals the removal of his name from the eligible list for Police Officer (M0047D), Freehold Township on the basis of falsification of the preemployment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    PAUL PROCTOR – CSC DOCKET NO. 2023-1601

 

Paul Proctor appeals the removal of his name from the eligible list for Police Officer (M0047D), Freehold Township on the basis of failure to meet the residency requirement.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

  

B-4    P.G. – CSC DOCKET NO. 2023-2225

         

P.G. requests that her applications for the 2023 Law Enforcement Examination be processed.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-5    STEFAN ENGERS – CSC DOCKET NO. 2023-1006

 

Stefan Engers, represented by Kevin McGovern, Esq., appeals the calculation of his seniority score and final average for the promotional examination for Police Sergeant (PM4672C), West New York. 

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    PATRICK LENTO – CSC DOCKET NO. 2023-1896

 

Patrick Lento appeals his score on the promotional examination for Deputy Fire Chief (PM1790A), Ventnor City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    KAREN LUCKIE – CSC DOCKET NO. 2023-1220

 

Karen Luckie appeals the decision of the Division of Agency Services which found that her position with the Department of Community Affairs is correctly classified as Technical Assistant 3.  She seeks an Administrative Analyst 3 classification in these proceedings. 

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-8    COUNTY CORRECTIONAL POLICE OFFICERS, ESSEX COUNTY – CSC DOCKET NOS. 2023-26 AND 2023-27

         

The Essex County Superior Officers’ Association, Fraternal Order of Police, Lodge No. 106 requests reconsideration of the Civil Service Commission’s final decision, rendered on May 18, 2022, which granted Essex County’s request to make temporary appointments of entry-level County Correctional Police Officers.

 

ACTION:     The Civil Service Commission directed that these requests be denied.

B-9    ISAAC TONEY, JR. – CSC DOCKET NO. 2022-442

         

Isaac Toney, Jr. requests reconsideration of In the Matter of Isaac Toney, Jr. (CSC, decided August 4, 2021), where the Civil Service Commission determined that he did not meet the experience requirements for the open competitive examination for Customer Service Representative (M0585B), Trenton.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-10   RICHARD OLIVA AND SUPERVISOR OF PATIENTS’ ACCOUNTS 1 (S1043A) – CSC DOCKET NOS. 2023-541 AND 2023-2629

 

Richard Oliva appeals the cancellation of the February 15, 2022 certification of the eligible list for Supervisor of Patients’ Accounts 1 (S1043A).  Additionally, Trenton Psychiatric Hospital, Department of Health, requests permission not to make an appointment from the August 30, 2021 and February 15, 2022, certifications of the subject eligible list. 

 

ACTION:     The Civil Service Commission directed that the appeal be denied, and the appointment waiver be granted with no selection costs currently assessed.

  

B-11   ADMINISTRATIVE ASSISTANT TITLES – CSC DOCKET NO. 2023-2744

 

The Division of State Police, Department of Law and Public Safety, requests that the titles of Administrative Assistant 2 and Administrative Assistant 3 be reallocated to the noncompetitive division of the career service on an interim basis to facilitate the initial hiring of staff in its Port Security Section.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-12   FY 2023 SALARY REGULATIONS COMPENDIUM EXTENSION

                  

Supplement 1 of the FY 2023 Salary Regulations Compendium, extending it beyond June 30, 2023, pending the issuance of the FY 2024 Compendium is presented for recording.  This Supplement has been approved by Allison Chris Myers, Chair/Chief Executive Officer, Civil Service Commission, and Tariq Shabazz, Acting Director, Office of Management and Budget.

 

ACTION:     The Civil Service Commission recorded the Supplement.
