Mission

The New Jersey State Police Port Compliance Bureau is committed to ensuring that compliance standards and activities within the Port of New Jersey are followed to ensure operational efficiency. By conducting audits and regulatory oversight for compliance, we can ensure businesses comply with relevant laws and regulations promoting ethical port activity.

Vision

The Port Compliance Bureau is focused on port access, denials, suspensions, revocations, and decasualization, as well as ensuring administrative law proceedings are correctly and expeditiously reviewed with integrity to eliminate backlogs and protect workers’ rights.

Overview

The Port Audit & Compliance Unit is responsible for the performance of payroll audits and compliance audits. Payroll audits are conducted to ensure companies and funds pay the correct quarterly assessments, assessments are properly received, and all covered personnel are accurately registered with the Port Security Section. Compliance audits are conducted to ensure the licensed companies working in the Port operate with good character and integrity.

In addition to the audits, the Port Audit & Compliance Unit is responsible for the collection of quarterly assessments that are computed upon the gross payroll payments made by employers to longshoremen, pier superintendents, hiring agents, and port watchmen for work or labor performed on the New Jersey side of the Port.

Assessments

It is mandatory that employers pay assessments on gross payroll for:

  • All individuals holding a temporary registration or permanent registration as a Longshore Worker (“LS”), Maintenance Worker (“A”), Hiring Agent (“HA”), Pier Superintendent (“PS”), Checker (“CK”), and Telecommunications System Controller (“TSC”).
  • All individuals holding a temporary permit or permanent license as Port Watchmen/ Security Officer (“SO”, “SSO” or “MSO”).
  • All payments to vacation/holiday or other funds (e.g., MMMCA, SANYNJ).
  • All individuals who act in the capacity of those described above and/or who directly or indirectly handle waterborne freight or perform services incidental to the movement of waterborne freight, regardless of whether or not the individuals hold a temporary registration, registration, temporary permit and/or license with the New Jersey State Police, Port Licensing & Background Unit.

Notes:
  • Incidental services include, but are not limited to, cargo storage, cargo repairing, coopering, general maintenance, mechanical and miscellaneous work, marine carpentry, cleaning, power sweeping, intra-port trucking, vehicle preparation, and/or export packing.
  • All individuals holding a temporary permit or permanent license as Port Watchmen/ Security Officer (“SO”, “SSO” or “MSO”).
  • Failure to pay assessment on payroll described shall be assessed interest at a rate of one percent (1%) on the amount due and unpaid and penalties, at a rate of five percent (5%) on the amount due and unpaid for each 30 days or part thereof the assessment remains unpaid.
  • Any person who shall willfully furnish false or fraudulent information or shall willfully fail to furnish pertinent information, as required, with respect to the amount of assessment due, shall be guilty of a disorderly person’s offense.
  • Every person subject to the payment of assessment hereunder shall keep an accurate record of that person’s employment of longshoremen, pier superintendents, hiring agents, or port watchmen, which shall show the amount of compensation paid and other information as the division may require. Those records shall be preserved for a period of three years (3) and be open for inspection at reasonable times. The Division of State Police may consent to the destruction of the records at any time after that period or may require they be kept longer, but not more than six years (6).
Quarterly Assessment Information and Form

Quarterly assessments, accompanying forms (SP 85J – Quarterly Payroll and Assessment Form) and worksheets are due by the 30th day of the month following the end of each calendar quarter. The forms must be submitted by April 30th, July 30th, October 30th and January 30th (following year). Please review and follow the instructions detailed on the form. The information provided will be used for the collection of quarterly assessments and the related figures and totals. The certification page must be completed by the individual compiling the form to certify that the individual completing the form is authorized to do so and that the information contained therein is true and correct.

NOTE: The current assessment rate is 1.60%

Port Discovery & Adjudication Unit

The Port Discovery & Adjudication Unit is responsible for the intake and processing of arrest notifications, scheduling and managing hearings, and providing discovery documents for incidents related to the shipping industry workforce, following Chapter 324 of New Jersey law. In addition, they will provide the administration and adjudication of potential discipline resulting from said hearings.
