A1 - The Notice of LP-Gas Installation has 2 capacity categories. They are:
** Temporary vapor – capacity of 251 but not over 2,000 gallons; and
** Temporary vapor – capacity of 2,001 to 9,999 gallons. 

R1s are for permanent vapor, 2,001 to 9,999 gallons and all liquid transfer up to and including 9,999 gallons.  R2s are for liquid or vapor, 10,000 gallons and greater.  The Notice of LP-Gas Installation category requirements are different from the R1s and R2s. There is no overlap between the 2 forms.  Therefore, if you are submitting a Notice of LP-Gas Installation under one of those 2 categories, then R1s and R2s are not required. And if you are submitting an R1 or R2 form, there is no need to submit the Notice of LP-Gas installation.  The Notice of LP-Gas Installation is for new temporary vapor systems in the 2 categories listed above and the R1 & R2 are for all existing systems. Please note that the latest version of the Notice of LP-Gas Installation is the one designated as “2023 rev. 8”.

A2 - A “Notice of LP Gas Installation” shall be filed with the DCA/LP-Gas safety unit for all systems of 250gal W.C. or more. If the vapor system is over 2000-gallon water capacity, then the permit and inspections are provided via the DCA/LP-Gas safety Unit. If the vapor system is 2000-gallon water capacity or less, the permits and inspections are expedited via the local enforcement agency. Although DCA may not be issuing permits and performing inspections, the notice of installation requirements still applies as indicated above. The LP-Gas safety unit may engage in enforcement activity of any temporary heating system even if we have not issued the permit. This is to ensure LPG regulations are being adhered to uniformly on construction sites.

A3 - These types of resellers are not considered Marketers. Since these are probably R1 registrations, the form requires that the owner of the system to submit the R1 registration form and identify the individuals operating the system and the training program which they have had.

A4 - A qualified employee of an LPG marketer shall undergo all necessary training requirements as directed in N.J.A.C 5:18 10.3 which includes CETP certifications relevant to the job they perform. 

A licensed master plumber, licensed HVACR contractor, and a single-family homeowner who owns their equipment and performs the work are exempt from the CETP requirements and may engage in propane services without limitation

A5 - No, this would be all liquid service or any vapor service over 2000 GWC aggregate storage. Plumbing permits are not required by the local code official for this type of system installation.  Plan review applications for these systems are required to be submitted directly to DCA/LP-Gas Safety Unit who will issue permits and expedite all inspections. 

If the project involves the installation of vapor piping inside the building, a local permit is required for this piping however subcode discipline may vary depending on the building occupancy classification.  There is no local plumbing permit required for the work outside the building where the DCA/LP-Gas Safety Unit does the plan review and inspections.

A6 - LP-Gas System, as defined in 5:18 means: an assembly of one or more containers with a means of conveying LP-Gas from the container(s) to dispensing or consuming devices (either continuously or intermittently) and which incorporates components intended to achieve control of quantity, flow, or pressure in the liquid or vapor state.  More than one container in a System usually means that they are manifolded together. Aggregate water capacity is the total water capacity of the containers within the System. 

Examples:

** Existing 4 – 1,000-gallon tanks at a greenhouse. If these are manifolded together, then an R1 form must be submitted to DCA. Not manifolded together – Apply for a permit with the local enforcing agency.

** New 4 - 1,000-gallon tanks, manifolded. Plans must be submitted to DCA for review and approval. Not manifolded – Apply for a permit with the local enforcing agency.

A7 - The individual or company who owns the tank, in most cases, also owns the appurtenances associated with the containers.

A8 - If a registration is submitted to the Division, it is usually for systems that were either not registered from initial installation or do not qualify to meet the plan review requirements; plan review applications are often used in lieu of registration forms. Once the Division is in receipt of the form, the form will be verified that the LPG system qualifies to be registered with the division and an inspection will be scheduled for that LPG system. If there are no violations, a certificate of operation (permit) will be affixed to the tank noting that the system can be operated.  If there are violations, an inspection report will be issued with a timeframe in which to correct the violations. A re-inspection will then occur on or before the proposed compliance date.  All LP Gas systems under the Division’s jurisdiction are subject to annual inspections. Bulk facilities will be audited once every three years.

A9 - No, the Manual does not have to be “sealed” or prepared by a Professional Engineer.

A10 - Yes, however DCA does not regulate pricing or act as an intermediary regarding fees, monetary or contractual disputes. N.J.A.C. 5:18-11.2 gives specific guidelines on the pricing policy to the consumer which the LPG marketer must adhere to (link below). All monetary and contractual disputes should be brought up directly with the LP Gas marketer. All other complaints should be handled as prescribed below.
