As set forth in In the Matter of Gabriele Spallacci (CSC, decided November 5, 2025) , the Civil Service Commission implemented the decision of the Superior Court of New Jersey, Appellate Division, in In the Matter of Gabriele Spallacci, et al., Docket No. A-1777-23 (App. Div. August 22, 2025) and invalidated the 2019 Police Sergeant examination for the jurisdictions of Newark and Paterson. As a result of this decision, all scores from the 2019 Newark and Paterson Police Sergeant examination have been nullified and candidates who participated in the examination for these jurisdictions will be eligible to retake the examination, tentatively scheduled for late February 2026. Additionally, appointments made from the 2019 Police Sergeant eligible lists for Newark and Paterson are now considered conditional, as well as any other appointments from subsequent Police promotional lists of employees who were originally promoted from these Police Sergeant eligible lists. Individuals serving in positions made as a result of appointments from the 2019 Police Sergeant eligible lists for these jurisdictions will be required to retake the Police Sergeant examination and be appointed from the resulting eligible lists in order to keep their position, or they will be returned to their permanent Police Officer position and their service as a Police Sergeant and any subsequent Police promotional position shall be considered provisional. Regarding candidates from Newark and Paterson who retired from Police service and who do not appear for the examination, agency records shall reflect their Police Sergeant position and any subsequent promotional Police position as provisional.
