Executive Order 295

On May 3, 2022, Governor Murphy signed Executive Order 295 . The Executive Order directs the Department of the Treasury (Treasury) to develop a State-backed certification program for the registration/certification of LGBTQ+-owned business enterprises.

The new certification is designed to help LGBTQ+ - owned businesses grow and thrive by opening doors to pursue contracting opportunities at the local, state and federal level, as well as with the private sector.

Treasury is now in the process of drafting administrative rules for the program, which will be modeled on rules for Minority/Woman Owned Business Enterprises (MWBE), and is working on the administrative systems required to implement the certification process. Generally, the rules and processes will address:

  • Eligibility criteria for LGBTQ+-owned businesses
  • Informational requirements for submitting a certification application
  • Online services for streamlined processing of applications
  • Procedures for the acceptance of LGBTQ+-owned certifications granted by other certifying authorities
  • Due process for appealing or challenging certification decisions
  • Posting of information about certified LGBTQ+-owned businesses on a public website such that LGBTQ+-owned business enterprises may be identified as such with regard to contracting and responding to bid solicitations, requests for information and other proposals
