Gonadal Shielding Exemption Request
The Department is reviewing exemption request from N.J.A.C. 7:28-15.9(a)3, which states:
“No person shall operate or permit the operation of certified or uncertified medical radiographic and fluoroscopic equipment or therapy simulation systems unless the following conditions are met: Gonadal shielding of not less than 0.5 mm lead equivalent shall be used on a patient during radiographic and fluoroscopic procedures, except for cases in which this would interfere with the diagnostic procedure. If the patient is sterile, the use of gonadal shielding may be omitted.”
To submit an exemption request to the Bureau of X-ray Compliance, a facility must:
- Demonstrate a hardship or compelling need for an exemption as per N.J.A.C. 7:28-2.8;
- Complete the Suggested Policy Template or develop and submit an equivalent Policy Statement; and
- Demonstrate or affirm that if an exemption is granted, the facility will adhere to the exemption request requirements and conditions.
Please note that an exemption request must be submitted by an individual facility and cannot be grouped with other facilities under the same ownership. Exemption requests will be reviewed in the order in which they are received by the Bureau.
