New Jersey Redevelopment Authority Presents a Workshop on "The 'But For' Test and Tax Abatements" - A Crucial Insight into Economic Development Incentives

TRENTON, NJ – The New Jersey Redevelopment Authority (NJRA) is proud to announce its upcoming Training Institute workshop, titled "The 'But For' Test and Tax Abatements," set to take place on December 5, 2023, at 10 a.m. at Thomas Edison State University.

“Tax abatements are a sought-after public incentive for enhancing the financial viability of private sector development projects,” said Leslie A. Anderson, President and CEO of the NJRA. “This workshop will provide attendees with a comprehensive understanding of the "But For" Test and the intricacies of tax abatements, equipping them with the knowledge needed to navigate the complexities of this essential economic development tool.”

In addition to the comprehensive workshop content, the session features a series of experts in the field that will provide case studies and further context, including Calvin Souder, Esq., partner at Souder, Shabazz, & Woolridge; Jeffrey M. Gradone, Esq., partner at Archer & Greiner, P.C.; Bryan Morris, managing director at Phoenix Advisors; and Kevin P. McManimon, Esq., managing partner at McManimon, Scotland & Baumann LLC.

Souder is a seasoned attorney specializing in real estate law and tax abatements. With a wealth of experience in advising clients on navigating the intricacies of tax incentive programs, Souder will share his insights on PILOT programs, the 5-year Exemption and Abatement Law, the Long Term Tax Exemption Law, and HMFA Tax Abatements.

A respected attorney known for his expertise in municipal law and redevelopment, Gradone will share his understanding of the legal framework surrounding tax abatements and will provide attendees with valuable insights into proformas and project assessment.

Morris brings a wealth of financial expertise to the workshop. He has extensive experience in structuring and negotiating financial agreements between property owners and municipalities. Morris will shed light on the financial aspects of tax abatements.

McManimon is an accomplished attorney with a focus on redevelopment law. His insights will offer valuable guidance on navigating the Regulated Asset Base (RAB) model as an alternative financing source.
